Bennett, General Solicitor Dear Sir: We are in receipt of a copy of a letter you sent to Mr. Robert A. Allen, Chairman of Nevada Public Service Commission, under date of August 20, 1953 File 80-12. As disclosed by your letter to Mr. Allen, we have been purchasing water quite a few years from the union Pacific Railroad Company, it is also disclosed by your analysis of water bills that from November of 1952 through April of 1953 our highest bill was $38.23 in April of 1953. You further state in your letter, ”As you know, these ready mix concrete plants use a very large volume of water and since Mr. Hen­derson's competitor, Young & Smith, agreed to the $50.00 basic charge, it would seem that Mr. Henderson would have no serious grounds for objection.” In view of the fact that we have been in the ready mixed concrete business for a number of years longer than Young & Smith and our water has always been metered, thereby disclosing the quantity used and this fact disclosed by your analysis to the Public Service Commission, we can not feel that you are justified to increase our monthly bill a mini­mum of $15.00 a month over what you disclosed to have been the volume of water used and recorded by the union Pacific Railroad. We also note in your analysis that you apparently have just taken an arbitrary stand on most of the small accounts and increased, in one Instance, namely Coco Cola Company whose account was running around $30.00 a month, you reduced the tariff charge to $18.90. Another account, L. R. Fayle which account was running an average of $12.00 a month, ypu reduced the tariff to $5.35. However on our account.
