1 Section 9* There shall be added to the basic purchase 2 price to be paid by the District upon the sale date the following 3 am o u n t s : 4 (a) All payments made by First Parties, or any of 5 H them, at any time, and the cost of all material furnished 6 by First Parties, or any of them, to contractors for work 7 performed during the period, September 1, 1952, to and 8 including the sale date under contracts executed by First 9 Parties, or any of them, with contractors for the con- 10 struction of all additions and betterments to and exten- 11 sions of the water production, storage, transmission and 12 distribution facilities mentioned in subparagraphs (b), 13 (d) and (f) of said Section 1. First Parties, and each 14 of them, hereby assign to the District, effective upon 15 the sale date, all their rights under all contracts for 16 the construction of such extensions, additions or bet- 17 terments uncompleted on the sale date, and the District 18 hereby agrees to assume, effective upon the sale date, all 19 obligations and liabilities accruing for work performed 20 subsequent to said sale date under any such contracts which 21 have not been completely performed by all parties thereto 22 on or prior to the sale date* The parties hereto agree 23 to execute and deliver such further instruments and doo- 24 uments to make effective said assignments by First Parties 25 and the assumption of such obligations and liabilities 26 27 28 34.
