PUBLIC COMMENT {in accordance with N.R.S. 241.020 (2)(c)(3)} IX. EXECUTIVE BOARD ANNOUNCEMENTS AND SUMMATIONS X. GOOD OF THE SENATE XI. ADJOURNMENT Posted in accordance with Nevada Open Meeting Law (N.R.S. 241.000) at the following locations: Moyer Student Union, Frank & Estella Beam Hall, Flora Dungan Humanities, Classroom Building Complex and Thomas Beam Engineering Complex. Articles of Impeachment C; RESOLVED, That, John P. A. Garcia, Consolidated Students University of Nevada Senator, is hereby referred to an Impeachment Committee for malfeasance under the Consolidated Students University of Nevada Constitution. The following articles of impeachment are hereby submitted to the Senate: Article 1 In his conduct of the office of Consolidated Students University of Nevada Senator, John P. A. Garcia, in violation of his Constitutional oath faithfully to execute the office of Consolidated Students University of Nevada Senator, and to defend the Consolidated Students University of Nevada Constitution, its bylaws and statues, and other laws of and within the United States and the State of Nevada, is in violation of actions that are to be referred as Conduct Unbecoming of a Consolidated Students University of Nevada Senator. The means used to implement this course of conduct or plan included one or more of the following: 1. Sexual Misconduct/Harassment Under the Student Conduct Code followed by the University of Nevada Las Vegas, Sexual Harassment as defined includes, as repeated and unwanted sexual behavior, such as physical contact and verbal comments or suggestions which adversely affect working or learning environment. Therefore the under the Rules of the 29th Consolidated Students University of Nevada Senate, and testimony forwarded by the Rules and Ethics Committee, there is sufficient evidence for the removal of John P. A. Garcia from the Consolidated Students University of Nevada Senate. 2. Threatening Opponents Under the Student Conduct Code followed by the University of Nevada Las Vegas, John P. A. Garcia is in violation of several occurrences under the category of Student Responsibilities, including but not limited to: 1. Assaulting, striking, harassing, discriminating or in any way threatening or causing physical or psychological harm to another. Section VI. Article 1. Furthermore, John P. A. Garcia is in violation of the rules outlined by the Election Rules passed by the 29th Consolidated Students University of Nevada Senate. Under Section V. Article C.: All candidates are expected to conduct themselves in a manner, which would best represent CSUN and UNLV during his/her campaign. As best expressed this would ultimately be in accordance with the Student Conduct Code followed by the University of Nevada Las Vegas, this being the case there is sufficient evidence for the removal of John P.A. Garcia from the Consolidated Students University ( of Nevada Senate. 3. Inappropriate Relationship with Dean Under the Rules adopted by the 29th Consolidated Students University of Nevada Senate Section 3: If a Senator cannot effectively represent his/her constituents, as shown through repeated tardiness, absences, or other documentable faults, he/she can be brought up for disciplinary measures (such measures can result in dismissal). John P. A. Garcia has broken relations with Carolyn Sabo, Collage of Health Science Dean, which would not allow John P.A. Garcia to continue to fulfill his duties as outlined by the Rules governing the 29th Consolidated Students University of Nevada Senate. Furthermore John P. A. Garcia is in violation of the Student Conduct Code followed by the University of Nevada Las Vegas under the guidelines for Student Responsibilities: 1. Assaulting, striking, harassing, discriminating or in any way threatening or causing physical or psychological harm to another. Section VI. Article 1. This being the case there is sufficient evidence for the removal of John P. A. Garcia from the Consolidated Students University of Nevada Senate. In all of this, John P. A. Garcia has acted in a manner contrary to his trust as Consolidated Students University of Nevada Senator and subversive of constitutional government, to the great prejudice of the cause of law and justice and to the manifest injury of the students of the Consolidated Students University of Nevada Las Vegas. Wherefore John P.A. Garcia, by such conduct, warrants impeachment and trial, and removal from office. Senate Committee Reports SENATOR MAIETTA stated that the Ways and Means Committee met today at 5:00 p.m. and approved some funding requests, which will be on the next agenda. He also commended the Senate for managing the budget so well. SENATE PRESIDENT PRO-TEMPORE DAVY stated that the Bylaws Committee will be meeting next Monday at 5:00 p.m. in Senate Chambers, there is one item pending. SENATE BASTUNAS stated that due to the required candidates meeting at 5:00 p.m. on next Wednesday