Each candidate must complete a filing form which may be obtained from the CSUN Secretary in the Student Government offices located in the Moyer Student Union-Room 160 from 8:00 a.m. to 5:00 p.m. B. Each candidate will be required to sign a waiver giving the UNLV Registrar access to her/his G.P.A. to determine eligibility. C. Filing Fee: 1. Each candidate shafl, at the time of filing or at another time set by the Chair[man], pay a filing fee to CSUN. 2. The filing fee amount shall be [twenty-five dollars ($25.00)] thirty dollars (130.00) for Senate Offices; thirty dollars ($30.00) for Homecoming; fifty dollars ($50.00) for Executive Offices. 3. The board shall retain, in whole or in portion, the filing fee of a candidate cited and deemed in violation of election rules. 4. The filing fee, or portion not retained, shall be refunded to a candidate within [two (2) weeks] one (1) month of election certification. D. A candidate meeting for the purpose of explaining election rules shall be held on the last day of filing. Candidates and/or proxies must attend. II. QUALIFICATIONS FOR CANDIDACY Qualifications for candidacy are set forth in the CSUN Constitution in Article IV, Section B. ill. CAMPAIGNING A. Candidates must abide by the Election Rules operating policy of the Elections Board [governing] overseeing the elections. Failure to do so will result in penalties discussed in the Election Rules. B. Official campaigning may begin on the final day of filing for an elected position, immediately following the mandatory candidates' meeting. C. Official campaigning includes, but is not limited to, the following: 1. Candidates are not allowed to post campaign materials on the UNLV campus, with the following exceptions: a. personal property as pertains to residence hall bulletin boards; b. personal property of supporters. c. kiosks and bulletin boards on campus All posting must be done in compliance with the rules set forth by that building. D. No campaigning or campaign materials will be permitted within twenty-five (25) feet of a polling booth during election days. Any campaign materials within twenty-five (25) feet will be removed by Elections Board members. E. The Elections Board shall determine the number of campaign materials to be posted on each kiosk* and bulletin board. f*Webster's ll: a cylindrical structure on which advertisements are posted! F. Candidates shall submit samples of all campaign materials prior to distribution. The materials shall be kept on file until all election disputes have been settled. G. All fines shall be assessed by majority vote of members present at Elections Board meetings. 1. Candidates/proxies have the right to speak in defense of violations at the meetings the fines are being assessed. . CAMPAIGN EXPENDITURES/LIMITATIONS A. Campaigns for any office shall be subject to the following rules: 1. The candidate shall be limited in his/her expenditures (including monetary donation) on all leaflets, posters, raw materials, and any other advertising to the following: a. CSUN Executive Board: $500.00 b. CSUN Senators: [$100.00]$200.00 c. CSUN Homecoming Candidates: $200.00 V 2. Receipts will be required for all those goods and services purchased or donated: a. for all goods received where receipts are unavailable (amateur, self-made, or non-commercial items), all candidates are expected to turn in an approximation of the fair market value and it shall be indicated on the candidates spending and contributions statement, the final [the] fair market value will be determined by the Elections Board [Director]; jdg Consolidated Students £ • University of Nevada "Students Serving Students" CSUN ELECTION RULES Page 3 of 7 b. any candidate's signs that are destroyed prior to the election may be replaced by candidates without reduction from their budget, provided proper evidence is shown to the Elections Board that the signs were destroyed. c. (a) any organized activity that promotes a candidate or ticket, or (b) any organized activity that hinders another candidate or ticket, provided it does not violate Article IV, Section E; Article V and Article VIII of the CSUN Elections Rules. B. Contributions shall be defined as any gift, money, professional service, or donation that a candidate may receive, or have received, on his behalf for the purpose of campaigning. The value of such contributions must reflect the fair market value and must be indicated on the candidates spending and contribution statement. C. Any on-campus events that may be for the benefit of a candidate must be in compliance with all university regulations. D. Contributions to candidates and their campaigns will be governed by applicable Nevada Statutes. Further limits may be set by Elections Board. [D]L Each candidate will be required to submit to the Elections Board two (2) complete statements of all campaigning expenditures and contributions. These statements must be supported by receipts