At the time of formulating each fiscal budget six thousand dollars ($6,000) shall be encumbered of the total CSUN budget received from student fees shall be transferred to the UNLV Student Financial Services Department under the name CSUN Washington Center Internship Program. H. The monies therein shall be awarded to students displaying leadership abilities and potential as determined by a committee of: A. Three (3) CSUN Officials appointed by the Senate; B. Two (2) members who are either faculty or professional staff; C. The Vice President of Student Services or his/her designee: 1. The committee shall be formed during each academic year. The committee's meeting shall be held in March, with the CSUN President serving as the committee chair. The committee's final decisions must be reached by April 15; 2. The committee, through the assistance of the UNLV Student Financial Services Department, shall request, receive, and review all applications; 3. Funding will be distributed in one (1) part; 4. The committee shall determine internship participant winners based on nominations by the Dean of a College or the President of UNLV; 5. The committee shall nominate three students per academic year; 6. All internship recipients must receive twelve (12) credits from UNLV during the internship; 7. The UNLV Student Financial Services Department will distribute all CSUN Washington Center Internship funding in accordance with University of Nevada System and UNLV guidelines. H. The CSUN Washington Center Internship fbr the Minority Leaders Fellowship Program (herein MLFP) shall be awarded on the following basis: A. A total of two-thousand ($2000) shall be awarded of the fiscal budget for the UNLV student who is nominated to participate in the MLFP and selected by The Washington Center, in addition to a twelve (12) credit fee waiver. The monies shall incur the costs of the sixty-dollar ($60) application fee, round trip airfare to Washington D.C. from Las Vegas, with the remainder to be divided equally as a weekly stipend for living expenses in D C. 1. These awards shall be granted strictly on the following basis (most important to least important): a. Leadership position and abilities displayed while at UNLV; b. Belong to one of the following racial/ethnic groups: African-American, Asian- American, Hispanic, Native American, or Pacific Islander; c. Be a citizen of the United States; d. Be at least a second-semester sophomore at the time of the program; e. Be in good academic standing with a minimum 3.0 G.P.A.; f. Be accepted by the Washington Center to participate in the program; g. Be nominated by the Dean of a College or the President of University; h. Be enrolled in at least 12 credits during the duration of the program. B. A total of four-thousand ($4000) shall be awarded of the fiscal budget divided equally ($2000 each) among two (2) UNLV students who are nominated to participate in any of the Washington Center programs, excluding MLFP and Seminars, in addition to a twelve (12) credit fee waiver: 1. These awards shall be granted strictly on the following basis (most important to least important): a. Leadership position and abilities displayed while at UNLV; b. Be at least a second-semester sophomore at the time of the program; c. Be in good academic standing with a minimum 2.5 G.P.A.; d. Be nominated by the Dean of a College or the President of University; e. Be accepted by the Washington Center to participate in the program; f. Be enrolled in at least 12 credits during the duration of the program 2. CSUN Officials currently receiving a stipend and/or fee waiver are eligible to compete for these internships, provided that they do not apply for a stipend position the following year; 3. If after receiving internship funding a recipient receives a fee waiver and/or stipend from CSUN prior to the beginning of an academic semester, he/she forfeits the remainder for the internship funding; 4. Any forfeited monies shall be returned to Student Financial Services for distribution in the following academic semester. To override or repeal this bylaw, the following votes are required: A. A two-thirds (2/3) vote of the CSUN Executive Board; B. A two-thirds (2/3) vote of the CSUN Senate. Supplemental Supplemental Agenda 29-04 D. APPROVAL OF