AN ORDINANCE TO PROMOTE THE PROTECTION OF HEALTH, COMFORT, SAFETY, LIFE, WELFARE AND PROPERTY OF THE INHABITANTS OF THE CITY OF LAS VEGAS, AND FOR THE PRESERVATION OF PEACE AND GOOD ORDER; FOR THE “SUPPRESSION AND PREVENTION OF VICE WITHIN THE CITY BY PROHIBITING LOITERING AND PROWLING UPON PUBLIC AND PRIVATE PROPERTY IN THE NIGHTTIME; BY PROVIDING FOR PENALTIES FOR THE VIOLATION; PROVIDING FOR OTHER MATTERS PROPERLY RELATED THERETO; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. WHEREAS, the Board of Commissioners of the City of Las Vegas under the provisions of the Charter of said City, are authorized to adopt and enforce ordinances which they deem expedient and necessary for the promotion and protection of health, comfort, safety, life, welfare and property of the inhabitants of the city, and the preservation of peace and good order, and the promotion of public morals and the suppression and prevention of vice within the City; and WHEREAS, many persons within the City of Las Vegas have been reported wandering and prowling about the public streets and alleys of the City and upon the private premises of others in the, nighttime, without any legitimate business in so doing; and WHEREAS, it is deemed necessary for the protection of the people of the City of Las Vegas that an ordinance be adopted to prohibit such actions; NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Las Vegas, as follows: SECTION 1. Every person who loiters, prowls, or wanders upon the public streets, alleys and other public places within the City in the nighttime without visible or lawful business in so doing; or who while loitering, prowling, or wandering upon the public streets, alleys, or other public places, peers or peeks in the window or door or a building or structure located adjacent thereto which is inhabited by human beings, without visible or lawful business with the owner or occupant thereof, shall be guilty of a misdemeanor. SECTION 2. Every person who loiters, prowls, or wanders upon the private property of another in the nighttime, without visible or lawful business with the owner or occupant thereof; or who while loitering, prowling or wandering upon the private property of another in the nighttime, peers or peeks in the window or door of any building or structure located thereon which is inhabited by human beings, without visible or lawful business with the owner or occupant thereof shall be guilty of a misdemeanor. SECTION 3. Every person convicted of violating this ordinance shall upon conviction thereof be punished by a fine of not more than $500.00, or by imprisonment in the City Jail for not more than six (6) months, or by a combination of both. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. This ordinance shall be in full force and effect upon its adoption and publication as in the next section provided. SECTION 6. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this ordinance to be published once a week for two successive weeks immediately following its first reading and adoption, in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas. _____C.
