1 repairing and replacing water pipe lines and appurtenances under 2 and along said easement strips. Grantee, its successors and assigns, 3 shall have reasonable access within said easement strips for said 4 purposes, but at their sole cost and expense shall be required to 5 take such steps as are required by sound engineering practice to 6 support said railroad tracks and appurtenant facilities, prevent 7 damage thereto or interruption of service thereover. 8 Except in the case of emergency Grantor, its successors 9 and assigns, shall not be entitled to make excavations upon or in 10 the vicinity of said easement strips which might endanger the water 11 pipe lines and appurtenances therein of the grantee, its successors 12 and assigns, or to remove or disturb any such water pipe lines and 13 appurtenances for the purpose of constructing, maintaining, operat- 14 ing, repairing or replacing said railroad traeks or railroad operat- 15 ing facilities until after hours' notice to the Grantee, its 16 successors and assigns; and in the case of emergency immediate no- 17 tice of such work shall be given to the agents or employees of the 18 Grantee, its successors and assigns, who can be found nearest to the 19 p o in t o f work. G ra n to r, i t s s u c c e s s o r s and a s s ig n s , s h a l l n ot be 20 entitled to temporarily remove or disturb any water pipe lines ex- 21 cept after having given notice hereinbefore provided and unless and 22 until Grantor, its successors and assigns, shall have taken such 23 steps as are required by sound engineering practice to prevent the 24 interruption of water service to customers and the distribution of 25 water to areas then being served by said water pipe lines. 26 any water pip© lines and appurtenances shall have been 27 EXHIBIT 28 Page 3
