***** November 8 , 19 5^ Files 80-11 Mr. Leo McNamee El Portal Building Las Vegas, Nevada Dear Leo: The agreement dated the First day of June, 1953* between the Railroad Company, the Water Company and the Water District provided in Section 6 thereof that the land, etc., shall be conveyed to the District upon the sale date "subject to all taxes levied and assessed upon, or properly attributable to, any of said property in the year in which the sale date occurs * * I presume you know that by deed dated July 18, 1953* the Union Pacific, having acquired the property from the LA&SL, conveyed to the Las Vegas Land and Water Company the real estate described in the contract of June 1, 1953; and thereafter, by deed dated June 1, 195^* and placed in the escrow, the Water Company conveyed the same land to the Water District. Therefore, the first of the year 195^ this land, standing in the name of the Water Company, was subject to taxes levied and assessed against it, and the Water District took such land subject to such taxes. I understand that the property of the District is not subject to local city and county taxes, and I presume, therefore, that it will be relieved of the taxes on this property which it acquired along about July 1, 195^* when the deed was placed in escrow and presumably recorded by the title company. I understand that the Nevada tax bills are not yet out, but I presume we will get ours in the near future, and I am wondering how you would like this
