Of the 29th Session Senate Resolution No. 1 Introduced By Senator Clemens UNLV Student Code of Conduct & Sexual Assault Whereas, the safety and well being of UNLV students is our top priority. Whereas, this safety and well-being can be guided and ensured through the correct implementation of UNLV Student Conduct Code and Policies Whereas, the UNLV Student Conduct Code and Policies currently lacks policy regarding Sexual Assault. Whereas, the addition of a clause to the effect: "It is the policy of the University of Nevada, Las Vegas to condemn Sexual Assault. Any faculty member or student convicted of sexual assault will face discipline in the manner outlined in the UCCSN Code (Chapter 6). " will help clarify UNLV's position on Sexual Assault. THEREFORE LET IT BE RESOLVED, that the Consolidated Students of the University of Nevada, here assembled in the CSUN Senate, beseech Dr. ^ckerman, Vice President of Student Services, to propose an addition to the UNLV/Code of Conduct to the Nevada Board of Regents that will indicate the UNLV Community's endorsement of a policy that assures perpetrators from UNLV convicted of sexual assault will receive disciplinary action. Senate Bill No. 4 Of the 29th Session INTRODUCED BY:Senate President Pro-Tempore Fisk Summary: This bill is intended to give the CSUN Rules and Ethics committee some oversight regarding the eligibility of CSUN Executive Board and Senate members. We, the Consolidated Students of the University of Nevada, represented in the CSUN Senate, do enact as follows: (Additions are underlined. Deletions shall be placed in brackets.) SENATE BYLAW 31 RULES AND ETHICS COMMITTEE I. Membership A. The CSUN Rules and Ethics Committee shall be composed of six (6) Senators serving in the current session of the CSUN Senate; B. Five (5) of the members will be designated as voting members and one (1) will be designated as the chair of the committee; C. Quorum will consist of at least four (4) committee members: three (3) voting members along with the chair; D. Four (4) members of the committee shall be nominated and approved by the CSUN Senate. Two (2) members of the committee shall be nominated and approved by the Executive Board. One (1) of these six (6) shall be nominated and approved by the CSUN Senate to chair the committee. These selections shall be made by the third official meeting of the new Senate session; E. Upon the creation of a vacancy in the committee, the Executive Board shall nominate and the Senate shall confirm a Senator to fill that vacancy. This shall occur at the Senate Meeting immediately following the creation of a vacancy; F. If a charge is levied against a member of the committee he/she shall be temporarily prohibited from participating as a member of the committee during that particular investigation. This member is therefore prohibited from voting in such a circumstance. The CSUN Senate shall reserve the irght toelect an alternate for the duration of the case. II. Chair A. The Chair shall preside over all committee meetings; B. The Chair shall assign excused/unexcused absences to members of the committee; C. The Chair shall be empowered to vote only in the case of a tie; D. The Chair shall notify a Senator or an Executive Board member who is being investigated by the committee so that the Senator or Executive Board member may appear on his/her own behalf at the meeting action is being taken; E. The Committee shall nominate and approve a voting member of the committee to serve as Vice-Chair; F. The Vice-Chair will preside over the committee only in the case of the absence of the chair. When acting as the Chair, the Vice-Chair is granted all the irghts and privileges bestowed upon the Chair; G. The Vice-Chair forfeits his/her voting privileges when acting as the Chair of the committee. Duties, Powers and Responsibilities A. The committee shall submit, for Senate approval, a set of rules that Senators will be required to follow for the current session of the Senate. These rules must be submitted on either the first or the second meeting of the committee; B. These rules become official upon being approved by the Senate; C. The Committee will be responsible for ensuring that all Senators are complying with all rules that are approved in the above manner; D. Members of the committee must report violations of the established rules to the committee at he next scheduled meeting after the infraction is discovered; E. Any CSUN member may report an infraction to the committee for purposes of investigation by the committee; F. A report by the committee may be given at each Senate meeting; G. The committee may request information pertaining to the eligibility of current student government officials and officers from the business manager. This information will only state whether this individual is eligible or not eligible. 