for all amounts; the [first] statement shall include expenditures/contributions incurred by 7:00 p.m. on the second day of elections for the Senate, on the second day of elections for Homecoming, onjhe second day of the Primary Elections and on the second dav of the General Flections these statements are due by 7:00 p.m. on those days. On the second day of the Primary Elections the [second] statement shall include all of the campaign expenditures/contributions incurred from the start of the campaigning period to the close of the Primary Elections [filing] period. A candidate shall then submit all of the campaign expenditures/contributions from the [to the] close of the Primary Elections period to the close of the General Elections [filing] period and it shall be due by 7:00 p.m. of the second day of the General Elections. These statements must be submitted on the proper form to the [CSUN Secretary, the Senate Secretary,Elections Board Director or an Elections Board member. 1. If at any time during the tenure of elected officers it shall be proven that the officer submitted a false or misleading statement, it shall be deemed an impeachable offense. 2. If it is determined that a candidate submitted a false or misleading statement, that person shall be brought before the Elections Board for disciplinary action. 3. A candidate who submits his campaign spending and contribution statement after the deadline will be subject to forfeiture of the remainder of the filing fee. If a candidate has already incurred fines totaling the amount of the filing fee . failure to turn in the spending and contribution statement will result in disqualification. jdg Consolidated Students £D University of Nevada "Students Serving Students" CSUN ELECTION RULES Page 4 of 7 . CONDUCT OF CANDIDATES A. Candidates must attend all Elections Board meetings scheduled by the CSUN Elections Board Director during the period of campaigning. 1. If a candidate is unable to attend a meeting, a proxy shall be designated by the candidate to attend the meeting. 2. A proxy form [written statement] from the candidate authorizing the proxy shall be turned in [prior to the] during Roll Call at the designated meeting. B. All protests, challenges, and complaints must be submitted in written form to the CSUN Secretary, Senate Secretary, or an Elections Board member within three (3) days after the alleged infraction. C. All candidates are expected to conduct themselves in a manner which would best represent CSUN and UNLV during his/her campaign. 1. Questionable conduct by a candidate or his/her supporter(s) will be brought before the Elections Board for further action. D. The Elections Board shall consider all complaints and take any appropriate action. E. Candidates will be held accountable for their own actions and those of their recognized supporters. F. Any candidate or his/her recognized supporters proved to have removed, defaced, or. tampered with another candidate's campaign materials will have his/her [security deposit ] filling fee partially or totally forfeited. The Elections Board will also reserve the right to take further action if deemed necessary. This action may be, but is not limited to, disqualification of candidate. I. VOTING PROCEDURE A. An elector desiring to vote shall present his/her UNLV Student I.D. or another picture identification at the polling area. The election worker shall verify the card with master list and hand the student a ballot. The elector will then proceed to mark the ballot. After voting, the elector shall place his/her ballot in the ballot teox. Any elector voting more than once will lose his/her privilege to vote in this election and his/her ballots shall be rendered null and void. B. If the elector is not on the master list, or a CSUN gold card holder he/she must obtain verification of current UNLV credit hours and his/her college major from the Registrar's Office. C. No write-in candidates will be permitted in the official ballot count. E. In the General Elections for Executive Officers, electors shall have a choice of voting for a candidate or for "none of these candidates." 1. If the "none of these candidates" ballot entry receives the winning total of votes, then the candidate with the next highest number of votes shall be declared the winner in accordance with these rules. VII. COUNTING OF BALLOTS A. Any individual creating a disturbance, as determined by the Elections Board Director during the counting of ballots "shall be required to leave. B. Ballot boxes are to be opened in the presence of a minimum of two (2) Elections Board members. C. Each candidate is permitted to designate one (1) person to function as an observer during the counting of the ballots in his/her election. D. At the close of Wednesday's voting, all ballots will be safely and securely stored until counting commences on Thursday. E. No bailot which is folded, mutilated or incorrectly marked will