I agree.Mary Ledding March 31, 1979 -2- You will note from the cue sheets that I have changed some lyrics on SAN FRANCISCO and THAT'S ENTERTAINMENT. Since these are both MGM films, do we need to notify the publishers about these lyric changes? I'm afraid that once we ask permission to make these changes the publishers will want to be paid for granting such permission. Again, I think we all agree that no publisher or composer should be paid any fees for the use of songs. However, I feel that a standard form cue sheet should be forwarded to ASCAP and BMI, since the complaint I hear most often from publishers and composers is that they receive normal ASCAP/BMI performance royalties from all media except stage shows - e.g., the Stardust Hotel was given the right to use certain restricted Gershwin copyrights (RHAPSODY IN BLUE) with the stipulation that this merely be listed as a musical cue. In short, this means that a small share of the monies paid by the hotel to ASCAP/BMI are channeled to the composer-publisher. Naturally, because we are successful, the publishers are more likely to note any possible infringements on our part. I have tried to give you as complete a picture as possible of our use of music. If you feel you need even more precise data concerning the sets and type of costuming or film being used, you should consult the set and costume designers.