1. In the event that the requirements of the CSUN Constitution cannot be met by a member of the Executive Board or the Senate, the CSUN Rules and Ethics Committee must notify that member within five (5) working days. 2. The CSUN Executive Board member or Senator must then show proof of error within ten (10) working days of receiving notification from the CSUN Rules and Ethics committee. 3. An Executive Board member or Senator who is in violation and does not step down will face impeachment by the appropriate CSUN Officials. H.fG.1 When discovered, the committee chair must make a motion at the next official Senate Meeting to levy charges of impeachment. Senate Bill No. 4 Of the 29th Session INTRODUCED BY.Senate President Pro-Tempore Fisk Summary: This bill is intended to give the CSUN Rules and Ethics committee some oversight regarding the eligibility of CSUN Executive Board and Senate members. We, the Consolidated Students of the University of Nevada, represented in the CSUN Senate, do enact as follows: (Additions are underlined. Deletions shall be placed in brackets.) SENATE BYLAW 33 GRADE VERIFICATION POLICY I. G.P.A. verification for CSUN Executive Board, Chairs, and Directors: A. Only the CSUN Business Manager may access grades of CSUN Officials, Directors and Chairs; B. The information accessed can be used for determination of eligible or non-eligible status only; C. The CSUN Business Manager shall enforce all provisions of the CSUN Constitution with regards to fee waivers. The CSUN Business Manager will audit all fee waivers and enforce any and all refunds for all dropped classes as well as for any CSUN Officer, Director, or Chair who did not complete the term of classes, and/or work. This applies to all Directors, Chair, Executive Board Officers, and Senators; D. The CSUN Business Manager shall check eligibility of all CSUN Officers on a monthly basis. II. The CSUN Judicial Council may request the Business Manager to provide confirmation that all grade checks have been conducted within a reasonable amount of time, not to exceed thirty (30) days of instruction. Only information pertaining to eligibility of current Student Government Officials will be released. This information will only state whether this individual is eligible or not eligible: A. The Judicial Council may request such inquiries on behalf of a written complaint from any CSUN member. III. The CSUN President shall administer all grade verification forms for the Vice-President and Directors: A. The CSUN President will submit the completed forms to the Business Manager within ten (10) working days of the start of each semester; B. In the event that the requirements of the CSUN Constitution cannot be met by a member, the CSUN President must notify that member within five (5) working days; C. That member must then show proof of error within ten (10) working days of receiving notification from the CSUN President; D. A member who is in violation and does not step down will face impeachment or removal from the appropriate CSUN Officials. IV. The CSUN Vice-President shall administer all grade verification forms for the Executive Board, excluding the Vice-President: A. The CSUN Vice President will submit the completed forms to the Business Manager within ten (10) working days of the start of each semester; B. In the event that the requirements of the CSUN Constitution cannot be met by a member, the CSUN Vice President must notify that member within five (5) working days; C. That member must then show proof of error within ten (10) working days of receiving notification from the CSUN Vice President; D. A member who is in violation and does not step down will face impeachment or removal from the appropriate CSUN Officials. V. The CSUN Senate President shall administer all grade verification forms for all Senators, except the Senate President Pro-Tempore: A. The CSUN Senate President will submit the completed forms to the Business Manager within ten (10) working days of the start of each semester; B. In the event that the requirements of the CSUN Constitution cannot be met by a senator, the CSUN Senate President must inform that Senator within five (5) working days; C. The Senator must show proof of error within ten (10) working days of receiving notification from the CSUN President or resign from the Senate. If no voluntary action is taken within this period of time, the Senator in question will be referred to the Senate Rules and Ethics Committee for review; D. A member who is in violation and does not step down will face impeachment or removal from the appropriate CSUN Officials. VI. The CSUN Senate Rules and Ethics Committee may request information pertaining to the eligibility of current student government officials and officers from the Business Manager. This information will only state whether this individual is eligible or not eligible. A. In the event that the requirements of the CSUN Constitution cannot be met by a member of the Executive Board or the Senate, the CSUN Rules and Ethics committee must notify that member within five (5 ) working days. B. The CSUN Executive Board member or Senator must then show proof of error within ten (10) working days of receiving notification from the CSUN Rules and Ethics committee or resign from their position; C. An Executive Board member or Senator who is in violation and does not step down will face impeachment by the appropriate CSUN Officials. VII.