Mr. Wade stated that he was of the opinion that this was the only way this could be accomplished since the water rights on the McNeil well had never been properly revoked by the State Engineer and he had been further advised by the State Engineer that the proper steps had not been taken in previous years to revoke this water right. He said that he had been advised by the State Engineer that no new rights would be granted for irrigation purposes in this area. Thereafter Commissioner Fountain moved this matter be held in abeyance to see if a solution can be worked out. Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. Mr. George E. Wade, Director of Public Works presented the request of Clark County for right-of-way through the property owned by the City in Sections 15, 17 in T21S, R61E, MDB3tM. Commissioner Fountain moved that the City grant the County 100 feet and 80 feet instead of 140 feet as requested down to the quarter line, and 80 feet from thereon; further that 40 feet be granted east of the line of the City property leased by Harrison Stocks. Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. Consideration was given to the report from the South 5th Street property owners concerning the parking ban in this area from San Francisco to Oakey Boulevard. His Honor asked if there was anyone present to speak on this matter. No one appeared, and no action was taken by the Commission. Assistant City Attorney, Ralston Hawkins requested that the City authorize the Attorney's office to release the les pendens on file on the certain portion of Charleston Village Tract No. 1. He explained that a portion of the property is covered by a bond put up for off-site improvements by the developers of the new shopping center. He further explained there would be no difficulty on the suit on the remainder of the property. Commissioner Sharp moved the request of the City Attorney's Office be approved and the les pendens released. Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. Commissioner Whipple moved the application of Suzie Forsyth for a Beer license at Susie's Snack Bar, 222 North Main Street be approved.
