The Company agrees: 1. Upon the execution of this agreement, the payment of the sum of THREE THOUSAND ONE HUNDRED EIGHTY DOLLARS ($3,180.00) specified in Paragraph 1 of Article I hereof, and the furnishing of necessary easements, and the furnishing of the policies of title insurance aforesaid, to order the necessary pipe, fittings and othe r material and upon the arrival of pipe and materials aforesaid at Las Vegas, to proceed with the installation of said water main along the lines so staked upon the ground by the Subdivider, and to com­plete the said installation with reasonable diligence. Said water main shall consist of 6" and 4W cast iron pipe* Construction of said water main shall not be commenced until the provisions of this subdivision 1 have been complied with* 2. To pay to the Subdivider, at quarterly intervals, thirty-five percent (35$) of the monthly revenue received by it from customers located within said Acres Addition Tract, taking direct service from water mains installed hereunder for a period of ten (10) years from date of completion of said installation or until Subdivider has been repaid the actual cost advanced by him (exclus­ive of the cost of installing said fire hydrant connections) which­ever first occurs* -3- j . / ; i