[VI]The following constitutes a valid description of grades: A. Six (6) or greater completed credits at UNLV; B. A 2.0 or greater semester G.P.A. Senate Bill No. 1% C) Of the 29th Session Introduced By Senator Clemens Summary: This bill is intended to clarify the vagueness surrounding some of the wording of this bylaw as well as provide the right to a speedy trial or exoneration for those accused of Impeachment. We, the Consolidated Student of the University of Nevada, represented in the CSUN Senate, do enact as follows: (Additions are underlined. Deletions are bracketed.) Senate Bylaw 6 Impeachment Committee I. Purpose Since by accepting a post in CSUN Government and taking the oath of office you summit yourself to the authority of CSUN Government, upon presentation of Impeachment charges and a majority vote by the Senate to investigate these Articles of Impeachment. the_Senate shall establish an impeachment Committee by nominating and appointing its members: A. The Committee shall be composed of one (1) UNLV [Administrator] Faculty Member and [two] four (4) CSUN Senators, all nominated and approved by the Senate. B. The Senate, at the same meeting, shall elect the Chair. II. Methods of Investigation The Impeachment Committee shall investigate the charges presented: A. The Committee shall meet at least weekly until the matter has been resolved. B. At least one CSUN Justice shall be required to attend any meetings or hearings of the Impeachment Committee. C. The Committee shall allow each side ten days for the preparation of their case but when hearings are set, an unexcused absence will result in an automatic recommendation for impeachment. DL The Committee shall make recommendations to the Senate based upon the finding of their investigation into allegations of malfeasance, or non-feasance perpetrated School Holidays. (30) day limit. III. The Committee's Recommendation A. Can be a recommendation to impeach or drop the charges. B. Shall be dealt with at the meeting that the recommendation is made. C. If the committee recommends to impeach it must be sustained by two-thirds (2/3 's) of the Senate to remove a CSUN official from office. D. If the committee recommends dropping the charges then no more articles of impeachment can be drafted upon those charges unless the Judicial council deems that the committee acted Unconstitutionally. E. Once impeachment is passed the accused is removed from office with their only recourse a reversal of impeachment by the Judicial Council upon appeal. IV. Appeals Any appeals based upon Constitutional, procedural or factual errors must be submitted to the Chief Justice or Senior Judicial Member within forty-eight (48) hours of Impeachment. A. If there are less than five Justices then appeals must wait for an operating Judicial Council. B. Once an operating Justice Council receives the charges they shall review them and render a decision within thirty (30) days. 1. School Holidays, summer break excluded, shall not count toward the thirty (30) day limit. Senate Bylaw 37 Senate Committee Guidelines I. Purpose Establishes Senate committee and guidelines for appointment. II. Structure A. Senate committees are chaired by Senators; B. The Senate Secretary may be a non-voting recorder of any Senate committee, subcommittee, or any Ad Hoc committee of the Senate, pending the Senate President's approval. III. Senate Committee Appointments A. Each Legislative Session will appoint Senators to chair Senate committees, out of the members elected to these committees by the full Senate, once each committee is filled as required by CSUN bylaws and the CSUN Constitution. B. The Chair of each committee [shall] may select members of their committee: 1. The Senate shall confirm all appointments to Senate committees that the chair has selected; 2. The Chair will submit all nominees to the Senate President for placement on the agenda; 3. The Senate committee appointments and nominations shall appear on the agenda prior to the Executive Board nominations; 4. The committee will select a Vice Chair. IV. Senate Committees Consist of the Following A. Senate Bylaws Committee as defined by Senate Bylaw #1; B. Senate Rules and Ethics Committee as defined by Senate Bylaw #31; C. Senate Ways and