A RESOLUTION COVERING ANNEXATION PROCEDURE. WHEREAS, the Charter of the City of Las Vegas provides for annexation of lands under certain conditions; and WHEREAS, it is the desire of the Board of Commissioners to adopt a uniform procedure in relation thereto; and WHEREAS, no fees therefor have been established and it is desirable to fix fees, to cover the expenses of the City incurred in annexation proceedings; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Las Vegas, that the filing fees for the Petition for Annexation shall be as follows: a. A filing fee of twenty-five ($25.00) dollars shall be charged for each petition containing lands of forty (40) acres or less. b. An additional fifteen ($15.00) dollars shall be paid by the applicant for each additional forty (40) acres or fraction thereof. c. Provided that no fee shall be charged for the annexation of any property in which the City of Las Vegas shall have been the petitioner. BE IT FURTHER RESOLVED that the following procedural steps shall govern: a. The Petition for Annexation shall be filed with the City Clerk and shall be accompanied by a plat of the proposed land to be annexed, on linen, signed by a registered engineer. b. The City Clerk shall notify the City Manager and department heads by memorandum that an application is on file and refer the application and plat to the Planning Department. c. The Planning Department shall check the land use and zoning, secure additional prints, if needed, from the Engineering Department, and compile information and recommendation from the Department of Public Works, covering utilities, drainage, topography, etc., and shall refer the application to other city departments for appropriate recommendations. The Planning Department thereupon shall coordinate the recommendations of the various departments and present the matter to the Planning Commission for approval or disapproval. Upon approval by the Planning Commission, the petition shall be referred to the City Attorney for legal study and comments, and upon completion thereof the City Clerk shall transmit the file and recommendations to the City Manager. d. The City Manager shall place the matter on the Agenda for the Board of City Commissioners for their consideration. Upon tentative approval by the Board of City Commissioners, the City Attorney shall prepare an annexation ordinance and present to the Board of City Commissioners for their action. e. Upon adoption of annexing ordinance by the Board of City Commissioners, a plat of the land to be annexed shall be filed with the County Recorder of Clark County by the City Engineer who shall notify the Director of Finance so that license fees, utility charges, etc. can be established. BE IT FURTHER RESOLVED that this Resolution shall take effect immediately on adoption by the Board of Commissioners. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Bunker, Sharp, Fountain, Whipple and His Honor voting aye; noes, none. Commissioners Fountain and Whipple, committee for recommendation on the proposed amendment to the liquor ordinance, requested additional time before reporting. Commissioners Sharp and Whipple, committee for recommendation on the proposed amendment to the Planning Commission ordinance concerning Use Permit, Variance and Rezoning applications requested additional time before reporting. Commissioners Fountain and Sharp reported favorably on the proposed ordinance to create Assessment District No. 200-17, for the installation of sewers in the Westside Area of the City. Thereafter Commissioner Sharp introduced and moved the adoption of the following ordinance, which was thereupon read in full and at length, and is as follows: AN ORDINANCE DECLARING THE DETERMINATION OF THE BOARD OF COMMISSIONERS OF THE CITY OF LAS VEGAS, NEVADA, TO MAKE CERTAIN PUBLIC IMPROVEMENTS IN THE CITY OF LAS VEGAS BY INSTALLING A SANITARY SEWER ALONG CERTAIN STREETS AND ALLEYS AND PORTIONS OF STREETS AND ALLEYS AND EASEMENTS THEREIN; TO CREATE SANITARY SEWER IMPROVEMENT ASSESSMENT DISTRICT No. 200-17 FOR THE PURPOSE OF MAKING SAID IMPROVEMENTS, AND TO DEFRAY THE ENTIRE COST AND EXPENSES THEREOF BY SPECIAL ASSESSMENTS MADE ACCORDING TO BENEFITS; FIXING A TIME IN WHICH PROTESTS AGAINST THE PROPOSED IMPROVEMENTS OR THE CREATION OF SUCH DISTRICT MAY BE HEARD AND CONSIDERED BY SAID BOARD; DIRECTING NOTICE THEREOF TO BE GIVEN AND PROVIDING OTHER MATTERS RELATING THERETO.
