    WHEREAS, the Federal Narcotic Laws impose no penalty on the addict since the problem is consid­ered local; and WHEREAS, the drug addict spread physical destruction and moral degradation in his wake and is a menace to the community; and WHEREAS, it has been demonstrated that the non-medical addict is not usually capable of follow­ing a legitimate occupation while addicted to narcotic drugs and will therefore engage in criminal activit­ies to obtain funds with which to purchase his supply of narcotics; and WHEREAS, it is necessary for the safety, welfare, and property of the inhabitants of this City and for the preservation of peace and good order and for the promotion of public morals and the suppression and prevention of vice in the City of Las Vegas that steps be taken to commit non-medical drug addicts to the City Jail; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF US VEGAS AS FOLLOWS: Section 1. That the Municipal Judge upon the voluntary application to him of any non-medical habitual user of narcotic drugs, shall commit such person to the City Jail. Section 2. Whenever a complaint is made to the Municipal Judge that any person is a non-medical habitual user of any narcotic drug, accompanied by a certificate executed by the City Health Officer and Jail Physician or from any other duly licensed physician certifying that such person is a non-medical habi­tual user Of narcotic drugs, he shall after trial of the truth of such complaint, commit such person to the City Jail for drug addiction. Section 3. Discharge, No person, whether committed upon voluntary application or upon complaint being filed, shall be discharged sooner than six months from the date of such commitment, unless the City Health Officer and Jail Physician or from any other duly licensed physician shall certify to the committing magistrate that any person so committed has received maximum benefit from such treatment* Section 4. For the purposes of this ordinance a non-medical habitual user of narcotic drugs shall mean any person who uses narcotic drugs merely to satisfy a craving for such drugs and who does not have a legitimate medical need for narcotic drugs. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby expressly re­pealed. Section 6. This Ordinance shall be in full force and effect upon its publication as in the next section provided, and final passage. Section 7. The City Clerk and the Clerk of the Board of Commissioners of the City of Las Vegas shall cause this Ordinance to be published once a week for two successive weeks immediately following its first reading and adoption, in the Las Vegas Review Journal a daily newspaper published in the City of Las Vegas. s/ C.D. F. Schellack, being first duly sworn, deposes and says: That he is Foreman of the LAS VEGAS REVIEW-JOURNAL, a daily newspaper, of general circulation, printed and published at Las Vegas, in the Comity of Clark, State of Nevada, and that the attached was continuously published in said newspaper for a period of two (2) insertions from Aug. 25, 1952 to Sept. 1, 1952 inclusive, being the issues of said newspaper for the following dates, to-wit: Aug. 25, 1952 — Sept. 1, 1952.