be counted. VIII. CERTIFICATION - :< A. The Elections Board shall certify that the elections for each race has been conducted in accordance with the Elections Rules, the operating policy of the Elections Board, and any other rules or policies governing elections including the CSUN Constitution. B. Certification of Elections shall take place no later than one (1) week after the last day of the elections. IX. FINES A. Fines will be levied in accordance with CSUt^Senate Bylaw 19. Article III, Section C(8) as follows [Section 6]: 1. Failure for candidate or proxy to attend a scheduled Elections Board meeting will result in a ten dollar ($10.00) fine. 96:jdg Consolidated Students CD University of Nevada "Students Serving Students" CSUN ELECTION RULES Page 6 of 7 2. Campaigning prior to date set by Elections Board will result in a minimum fine of fifty percent (50%) of the original filing fee. The Elections Board will also reserve the right to take further action if deemed necessary. The action may be, but is not limited to, disqualification. 3. Campaign material(s) placed by a candidate or supporter(s) within twenty-five (25) feet of voting area(s) will result in a ten dollar ($10.00) fine. [ A second offense may result in disqualification.] Any handbills/handouts found within twenty-five (25) feet of any poll during the two election days will result in a one dollar ($1.00) fine for each handbill/handouts. Excessive offenses, as determined by the Flections Board will result in disqualification. 4. Actual physical campaigning within twenty-five (25) feet of the voting areas will be subject to fines as determined by the Elections Board. 5. Failure to submit samples of campaign materials to the Elections Board will result in a ten dollars ($10.00) fine. If samples are not submitted within three (3) days after usage, the candidate will be disqualified. 6. Failure to adhere to the rules set forth by each building will result in fines as determined by the Elections Board. [61Z. Failure to comply with the Elections Board rules concerning posting will result in loss of filing fees or disqualification, based upon Elections Board discretion. [7]B_. Receipts not turned in by seven o'clock. (7:00) p.m. with the candidates spending and contributions statement on the second day of elections for Senate, on the second day of elections for Homecoming, on the second day of the Primary Elections, and on the second day of the General Elections, to an Elections Board member will result in forfeiture of filing fees of said election. If a candidate has already incurred fines totaling the amount of the filling fee, failure to turn in the contributions and expenditures sheet will result in disqualification. [8]2.. Any i'ines that total over the filing fee of said election will result in an automatic disqualification. [9] 10. Candidate expenditures over [one hundred dollars ($100.00)] two hundred dollars ($200.00) for the Senate races will result in automatic disqualification. 10. Candidate expenditures over two hundred dollars ($200.00) for the Homecoming elections will result in automatic disqualification. 11. Fines will be posted [daily] in CSUN offices and are subject to appeal as per Elections Rules Article III.. Subsection G(1). 13. Banners that are affixed [illegally on or in the Moyer Student Union or other] on any campus structures without the written permission of thosp in charge of thp building or not with in their specifics will result in the minimum of [will result in] a ten dollar ($10.00) fine. 14. Use of CSUN materials for the purpose of campaigning shall result in a minimum ten dollar ($10.00) fine or disqualification, based upon Elections Board discretion. 15. Any candidates fliers that have been posted over another candidate's flier, this includes any "piggybacking", as defined by the Elections Board, will result in a one dollar ($1.00) fine for each offense. 16. III. APPROVAL OF MINUTES: Motion to approve Minutes for Senate Meeting 27-21 made by SENATOR FLEISCHMAN, -conded by SENATOR STARK. SENATOR FLEISCHMAN stated that where she motioned to nominate herself and SENATOR ANDERSON during Senate Meeting 27-21, it should also state that she motioned to nominate SENATOR LIDEROS. SENATOR MARSHALL requested that on page one II. ROLL CALL "(elected at 6:55 p.m.)" be deleted. She also motioned to correct II. ROLL CALL on Senate Meeting 27-20 Minutes to read "(appointed at 6:55p.m.)" instead of "(elected at 6:55 p.m.)