Means Committee as defined by Senate Bylaw #15, D. Impeachment Committee resulting from recommendations from [the Rules & Ethics Committee, Executive Board, or] Senate Investigations. E. Any Investigations committee or Ad Hoc committee that the Senate enacts; F. Senate Campus Safety & Awareness Committee as defined by Senate Bylaw #32. V. Representatives The following representatives will be Senate appointed by a majority vote: A. KUNV Liaison Seat to KUNV Radio Station. B. CSUN Rebel Yell [newspaper] Advisory Board Member [as a voting member to the Rebel Yell Advisory Board], C. SENATE BYLAW 14 CSUN OFFICE OF STUDENT INFORMATION (Effective June 16, 1988; Revised October 7, 1992) L PURPOSE The Office of Student information (OSI) shall serve to inform the student body, faculty, media, and concerned members of the public as to the activities of the CSUN Student Government. n. STRUCTURE The OSI shall consist of the following: A. The Director, who shall be nominated by the Executive Board and approved by the Senate; B. The Assistant Director, who shall be selected as prescribed by Articles IX, Section E, Item 1, of the CSUN Constitution; C. Staff members shall be selected by the Director and approved by the Senate. m. DUTIES, POWERS, AND RESPONSIBILITIES OF OFFICE OF STUDENT INFORMATION A. The Director: 1. The duties of the Director shall be as those as described in Article IX, Section D, of the CSLJN Constitution. Senate Bill No. 1% C) Of the 29th Session Introduced By Senator Clemens Summary: This bill is intended to reflect our current policies rather than the way they currently read. We, the Consolidated Student of the University of Nevada, represented in the CSUN Senate, do enact as follows: (Additions are underlined. Deletions are bracketed.) Senate Bylaw 13 CSUN NEVADA STUDENT AFFAIRS (Effective June 13, 1988; Revised October 7, 1992) I. PURPOSE The purpose of Nevada Student Affairs (NSA) shall be to represent CSUN as the chief advocate on issues concerning students at the university, local, county, state, and national levels. n. STRUCTURE The NSA shall consist of the following: A. The Director, who shall be nominated by the Executive Board and approved by the Senate; B. The Assistant Director, who shall be nominated by the Director and approved by the Senate [selected as prescribed by Articles IX, Section E, Item 1, of the CSUN Constitution]; C. The Research Staff chosen by the NSA Director and approved by the Senate. Members of the Research Staff must be CSUN members in good academic standing. in. DUTIES, POWERS, AND RESPONSIBILITIES OF NEVADA STUDENT AFFAIRS A. The Director: 1. The duties of the Director shall be as those as described in Article IX, Section D, of the CSUN Constitution; 2. The Director shall, with the Research Staff, gather, maintain, and distribute information relevant to the needs of CSUN at all levels of government. This includes, but is not limited to, Administration and Faculty, Board of Regents, Nevada State Legislature, and Federal Government action; 3. The Director shall make a report to the Senate at each Senate meeting regarding issues relevant to CSUN. The NSA Director is required to attend all CSUN Executive Board meetings and Senate Meetings, unless excused by the CSUN President or Senate President, respectively; 4. The Director shall schedule and administer functions designed to heighten the awareness of the campus and local community to relevant student interests. These include, but are not limited to, events such as voter registration drives, surveys, speakers, and candidate forums (university, local, state, and national); 5. The Director shall submit a budget to the CSUN Executive Board and CSLJN Senate for approval; 6. The Director shall vote only to break a tie. B. The Assistant Director: 1. The duties of the Assistant Director shall be as those as described in Article IX, Section E, of the CSUN Constitution. C. Nevada Student Affairs (NSA): 1. NSA shall establish an Operating Policy to be approved by both the NSA and the Student Senate and shall keep their Operating Policy consistent with the CSUN Constitution and CSUN Bylaws. ( B. The Assistant Director: 1. The duties of the Assistant Director shall be as those as described in Article IX, Section E, of the CSLJN Constitution. Office of Student Information shall: 1. Report on the activities of CSUN media and local media; 2. Maintain and update all informational materials used to inform the campus and public of CSUN's activities, including the OSI Page in the Rebel Yell as well as the Student Government website; 3. OSI shall also perform any duties delegated to it by the Executive Board or the CSUN Senate; 4. OSI shall establish an Operating Policy to be approved by both OSI and the CSUN Senate and shall keep their Operating Policy consistent with the CSUN Constitution and CSUN