ORDINANCE NO. 438 AN ORDINANCE TO AMEND CHAPTER 6, SECTIONS 5 AND 6 OF THE LAS VEGAS CITY CODE PROVIDING FOR THE REGISTRATION AND OPERATION OF BICYCLES IN THE CITY OF LAS VEGAS AND PROVIDING PENALTY FOR VIOLATION THEREOF, AND TO REPEAL CHAPTER 6, SECTION 8 OF THE LAS VEGAS CITY CODE. The Board of Commissioners of the City of Las Vegas do ordain as follows: Section 1. Chapter 6, Section 5, of the Las Vegas City Code is hereby amended to read as follows: (a) The Chief of Police, upon receiving proper application therefor, and a fee of fifty cents (500), shall be authorized to issue a bicycle license which shall be effective for the lifetime of the bicycle unless it is sooner traded, sold, or otherwise disposed of, in which case the new owner shall renew the license the same as upon an original application. (b) The Chief of Police shall not issue a license for any bicycle when he knows, or has reasonable ground to believe, that the applicant is not the owner of, or entitled to the possession of such bicycle. (c) The Chief of Police shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued, and the number on the frame of the bicycle for which issued. Section 2. Chapter 6, Section 6, of the Las Vegas City Code is hereby amended to read as follows: (a) The Chief of Police, upon issuing a bicycle license, shall also issue a license plate bearing the license number assigned to the bicycle, and the name of the City. (b) The Chief of Police shall cause such license plats to be firmly attached to the rear mudguard or frame of the bicycle for which issued in such position as to be plainly visible from the rear. (c) No person shall remove a license plate from a bicycle during the period for which issued except upon a transfer of ownership or in the event the bicycle is dismantled and no longer operated upon any street in the city. (d) It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highways of the City of Las Vegas, without first procuring a license as herein provided. Section 3. Chapter 6, Section 8, of the Las Vegas City Code is hereby repealed. Section 4. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor. Section 5. If any part, provision or section of this ordinance or the application thereof to any person or circumstance shall be held to be invalid by any court of competent jurisdiction, the remainder of this ordinance or the application of such part, provision or section thereof to any other person or circumstances shall not be affected thereby. Section 6. This ordinance shall be in full force and effect upon its final reading and adoption, and final publication as in the next section provided. Section 7. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this ordinance to be published once a week for two successive weeks immediately following its first reading and adoption, in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas. The above and foregoing ordinance was first proposed and read by title to the Board of Commissioners on the 7th day of September, 1950, and referred to the following committee composed of Commissioners Moore and Whipple for recommendation; thereafter the said committee reported favorably on said ordinance on the 15th day of November, 1950, which was the regular meeting of said Board of Commissioners; that at said regular meeting held on the 15th day of November. 1950, the proposed ordinance was read in full to the Board of City Commissioners as first introduced and adopted by the following vote: Voting "Aye": Commissioners Peccole, Moore, Whipple and His Honor_____________________________ Voting "Nay": Commissioner_____Bunker________________________________________________________________________ Absent: _____None__________________________________________________________________________ APPROVED: (SEAL) __________E.W.
