THIS AGREEMENT, made and entered into as of the 20th day of October, 1 9 by and between LAS VEGAS LAND AND HATER COMPANY, a corporation of the State of Nevada, hereinafter called "Company", Party of the First Part, and PHILIP A. SHIPLEY, V.J. MOORS, JR., and BALLARD BARRON, all of Las Vegas, Clark County, Nevada, hereinafter called "Subdivider, Parties of the Second Part, WITNESSETH: RECITALS WHEREAS, the Company is engaged in the business of distributing water as a public utility, in the City of Las Vegas, Clark County, Nevada; and WHEREAS, the Subdivider is engaged in the development of Crestvood Homes Tract as per plat thereof on file and of record in Clark County, Nevada Records at the easterly city limits along Charleston Boulevard in the City of Las Vegas, Clark County, Nevada; and WHEREAS, the Subdivider proposes to immediately construct 36 hisses in Block 1, 2 and the North half of Block 3 of said Tract and desires water service to said hemes; and WHEREAS, the Subdivider proposes, in the future, to construct 78 homes in the South half of Block 3 and in Blocks 4,5,6,7, and 8, and will require water service to said homes when constructed; and WHEREAS, the Company is willing to serve said homes with waters AGREEMENT ARTICLE I Subdivider agrees: 1. At its own expense, to furnish all necessary materials and labor and to construct water mains in location as indicated by solid yellow line on Exhibit "A", attached hereto and made a part hereof, and being more - 1 - A-3!
