Squires being duly sworn, deposes and says: That he is Managing Editor of LAS VEGAS AGE, a weekly newspaper of general circulation, printed and published at Las Vegas, in the County of Clark, State of Nevada, and that the attached Ord. #246 was published in said newspaper for a period of 2 weeks from February 10 to February 17, 1939 inclusive being the issues of said newspaper for the following dates, to-wit: Feb. 10 and Feb. 17, 1939. That said newspaper was regularly issued and circulated on each of the dates above named. That the legal charge for publishing said legal notice was $39.80. Signed J. W. EMERGENCY ORDINANCE ORDINANCE NO. 247 AN EMERGENCY ORDINANCE TO PROHIBIT THE WASTE OF WATER: REFINING WASTE OF WATER: REGULATING THE USE THERE OF: AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE: AND REPEAL- ING ALL ORDINANCES IN CONFLICT THEREWITH. The Board of Commissioners of the City of Las Vegas do ordain as follows: WHEREAS, the City of Las Vegas is threatened with a water shortage on account of the diminishing supply flowing from the artesian wells in said City and on account of the pre­sent waste thereof by the inhabitants of said City, and WHEREAS, the capacity of the sewer system of the City is overtaxed by reason of water wasting into the sewers without being put to a full beneficial use; and WHEREAS, the Board of City Commissioners deem it expedient and necessary for the protection of health, comfort, safety, life welfare and property of the inhabitants of said City to regulate the use of water therein and to prevent the waste thereof, NOW, THEREFORE, Section 1. Waste of water in the City of Las Vegas is hereby prohibited and declared un­lawful. Section 2. Any one of the following acts shall constitute waste of water, as the term is used in this ordinance. (a) Permitting a hydrant, tap, cock or valve connected with any water system belonging to any public utility, to leak onto the ground or into any sink, bowl, toilet or tub connected with a sewer or cesspool, or permitting water to drain from a person's premises any street, alley, or road, after the person permitting the same has been notified to remedy such leak or to prevent such draining by any public officer, or an agent of any public utility, as hereinafter defined ; (b) Using water from any water system belonging to any public utility for the purpose of cooling any refrigerator, refrigerating machine, ice plant, ice machine, cooler, cooling plant, cooling system, air conditioning machine or apparatus, engine or motor, where said water, after being so used, is permitted to flow into a sewer or cesspool or onto the ground, provided, however, that the use of water for such cooling purposes is not pro­hibited where, after being so used, it is collected, recooled and re-used, and is not permitted to flow into a sewer, cesspool, or onto the ground;