." SENATOR HAYES requested her name to be inserted under II. ROLL CALL as being present because she was in attendance at Senate Meeting 27-21, and the motion to approve the mintues for Senate Meeting 27-20 should read "passed at 16-0-0." SENATOR AMEND corrected his comments on page 14, paragraph 7, to read "Any objection for the cause..." Move into a vote. Motion to Approve the minutes as corrected passes 15-0-0. IV. ANNOUNCEMENTS: SENATE PRESIDENT PRO-TEMPORE PERSCH stated that there were no announcements. V. BOARD AND COMMITTEE REPORTS: A. Senate Committee Reports: 1. SENATE PRESIDENT PRO-TEMPORE PERSCH announced that Ways and Means met tonight and did approve most of the funding requests on the agenda. B. Faculty Senate Committee Reports: 1. SENATOR ANDERSON pointed out that items F and L are out of order and they've been tabled. C. Director Reports: 1. NSA DIRECTOR CONTINE announced that they've managed to get voter registration in the orientation packets so that all new students coming in will have the opportunity to register to vote. He added that they registered approximately 60 of the new students. He stated that he is in the process of trying to schedule some speakers, and he also talked with the editor of the ^ebel Yell in regards with what they're going to do. 2 SENATE MINUTES 27-21/ July 14, 1997 2. Elections Board DIRECTOR FLEISCHMAN announced that there are two ;ras on the agenda which she cannot speak on, but will at the appropriate time. She also stated that the packets (i.e., filing packets for homecoming and Senate), pending what happens this evening, will be ready for the next Senate Meeting. She stated that she tentatively scheduled and booked rooms for meetings for the Elections Board for every Tuesday at 6:00 p.m., and she tentatively has a candidate for the Assistant Elections Board Director. She stated that they are looking into having voting stickers again with Rebel Sam on them and is also looking into getting 9-10 banners for our voting booths to replace the ones costing $900.00 that have dissappeared. 3. O-Board DIRECTOR FINKELSTEIN apologized for not being present at the Ways and Means meeting but will be at the next one. He, then, announced that he's preparing everything and getting packets ready, and he's put in the forms for the rooms and, hopefully, meetings should be Tuesday, starting September 2, and every other Tuesday after that, except for Veteran's Day. He stated that he's getting a contact for ticketing and the football games, and they're working on some trips up to Reno, etc.. In response to questions, he stated that they're working on trips up to USC, Fresno, and as many games as they can. He added that they've got 2 buses so far up to USC, but are looking into more. He also stated that he's planning on attending the trips if all works out. 4. E&P DIRECTOR WIESSEN announced that he has all the football games scheduled for tailgates, and they're still working on buses for the away games, but it's looking very Promising. He stated that he tentatively has a candidate for the Assistant E&P Director, Mike iuffer, who was the assitant last year. He added that he spoke with people up in the Thomas and Mack Center regarding tailgates and the use of the Rebel Experience and stated that the first home game is against Hawaii. He stated that they have Boogie Nights playing beforehand and a 2 hour concert after the game. He added that they are planning the same deal for Homecoming, a small local band playing for the tailgate, and then, a concert afterward. He announced that the movie series is finished and if anyone wants to see the schedule they can come into the office. In response to a question, he stated that he will copy the schedule when it is finalized, and he is working with Sunny Martin regarding the 40-year anniversary. In response to another question, he stated that the company that they usually get the buses to go from the school to the stadium is bankrupt; so, the Thomas and Mack is working with another company. Therefore, he stated that they're going to get two buses to go from the DC or the MSU parking lot to the game; and since they're building the new Rebel Experience, the way that the alcohol is going to be set up is they have three separate booths that are going to permanently be there: one for Kahlua, one for Coors Light, and one for Jim Beam. He added that they're going to be having buses going from an hour and a half before the tailgate to midnight after the game. In response to another question, he stated that the first two games are night games which is a 7 o'clock kickoff, so the Hawaii game is going to start, Boogie Nights goes on around 5:30 p.m., and then for the homecoming game it is going to start earlier because they have a homecoming parade, the announcement of the Royalty Court, and some other awards, etc. He stated that the homecoming game will start around 3:30 p.m.. 5. OSI DIRECTOR AYON announced that he's been updating a few programs on c computer, he has an appointment next week with Tracy Cotton, who is the overseer of the web page for Student Services and, hopefully, we'll have a operational CSUN web page by the end of next 3 SENATE MINUTES 27-21/ July 14, 1997 eek. He added that he'd like to put CSUN members on that web page with an email address. He , w*en, added that he like to have CSUN members' pictures on the web page also. They should have an