MINUTES: Motion to approve minutes 28-34 made by SENATOR BASTUNAS, seconded by SENATOR CLEMENS. Move into a vote. Motion passes 18-1-1. (SENATOR WHITAKER opposed, SENATOR KNAPP abstained.) IV. ANNOUNCEMENTS: The Senate Secretary asked SENATOR DAVY to meet with her to update the Bylaws. SENATE PRESIDENT KIMBROUGH stated that Unfinished Business Item C needs to remain on the table. V. BOARD AND COMMITTEE REPORTS: A. Senate Committee Reports: 1. SENATOR CLEMENS stated that the Campus Safety and Awareness Committee will be meeting next week. 2. SENATOR SHAPIRO stated that Ways and Means will be meeting on Monday, December 7th at 5 p.m. 3. SENATOR DAVY stated that she needs availability schedules for members of the Bylaws Committee and she would like to hold a meeting on Wednesday. 4. SENATOR MORADKHAN stated that the Rebel Yell Advisory Board met last week and their next meeting will be in January. B. Faculty Senate/University Committee Reports: C. Director Reports: 1. NEVADA STUDENT AFFAIRS DIRECTOR DALEY stated that he had no report. 2. ELECTIONS BOARD DIRECTOR RAMIREZ was not present. VICE PRESIDENT CECI stated that she is having problems at home and she will be here next week. ( SENATOR GARCIA asked if her absence is excused or unexcused. 2 SENATE MINUTES 29-04/ November 23, 1998 VICE PRESIDENT CECI stated that she is excused. 3. ORGANIZATIONS BOARD DIRECTOR AYALA was not present. VICE PRESIDENT CECI stated that the next O-Board meeting will be Tuesday, December 1st. He is working on policy changes and updates for the next semester and will be looking for approval of the operating policy. 4. ENTERTAINMENT & PROGRAMMING DIRECTOR JOHNS stated that the Ice-T lecture was a success. It was very well promoted by DIRECTOR DELAFONTAINE. It was one of the biggest turnouts for an event despite what the Rebel Yell said. The lecture was based on his opinion and was entertaining and informative. On Thursday they had a movie night and showed Small Soldiers and it was also a success. Over the break he and Assistant Director Lucchese will be working on the next semester. Assistant Director Lucchese asked how many Senators attended the lecture. He stated that he spoke to students after the lecture and also a teacher that was in attendance who said that she uses clips of his sitcom to teach. He thought that was very interesting and looks forward to getting more speakers of his caliber on campus to speak to us. There were several questions and comments for DIRECTOR JOHNS from the Senate. 5. OFFICE OF STUDENT INFORMATION DIRECTOR DE LA FONTAINE stated that she put a memo in the Senator's boxes regarding orientations. There are three dates for the spring semester and tabling will be from 11:00-l :00. 6. STUDENT SERVICES DIRECTOR FLEISHMAN stated that starting next semester there will be a new inventory system in which receptionists will be taking inventory of what we do and don't have. She also stated that SENATOR CLEMENS asked her to get an estimate for a 4-seater cart but the company that we worked with last year is no longer located in Las Vegas so it is going to take her a little longer to get the estimates. There were several questions and comments from the Senate. SENATE PRESIDENT KIMBROUGH stated that we have a special guest who is here to talk to us and introduced Dr. Harter. President Harter spoke to the Senate regarding the state of the Campus and then answered questions from the Senators. SENATOR VENTURA leaves at 6:10. SENATOR SHAPIRO returns at 6:44. SENATOR AUGUSTIN leaves at 6:51. D. Residence Hall Liaison Report: Trung Fung stated that their drag pageant on Friday was successful. Tomorrow they are having Disney trivia night. There were several questions. E. Student Athlete Advisory Board Liaison Report: The liaison gave a report on behalf of Daron Dorsey who was their President last year. He also stated that if anyone would like information about the certification process or the athletic program there will be a forum open to the public held on Wednesday, December 5th from 4:00 to 5:00 p.m. F. Ethnic Student Council Liaison Report: Ann Yu passed out copies of their fall newsletter. She stated that they have been passed out in the library and different colleges. They chose three people for their programming chair position and they