she is canceling the Education Committee meeting at 5:30 p.m. SENATOR P. MORADKHAN stated the Constitutional Revisions will be meeting on Friday in Senate Chambers at 3:00p.m. and will be walking over to BHS to fill out the film survey. SENATOR VENTURA has a few questions for SENATE PRESIDENT FISK. B. Faculty Senate/University Committee Reports SENATOR MAIETTA stated that he is sitting on the Student Advisory Committee with President Harter, STUDENT BODY PRESIDENT PECK, SENATOR AUGUSIN, and DIRECTOR NYSTROM. He is asking Senators to give him a memo about any concerns that they have, that he could help them address their concerns with the committee. C. Director Reports: NEVADA STUDENT AFFAIRS DIRECTOR NYSTROM stated that he is sitting on the Student Advisory Committee with SENATOR MAIETTA had mentioned. Would like to get some input for the committee as well. There will be surveys in BHS as well. The results are available through the web. Talked with members from other Student Governments. There will be forums for students to express their feelings. The Inter Collegiate Athletic Committee meeting was today. There will be a grad bag lunch Workshop in MSU 201. ELECTIONS BOARD DIRECTOR RAMIREZ-ESTUS stated that she has completed the homecoming packet, which is due October 1, 1999. Information will be given out on Monday. SENATOR M. MORADKHAN leaves at 6:26 p.m. ENTERTAINMENT AND PROGRAMMING DIRECTOR GLANCZ stated that the tailgate last week went well. This coming tailgate Boogie Nights will perform. Movie night was a success. Comedy night is this week, please come and support this event. 2 SENATE MINUTES 29-35/ October 11, 1999 There were questions from SENATOR QURESHI and SENATOR GARCIA. ( OFFICE OF STUDENT INFORMATION DIRECTOR DELAFONTAINE stated all of her announcements on paper. She announced "Thank you for your help with all of the publicity that has been placed in your boxes. The next things that you will be seeing in your boxes within the next week are going to be for Pauly Shore. We are currently working on Table tents, handbills and big posters to be distributed for this big event. It will be a sell-out! Just make sure that you folks get your tickets early and spread the word. Also, I would like to remind you all that I am still looking for people to volunteer at Senior Nights this week. Here are the dates and times: Wednesday, September 22 6:00-8:00 p.m. and Thursday, September 23 6:00-8:00 p.m. I really need people to sign up. It is for a great cause! Let me know after the meeting if you can help out. If you have any questions, please see me after the meeting. D. Residence Hall Liaison Report: The RHA Executive Board Meetings have been moved to the Warner Building on Friday's at 3:00 p.m. Looking to update the web page for the Residence Halls. Also, a Game Show Week starts tonight and goes through October 14, 1999. E. Student Athlete Advisory Board Liaison Report There was no Liaison. F. Item will read "Nomination/Election of two senators and one UNLV administrator to serve on the CSUN impeachment committee to review the articles of impeachment regarding SENATOR GARCIA as per bylaw 6. Move into a vote (amendment). Motion passes 18-1-1. (SENATE PRESIDENT PRO-TEMPORE DAVY opposed. SENATOR SCHROEDER abstained.) There was discussion. SENATOR ANZALONE made a motion to move into a roll call vote, with each candidate speaking for no more than one minute, followed by a brief question and answer, seconded by SENATOR AY ON. Move into a vote. Motion passes 18-2-0. (SENATOR KNAPP and SENATOR PAJAK opposed.) SENATOR AYON, SENATOR FECTEAU, SENATOR KNAPP, SENATOR QURESHI, and SENATOR MCLAUGHLIN spoke regarding their candidacies. SENATE PRESIDENT PRO-TEMPORE DAVY moves to nominate and elect a chair following a roll call vote, seconded by SENATOR ANZALONE Move into a vote. Motion passes 20-0-0. Move into a roll call vote. SENATOR AYON and SENATOR QURESHI receive the seats. SENATOR ANZALONE made a motion to nominate SENATOR AYON as chair, seconded by SENATOR MAIETTA. SENATE PRESIDENT FISK closed nominations. SENATOR AYON receives the seat by acclimation. III. PUBLIC COMMENT DIRECTOR RAMIREZ-ESTUS stated that all the campaign flyers need to be down tonight. DIRECTOR WAINSCOTT stated that she has the organization list done, if you would like a copy on the list. There are 30 organizations that are currently on probation. I will be having another meeting next Tuesday. Two organizations are having problems because they do not have enough members, and one organization has appealed my decision and is taking it up with the Judicial Council. Anyone who has served in this session can be nominated. Anyone who has to sit on this committee it has to be a difficult job. Both candidates nominated for the Judicial Council are very high quality people, and they will do a good job It is sad that there are some Senators that continually abstain, I am sorry if my tone of voice