Bylaws. SENATE BYLAW 16 CSUN ORGANIZATIONS BOARD (Effective November 2, 1987; Revised October 7, 1992) L PURPOSE The purpose of the Organizations Board shall be to coordinate and provide a forum for student organizations, as well as to approve of funding requests from organizations and send approved requests on to the CSUN Ways and Means Committee. H. STRUCTURE A. The Director, who shall be nominated by the Executive Board and approved by the Senate; B. The Assistant Director, who shall be selected as prescribed by Articles IX, Section E, Item 1, of the CSUN Constitution; C. The president or representatives from each recognized organization; D. One (1) CSUN Senator nominated and approved by the Senate. m. DUTIES, POWERS, AND RESPONSIBILITIES OF THE ORGANIZATIONS BOARD A. The Director: 1. The duties of the Director shall be as those as described in Article IX, Section D, of the CSUN Constitution; 2. The Director shall vote only to break a tie. 3. The Director shall work with their Assistant Director and the Senate Representative on their board to establish an Operating Policy and ensure that it complies with the CSUN Constitution and CSUN Bylaws. B. The Assistant Director: 1. The duties of the Assistant Director shall be as those as described in Article IX, Section E, of the CSUN Constitution. C. The Board: 1. The Board shall meet at least once each [semester] month with the first meeting no later than the second Friday in the Fall and Spring academic semesters. 2. Shall approve the operating policy or any changes in the operating policy before the operating policy can be sent on to the Senate for final approval. SENATE BYLAW 19 CSUN ELECTIONS BOARD (Effective November 12, 1987; Revised January 25, 1990; March 11, 1992; October 7, 1992) I. PURPOSE The purpose of the Elections Board shall be to conduct and certify fair CSUN Elections. II. STRUCTURE The Elections Board shall consist of the following: A. The Director, who shall be nominated by the Executive Board and approved by the Senate; B. The Assistant Director, who shall be selected as prescribed by Articles IX, Section E, Item 1, of the CSUN Constitution; C. At least three (3), but no more than ten (10), CSUN members, at least one (1) of whom must be a Senator, nominated and approved by the Senate. III. DUTIES, POWERS, AND RESPONSIBILITIES OF ELECTIONS BOARD A. The Director: 1. The duties of the Director shall be as those as described in Article IX, Section D, of the CSUN Constitution; 2. The Director shall vote only to break a tie; 3. The Director shall be required to comply [by] with the duties required of the Board as long as it does not interfere with his/her duties as Director. ( B. The Assistant Director: 1. The duties of the Assistant Director shall be [as] those as described in Article IX, Section E, of the CSUN Constitution. C. The Board: 1. The Board shall review and approve the budget prepared by the Director; 2. The Board shall disqualify candidates for elective offices as appropriate; 3. The Board shall certify CSUN Elections, including counting the ballots, within [one (1) week] fourtv-eight (48 ) hours of the closing of the polls; 4. The Board shall conduct referendums; 5. The Board shall determine petitions for initiative proposals and recall elections; 6. The Board shall determine the apportionment of all Senate seats one (1) week prior to the beginning of the filing date for Senate elections [subject to Senate approval] and the Director shall report their determination at the next Senate Meeting; 7. The Board shall establish any necessary subcommittees, the chair of which must be Board members; 8. The Board shall establish the rules necessary for the conduct of elections; 9. The Board shall establish and collect a fee, not to exceed fifty dollars ($50.00) per candidate, to ensure compliance with election rules, and to retain a fee, or a portion thereof, for noncompliance; 10. The Board shall circuit the polls on election day(s) as per assigned by the Director; 11. The Board shall be responsible for ensuring the polls are operational and dismantled at the designated times; 12. Upon a third (3rd) unexcused absence, a member of the Board shall be automatically terminated; 13. PURPOSE The purpose of the Entertainment and Programming Board (E & P) shall be to obtain, schedule, administer, and publicize CSUN sponsored activities, entertainment, and social events. II. STRUCTURE The E & P Board shall consist of the following: A. The Director, who shall be nominated by the Executive Board and approved by the Senate; B. The Assistant Director, who shall be selected as prescribed by Articles IX, Section E, Item 1, of the CSLTN Constitution; C. At least five (5), but no more than ten (10), CSUN members, at least three (3) of whom must be Senators, who may be nominated by the director but must be approved by the Senate. m.