have a meeting tonight. G. Business Manager Report: BUSINESS MANAGER JIM MOORE read the expenditures for the past 2 weeks: $400.00 to David Ruffin for a noonscene DJ performance, $104.25 for Rebel reggae fliers, $146.65 for the October phone bill, $7.36 for postage from August, $339.32 for the vehicle rental for the early voting on October 19-23, $162.50 for the movie night posters, $12.50 for business cards, $83.85 for the computer network, $118.60 to the Rebel Yell for an advertisement for a movie, $43.60 for office forms, $350.87 for tables and chairs and misc. items from last weekend's tailgate party, $222.00 for pizzas from the tailgate party, $38.00 for name plates, $50.00 for movie night pizzas, and $167.00 for a co-sponsorship for the meet the candidates forum on October 21st. He also stated that they are still trying to get the computers up and will be installing the pioneer network access. Action Item: Nomination/Election of chair to the Senate Rules and Ethics Committee; SENATOR CLEMENS made a motion to remove the Item from the table, seconded by SENATOR WHITAKER. Move into a vote. Motion passes 19-0-0. SENATOR CLEMENS made a motion to open nominations, seconded by SENATOR BASTUNAS. SENATOR CLEMENS nominated SENATOR AUGUSTIN, seconded by SENATOR FISK. SENATOR SHAPIRO nominated SENATOR WHITAKER, seconded by SENATOR KNAPP. SENATOR CLEMENS made a motion to allow each candidate to speak for no longer than 2 minutes followed by a roll call vote, seconded by SENATOR SCHROEDER. SENATOR WHITAKER spoke about why he should be the chair. SENATOR ANZALONE stated that SENATOR AUGUSTIN apologizes for not being present and read a statement from him about why he should be the chair. ( Move into a roll call vote. 5 SENATE MINUTES 29-04/ November 23, 1998 SENATE PRESIDENT KIMBROUGH stated that SENATOR AUGUSTIN receives the chair. SENATOR CLEMENS leaves at 7:11. C. VII. NEW BUSINESS A. Action Item: Nomination/Election of one Senator to serve on the Senate Ways and Means Committee; SENATOR SHAPIRO made a motion to open nominations, seconded by SENATOR CORDONE. SENATOR FISK nominated SENATOR LAZAROFF, seconded by SENATOR MORGAN. ( SENATE PRESIDENT KIMBROUGH closed nominations and stated that by unanimous acclimation SENATOR LAZAROFF receives the seat. B. Action Item: Nomination/Election of four (4) CSUN members to serve as Judicial Council representatives; SENATOR BASTUNAS made a motion to table the Item, seconded by SENATOR MORGAN. Move into a vote. Motion passes 18-0-0. C. Action Item: Discussion/Approval of Senate Bill 29-03, as submitted by SENATOR RAMEY; SENATOR DAVY made a motion to commit the Item to Bylaws, seconded by SENATOR BASTUNAS. Move into a vote. Motion passes 18-0-0. D. Action Item: Discussion/Approval of Senator Anne-Marie Lazaroff to serve on the Constitutional Revision Committee; 6 SENATE MINUTES 29-04/ November 23, 1998 Motion to approve made by SENATOR FISK, seconded by SENATOR BASTUNAS. SENATOR FISK stated that this Item was submitted by SENATOR BINETTI. Move into a vote. Motion passes 18-0-0. PUBLIC COMMENT SENATOR CLEMENS returns at 7:14. Jennifer Peck stated that the UNLV LEAD Team is accepting applications. They can be turned into their office in the SORCE room and are due by December 1 st. SENATE PRESIDENT KIMBROUGH called a recess at 7:16. SENATE PRESIDENT KIMBROUGH called the meeting back to order at 7:24. EXECUTIVE BOARD ANNOUNCEMENTS AND SUMMATIONS VICE PRESIDENT CECI stated that the Thomas and Mack is probably going to do the next ticket distribution on December 14th. He talked to SENATOR FISK last week about new Director evaluations. There is a Directors meeting on Wednesday at 5:30 per PRESIDENT PRICE'S request. SENATOR GARCIA asked if when the new round of tickets are distributed the Senate can get their seats back. VICE PRESIDENT CECI stated that it is something that he is going to talk to SENATOR VENTURA about later today and they are going to talk to the Thomas and Mack about what they can do about it. SENATOR CANEPA asked VICE PRESIDENT CECI about the status of his grades and if he is eligible. VICE PRESIDENT CECI stated that the question is the way the Constitution reads. He is challenging the way the Constitution reads for the term "in office". Once the Judicial Council is sworn in he