Amendment to H.R. , as Reported (Energy and Water Development Appropriations, 2003) Offered by Ms. Berkley of Nevada At the end of the bill (before the short title), insert the following: 1 SEC. . It is the sense of the Congress that the 2 Nuclear Regulatory Commission should not certify any 3 package pursuant to section 180(a) of the Nuclear Waste 4 Policy Act of 1982 (42 U.S.C. 10175(a)) for the transpor- 5 tation of spent nuclear fuel under subtitle A of title I of 6 such Act, unless the safety of the package has been estab- 7 lished through a full-scale physical testing process that in- 8 eludes the following: 9 (1) Meaningful stakeholder participation in the 10 development of testing protocols and in the selection 11 of test facilities and personnel. 12 (2) Full-scale physical testing (sequential drop, 13 fire, puncture, and immersion) prior to certification 14 by the Commission. 15 (3) Additional computer simulations to deter- 16 mine performance in extra-regulatory accidents and 17 to determine failure thresholds.
