Manager* Dear sir:- Replying to your m e m o . of the 8th, on my letter of the same date, relative to the above subject, in which you say "lari-ifs provide in this & nearly .all cases to actual weight'*. In that case the actual weight must be charged for. If however, the tariffs provide for weight at point of origin, as is usual in cases of shipments of coal, which are based on mine weights, then the charges must be col­lected on the basis of point of origin weight. If the tariffs provide for destination weights, then that course must be followed. If for actual weight, then the actual weight must be determined in a business like, careful and proper manner,just what that is the Law Department is vnab 1 e t© say. You are not justified in making reduction in charges upon the affidavits only of the consignee. An affidavit made in a matter of that kind is n© more than any other written statement, the oath adding nothing t© its efficacy. A proper rule should be formulated for the government of Agents in determining what are the true weights and such rule should be in­cluded in the tariffs. Yours very truly, f/RK-M. General Counsel