wants to present the case to them because he doesn't think it is consistent with the way the policy should read. SENATOR CANEPA asked what is his current GPA. VICE PRESIDENT CECI stated that the question is about his spring semester GPA. The Constitution reads your grades while in office. He was not in office in May or during the spring semester, because if he were in his office CSUN would have paid for his classes. If SENATE MINUTES 29-04/ November 23, 1998 CSUN paid for his classes then he should have been held accountable. Since they were not he feels it is a different situation. SENATOR FISK stated that he believes he took office on May 1 st and the semester did not end until a week after that. He doesn't follow his logic on that. He will listen to what PRESIDENT PRICE has to say before he asks the rest of his questions. VICE PRESIDENT CECI stated that he was in office for a week during that semester but if he was in office, according to the Constitution, then CSUN would have paid for all of his credits that semester. SENATOR FISK stated that so any Senators sitting here now that may be below grades should retain their seats because their classes were not paid for this semester. So if there are any Senators sitting out there that may be below grades you are off the hook this semester. VICE PRESIDENT CECI stated that is his challenge to the J.C. and we will see how it comes out. SENATOR BINETTI stated that so after he received his report card from that Spring semester he was eligible then. VICE PRESIDENT CECI stated "excuse me?" SENATOR BINETTI stated that he is saying that during the Spring semester no one paid for your classes so it doesn't matter. VICE PRESIDENT CECI stated "right". SENATOR BINETTI asked so after the spring semester now that he is getting paid is he eligible? VICE PRESIDENT CECI stated that he is not getting paid. SENATOR BINETTI stated that is irrelevant. The point isn't whether or not this is a charity position. These requirements have to be met. VICE PRESIDENT CECI stated that the point of debate is from the spring semester. SENATOR BINETTI asked "so then right now are you eligible?" VICE PRESIDENT CECI stated that he is currently debating from the spring semester. The spring semester he got under a 2.0, which would make him ineligible for the spring semester. That is what he is taking to the J.C. 8 SENATE MINUTES 29-04/ November 23, 1998 SENATOR BINETTI asked if right now he is above a 2.0. VICE PRESIDENT CECI answered yes, he is above a 2.0. SENATOR BINETTI asked when did he go from ineligible to eligible. VICE PRESIDENT CECI stated that he was ineligible because he got below a 2.0. His overall is above a 2.0. Only his semester grade was below a 2.0 which is where the eligibility questions arise. SENATOR CANEPA asked if when he ran for his position was there not a statement regarding eligibility and what was required? VICE PRESIDENT CECI answered yes. SENATOR CANEPA asked what was his GPA when he ran for office last March. SENATE PRESIDENT KIMBROUGH stated that February 4th was the filing date. VICE PRESIDENT CECI stated that he believes it was a 2.8. SENATOR CANEPA stated so he was eligible at the time he ran. VICE PRESIDENT CECI answered yes that he was eligible at the time he ran. SENATOR CANEPA asked how did he interpret this clause in the Constitution before he found out his grades were in question. Did he interpret it the same way or is he basically looking for a loophole. VICE PRESIDENT CECI stated that he is not looking for a loophole but his contention is that if he were in office then his classes would have been paid for. That is how he sees it. You can interpret it different ways but he thinks it should be left up to the Judicial Council to decide. SENATOR BASTUNAS stated that she holds office at this point in time, however she paid for all of her classes. She finds his logic interesting. She knows that he took summer classes so he went to school while he was Vice President. She asked if he received funds during the summer school time. VICE PRESIDENT CECI stated that he did for the second set of classes, not the first. SENATOR BASTUNAS asked what is the difference between holding office and going to summer school and holding office and going to fall school. SENATE MINUTES 29-04/ November 23, 1998 VICE PRESIDENT CECI stated that it is not fall school, it is the spring semester that is in question. SENATOR CLEMENS stated that he wanted to clarify that for two weeks after he took office he did not have grades but since then he has been acceptable. VICE PRESIDENT CECI answered yes. SENATE PRESIDENT KIMBROUGH stated that this Executive Board was inaugurated on May 2nd. SENATOR BINETTI stated that she doesn't agree with the whole I'm not getting paid argument but following that it is her understanding that he actually has only not been getting paid since October. She asked when was the last paycheck that he received. VICE PRESIDENT CECI stated that it was a couple months ago, he believes it was in October. SENATOR CLEMENS asked if there was a grade that he was trying to get changed from the semester in question. VICE PRESIDENT CECI stated that there was a grade he was appealing from the spring semester but the appeal was denied. SENATOR CLEMENS asked if it was just recently. VICE PRESIDENT CECI stated that it was. SENATOR CLEMENS stated that unfortunately he heard about it from SENATOR BASTUNAS and the Rebel Yell found out about it. SENATOR CANEPA stated that according to our CSUN Constitution, it says that Executive Officers serve a 1 year term from May 1st to April 30th. So after May 1st he was technically in his term, regardless of whether his classes were being paid for. He was sworn in on May 2nd so therefore his grades were not in accordance with CSUN standards. SENATOR GARCIA asked why it has taken him so long to come forth with this information. Why didn't he make them aware of it during the summer. VICE PRESIDENT CECI stated that it was something that he was trying to remedy so that it wouldn't turn into a problem. SENATOR GARCIA stated so it took him from June up until November of this month to try to get this fixed. 10 SENATE MINUTES 29-04/ November 23, 1998 VICE PRESIDENT CECI answered "right." SENATOR GARCIA asked if he is currently using the CSUN resources such as the parking space, the cart, and other resources of CSUN while he is ineligible. VICE PRESIDENT CECI stated that he used the parking space and the office. SENATOR GARCIA asked how many paychecks he has received since he took office May 2nd. VICE PRESIDENT CECI answered probably about 5. SENATOR ANZALONE asked what grades do they use for eligibility for the Executive Board. Didn't they use the fall semester before they ran? VICE PRESIDENT CECI stated that to run they use grades from the fall semester. SENATOR ANZALONE stated that he doesn't understand where the ineligibility comes from. If they use the fall semester and then you don't make grades the spring semester, he doesn't see where it is a question. SENATE PRESIDENT KIMBROUGH stated that he believes that the Constitution stated that you have to maintain a semesterly GPA of a 2.5 during your time in office. SENATOR ANZALONE stated that he doesn't have a copy of the Constitution. SENATOR WHITAKER asked under which article is this a J.C. issue. VICE PRESIDENT CECI stated that he doesn't have his Constitution with him. SENATOR CLEMENS stated that he doesn't know if some people understand the situation. He stated that VICE PRESIDENT CECI stated that he found out what his grades were after the 15th and he found out he was ineligible. But he appealed a grade and just now got his appeal denied. Now he has finally realized that his appeal did not work and he was ineligible for two weeks. He was remedying the situation the best he could which was giving his paycheck. He doesn't think he was purposely trying to trick us, and he thought he could fix the situation by appealing his grade, and now that the grade was not changed he might be ineligible for that time, which is unfortunate. VICE PRESIDENT CECI stated that the part of the Constitution he read was in Article 4, section c, number 5. (He read from the Constitution). He stated that his question is that it says to hold office. He asked if that means that you can never have a semester under a 2.0 to serve but if you have one semester even when you weren't running that you wouldn't 11 SENATE MINUTES 29-04/November 23, 1998 do it. He asked if that means that while you are in office that you can't do that or does that mean at any time. SENATOR GARCIA stated that he has basically lost the trust of the Senate and the student body. He asked if he feels that he is still capable of fulfilling his duties as the Vice President. VICE PRESIDENT CECI stated that if you evaluate his performance as a Vice President he is fulfilling his job and it's requirements. He does feel that he is capable of serving. SENATOR GARCIA stated that he doesn't feel he has met the requirement of the evaluations of the Directors. The Constitution states that the Directors shall be evaluated every month. 