Of- said total authorized bonds, bonds ag­gregating the principal amount of $3,000,000, of which this bond is one, are being presently* issued, said issue consisting of 3,000 bonds, numbered from 1 to 3000, both numbers inclu­sive, all of said bonds being of like date, denomination and tenor except a* to number, redemption privileges (if any) and dates of maturity. The bonds aforesaid have been , duly au­thorized and issued for the purpose of taking up and paying for at par $1,054,000 principal amount of Pub­lic'Levee Revenue Bonds of the City of Kansas City* Kansas, dated Feb­ruary 1, 1936, heretofore issued for ,*the purpose of securing funds to f provide for the cost of improving, constructing, reconstructing and •-repairing the Public levee, docks, wharves, river terminals. grain elevator terminal docks and such works, storage structures, facili­ties and properties as wilt make the publicly owned Levee of sa'd City convenient and' accessible for use in connection with water trans­portation on the navigable rivers adjoining such Public Levee, and for the purpose of securing additional jfunds for making said improvements, and for making additional Improve­ments and extensions to the Public Levee of said City, by the authority of and in full compliance with the provisions, restrictions and limita­tions contained in Chapter 43 of the Laws of . Kansas. Special Session, 1933, being Sections 13-1238 to 3 3-1245, inclusive, of the General Statutes of Kansas, 1935, as amended by Chapter *35 of the Laws of Kan­sas, 1937. and all sections to which said statutes are amendatory and supplemental, and in compliance with all other applicable provisions of the Constitution and laws of the State of Kansas, and in conformity with ordinances duly passed, ap­proved and published and proceed­ings duly taken by the governing body of said City of Kansas City. . Ordinance Ho# THIS BOND and the interest hereon are payable solely from the money and revenue received by said City from tba fees charged and rental received for the use of the property and facilities Improved, constructed, reconstructed, repaired or otherwise Improved by the pro­ceeds, in whole or in part, of the revenue bonds of said City, issued or to be issued as aforesaid, and not from any other fund or -source. This bond shall not be or constitute a genergl obligation of said City of Kansas City. Kansas. The statute under which this bond is issued provides, among other things (Section 13-1242, G. S.. Kan.. 1935), as follows: “Provision shall be made by the governing body of such city for tho payment of said bonds, by fixing rates and charges for the use of and the services to be rendered by such property and fa­cilities. which rates and charges so fixed shall be sufficient to pay all expenses of the city in connection therewith and cover the cost of op­eration and repairs, pay all inter­est charges upon all indebtedness created for the purpose of improv­ing, constructing, reconstructing, re­pairing or improving of such public levee and the improvements and facilities thereon for which auch revenue bonds were issued to so improve, construct, reconstruct or repair and to provide a sinking fund sufficient to pay off such in­debtedness at maturity.” The City of Kansas City.
