pumping stations to be constructed by the Union Pacific pursuant to the provisions of Section 3 hereof, said new pipelines, appurt-enanees and pumping station shall be constructed, and said pipe lines shown by broken black and red line on Exhibit MA~1H shall be removed, under the Joint direction of the District and Union Pacific pursuant to a contract to be entered into between the Union Pacific and a contractor after bids have been obtained there* for. In the event the Union Pacific and District shall be unable to agree upon the type and nature of said new pipe lines and pumping station, Union Pacific shall nevertheless have the right to construct said facilities as provided in Section 3 and to remove said pipe llnea shown by broken black and red lines on Exhibit "A-l* pursuant to a contract to be entered into between the Union Pacific and a contractor after bids have been obtained therefor, Xn either event the contract price thereof plus 10$ for supervision shall be considered as the cost to Union Pacific of constructing said new pipe line facilities and pumping station and removing said existing pipe lines, Section 5, Zn the event the pumping station referred to in subparagraph (c) of Sections 2 and 3 hereof shall be relocated as therein provided, Union Pacific agrees to grant to the District by separate instrument a parcel of land approxlmagely 5 ,000 square feet in area as a site for said relocated pumping station shown by green square near point ft on Exhibit *A-1% said grant to be subject to reversion to the grantor, its successors or assigns, when the District, its successors or assigns, shall cease to use said land as a site for a pumping station. In the event the District shall abandon the use of said pumping station on said land, the District at its sole expense, and within ninety (9 0) days after said abandonment, shall remove said pumping station and restore the surface of the ground to the condition existing prior to the construction of said pumping station.
