, ; i' . • and to this end shall furnish the owner with a bond in the sum of $2500*00 to insure the faithful performance of this contract and to save the owner harmless from any of the consequences flowing theref rom, IX* It is further agreed and understood by and between the parties hereto, that from the commenceiani to the completion of every part of the work under this contract, the same, and all materials and things upon or near the premises, whether placed thereon or not, shall be deemed to be, and shall become the property of said owner, but it shall not be responsible, charged or chargeable for anything lost, stolen, damaged, destroyed or removed from the building or premises, or that shall fail in any way whatever; and the care of the same and everything connected therewith, or appertaining thereto, shall be with the builder, who shall protect and preserve entire and uninjured the whole of said work and material; and if any injury or disfigurement shall be done thereto by fire, or by the inclemency of the weather, or by accident of any description, or by the workmen employed, or by any other means whatsoever, then, and in every such case, the builder shall completely repair or replace the same, as the case may be, at his own cost, and upon completion of said work, remove all the scaffolding, rubbish, and materials then remaining in and about the said building, and leave the premises in a perfect and proper condition. X. It is further agreed and understood that the builder shall not assign or underlet this contract for the execution of the work, or any part thereof, or let out any part of the work by the piece or job, but will during the whole time of building, and until the completion of said building and work, give due personal attention in the execution thereof in order that the same may be carried on, -4—