5 months have passed and they have received only one evaluation of the Directors. VICE PRESIDENT CECI stated that he just read the Bylaw today that stated that he was supposed to do that every month. He did not know that they were supposed to be done every month and now that he knows he will be sure to take care of that. SENATOR SCHROEDER stated that she understands that his grades were in question and he was appealing one grade and he found out the appeal was denied now. VICE PRESIDENT CECI answered "right". SENATOR SCHROEDER asked how he feels about his eligibility. VICE PRESIDENT CECI stated that he feels depending on the Judicial Council's interpretation of the Constitution it will determine his eligibility. SENATOR SCHROEDER asked why he has to rely on other people to tell him. Why can't he say for himself whether he is eligible. VICE PRESIDENT CECI stated that if you ask him he would say that it means while in office and he was not in office during the spring semester. SENATOR ANZALONE stated that he thinks this is an unfortunate situation and he thinks PRESIDENT PRICE was put in a tough spot but he suggests if it is possible for a suspension of VICE PRESIDENT CECI until he does go to the Judicial Council and get overturned. Obviously VICE PRESIDENT CECI is doing his duties right now which really shouldn't be being done until he goes to the Judicial Council, which seems to him would be O.K. PRESIDENT PRICE stated that is something they could look into. i 12 SENATE MINUTES 29-04/ November 23, 1998 SENATOR FISK stated that his questions are not anything to do with VICE PRESIDENT CECI'S performance in office. He has been a supporter on many occasions of what he has done. He does believe that this attempt to have an appeal to the Judicial Council is an absolute last straw. He is sorry but you know your grades during the semester and you can get a pretty good grasp of what you are going to get. His appeal was not granted. No matter how well he did during the summer it is not going to bring up his spring grades. A Senator would have not been given this leniency. He has seen many Senators leave office without being given probably 10 days. This is a new step and he hasn't known something like this to occur. He thinks it is pretty straight forward. If you look at the Bylaws that ask for a grade check on a regular basis, he believes that does tell us that grades while you are in office count. It isn't just before you decide to run. There seems to be alot of things that alot of people don't want to have to do. There are rules, and when you break them there are consequences. He has alot of questions regarding the way this was handled but those are going to go to PRESIDENT PRICE. He doesn't support a suspension, he thinks he has been on suspension for six months. He would also argue that if he knew this was an issue they did have a Judicial Council for about a month. Why was that not issued to them then? VICE PRESIDENT CECI stated that we only had a Judicial Council for a week. He was getting prepared assuming that they would be there for a longer amount of time. SENATOR FISK stated that it is his understanding that at that time he had intended to fill the seat that was going to become vacant by the incumbent justice with him again. He doesn't really see why at that time they would have thought that there was not going to be a Judicial Council. He thinks that would have looked much better had that been addressed at that time or at least had the attempt been there. It wouldn't have given the appearance of let's wait and see what happens and if anybody finds out. Which he is hoping was not the mindset there. But unfortunately he gets that opinion. VICE PRESIDENT CECI stated that was not his