changes but it seems mondane for those who have to do it all of the time. Glad to fill the J.C. seat. 9 SENATE MINUTES 29-35/ October 11, 1999 SENATOR TURNER stated that he would like to congratulations to the two new J.C. and congratulations to those that were re-elected. SENATOR M. MORADKHAN stated that she attended Leadershop. Congratulations to the newly elected J.C. and Senators. SENATOR A YON stated that he is sorry that SENATOR WHITAKER was D.Q. and hopes that he submits it to the Judicial Council. Glad to see that there are two new members to Judicial Council. Very serious about the impeachment, hopes to get a lot done. Sorry to give SENATE PRESIDENT FISK such a hard time. The elections forum was completely uninspiring. I hope that the people who seat in these chairs after us will read real literature from the framers of the constitution. And hope they will inspire others, and know what came before you as a reference to the past. Anyone who reads the Rebel Yell would be greatly misinformed and would not know anything about the actually election but rather the opinion of two people who wanted Aaron Clemens in office. And the Editor-in-Chief, Rachel Land, misinforms the students about the candidates who are out there campaigning for the election. The issue of the Rebel Yell consistently declines. They can't even find things that are news worthy on this campus, instead they report on news on other campus'. I know that there are news worthy people on this campus and organizations that are doing good things on campus that aren't being reported. Maybe if you are looking to improve the paper you might want to take a journalism class and stop reading the Review Journal because that is not a high quality paper. SENATOR BRINK stated that she abstains votes when she is uneducated on the issue and does not feel she could accurately give an opinion one way or another. I have complete faith in the Senate, and I believe that we deal with very heavy issues and should be taken very seriously. You need to understand what the issues are before you can vote on them. Congratulations to all the candidates. There are a few things that she would like to see change for the next elections, but she'll address them at another time. SENATOR MCLAUGHLIN stated that she is not one to abstain but she felt she was not informed enough on the issue. And she doesn't appreciate the look of death that she received from people across the room. She has full faith in the members of the board. Sorry that you weren't inspired SENATOR AYON by my speech during the open forum. Congrats to those members who were elected. SENATOR QURESHI stated that she appreciates the position and will do the best job she can. Congrats to everyone who ran for the election. The abstaining thing doesn't happen all the time but was necessary for those particular votes. SENATOR AYON you don't have to read the paper and agree with it when it is just an opinion. Really would like to see pizza available during the election there were several people who would like to see that available. SENATOR P. MORADKHAN stated that their will be a committee meeting on Friday. Congrats to all the Senators. I think that SENATOR QURESHI really expressed her concerns about the committee and will do a great job. Rebel Yell is just a waste of paper. SENATOR AUGUSIN returns at 8:01 p.m. SENATOR SCHROEDER stated that she is very concerned with the ELECTIONS BOARD DIRECTOR who was not in attendance on Thursday. Especially at the amount of complaints filed on that day. She also commended DIRECTOR WAINSCOTT who filled in for DIRECTOR RAMIREZ-ESTUS during the election. And DIRECTOR RAMIREZ-ESTUS never called anyone about the meeting. She sees both sides of the voting process and knows what it means to abstain. Also, glad to see that there are Senators which will be back. SENATOR HAMBY stated that she would like to congratulate members of the newly elected senate. SENATOR GREEN stated that he attended LEADERSHOP and thought that it was a positive experience. Sad to see the College of Engineering lose such a great Senator especially when the members of the college voted for him. SENATOR WHITAKER stated that the Rebel Yell loosing a lot of journalism skill. Didn't campaign at all and yet he won, and now he is being disqualified for that basis. Not planning to appeal the decision, you have to follow the rules and apparently I didn't. SENATOR ANZALONE stated that he would like to congratulate SENATOR A YON. Impressed to see David Himmel take things and run with it, even though he does write for the paper. Those senators that abstained did a great job, because they were not educated enough to vote. As far as abstaining, inform yourself about the issues before the meeting and don't become a Monday nigh Senator. Student involvement is something that I take very seriously and it really bothers me when young people are discouraged to get involved.