oversized, functional web page within 3 weeks. SENATE PRESIDENT PRO-TEMPORE PERSCH announced that she asked SENATE PRESIDENT MOORE if he would like her to have a photographer come in, but he said, no, that he would take care of that in regards to taking pictures of CSUN members. D. Residence Hall Liaison Report: SENATOR SONG enters at 6:50 p.m.. JENNIFER PECK apologized for not attending last meeting because she was not called with the new meeting date. SENATOR FLEISCHMAN stated that she believes the Senate President will probably owe JENNIFER PECK an apology because he changed the meeting date and she probably was never notified. JENNIFER PECK announced that they've been in the process of completing their professional staff changeover in the Residence Halls and it's going fairly smoothly; they are preparing cor their Residence Hall Student Orientation Services and they're getting their Hall Senate for Fall esidences, and finishing up all their contracts and details for their Welcome Weekend. In response to a question, she stated that the Residence Halls have been full for about a month and a half now, they had about a four-page waiting list. SENATOR FLEISCHMAN suggested arranging to give the Residence Halls a copy of the two of our roomate-referal books. DR. TERRY PIPER announced that the waiting list, four pages, translates into about 90 transfer students and about 48 freshman. He added that a priority system is now in place where Nevada freshman who are from outside of Clark County have first priority followed by out-of-state freshman, followed by local freshman, followed by transfer students. He stated that they anticipate that with cancellation they will absorb probably most of the freshman that are on the waiting list and some transfer students that will probably not be accomodated which will be consistent with last year. He stated that the waiting list at this point is identical to the waiting last at this point last year. He added that at the Campus Community Development office, Phil Burns has a system set up of information that can be requested by students on the waiting list which gives them access to numbers and housing information lists. He stated that they will also operate, out of Campus Community Development, a listing service for students who are just looking for another student, who's on the waiting, to help them match up to find rooms, and he believes the CSUN numbers are a part of all packages. He summed up by saying that all students last year by opening week who were on the waiting list, except for 11 students, were either placed in housing or had found alternate housing rangements. 4 SENATE MINUTES 27-21/ July 14, 1997 E. Business Manager Report: BUSINESS MANAGER JIM MOORE read the expenditures: $29.00 for postage, $29.23 repairing the cart cord, $144.00 to Boulevard Trophy for the Directors' nameplates and two gavels, $85.00 to the Printing Group for business cards for the new directors, and $68.15 for office forms. He announced that he'll be out all of next week on a business trip, and he stated that his alternate, Karla Kirk over in the Controller's Office will be out Thursday and Friday of next week also; so, she will not be available to sign E-docs. Thus, they will have all of the E-docs prepared for CSUN members by the end of this week, Aug. 1, and they'll need everyone to sign them either Friday or Monday or Tuesday. In response to a question, he announced that the pay checks will be here on Aug. 31, and he will turn them over to Joyce. In response to another question, he stated that there was $7.50 for certified mail and the rest was standard postage for the $29.00 postage expenditure. Then, he stated that the cart cord evidently fell off the cart and, subsequently, was run over by a tire and the cord tore apart. In response to another question, SENATE PRESIDENT PRO-TEMPORE PERSCH sent out a list of Senators who need to change the name of their college on badges. SENATOR HAYES stated that she didn't need one. SENATE PRESIDENT MOORE enters at 7:00 p.m.. i. PUBLIC COMMENT [in accordance with N.R.S. 241.020 (2)(c)(3)] SALLY MILLS stated that she was wondering why Terry Moore got to be part of the motorcade. In response to her question, SENATE PRESIDENT MOORE stated that he was called by one of the Regents, Regent Berkley, who invited him to be a part of the motorcade. SALLY MILLS continued to stated that she thinks that it is a sad commentary on how the last meeting, July 14, 1997, was conducted improperly. She added that she thought there is sad commentary that the Robert's Rules of Order and intelligent backup, state, public //unintelligible// were not shown here. She stated that it is a sad commentary when your Student Body President is not afforded a proper procedure. SENATE PRESIDENT PRO-TEMPORE PERSCH interrupted SALLY MILLS and stated that we can't discuss that at this time, would love to hear her out, but cannot do it at this time.
