I agree.L a s Vegas Valley W ater D istrict - pg. 5 May 4 , 1953 I am unable to find handily where the rule against perpetuities is involved in case of a covenant in the nature of a restriction such as this would be. In other words, the railroad company is to give the district an instrument in which the railroad covenants that no wells will be drilled upon the lands retained by it, for a period of 50 years. M r. Hamilton and I discussed this "covenant - condition" proposition over the phone, and I will have to give it some more study.
