CSUN SENATE MEETING 34-29 MONDAY, AUGUST 30, 2004 MSU 201, 6:00PM I. CALL TO ORDER SENATE PRESIDENT AMESQUITA called the meeting to order at 6:08pm II. It's gonna comprise 3 stories and will allow to actually serve all these students. Campus groups will be able to go there. Anything you can think of in a rec center. SENATOR CORPUZ: I'd like to commend Manuel SENATE PRESIDENT PRO-TEMPORE CIANCI: motion to move back to order of the day to PRESIDENT SCHUCK'S state of the campus address. SENATOR HUERTA 2nds 20-0-0 Motion PASSES unanimously. E. Liaison Reports THOMAS STUDDERT: thanks CSUN for support in Ask Me campaign. 3 SENATOR ESPINOZA: Ask Me is successful. SENATOR JIMENEZ: it looks really professional, 100 times better than last year. SENATOR CONWAY: if they don't go to the meeting? THOMAS STUDDERT: we're trying to make it as mandatory as possible. PRESIDENT SCHUCK: Tom put the whole thing together and everything about it, went through Tom and it's one of the greatest things. I think we should all take a second to commend him. i. Greek Advisory Recruitment is gong on. Tables are set up. September 8 at 6 in the ballroom for registration. ii. Multicultural Student Affairs iii. Residence Hall Association NICK: vice president of .. .opening week: (see report) SENATOR MACK: I have the pleasure of living in the dorms and the transition was great. NICK: they're trying to get rid of the word dorm and use the word residence hall. iv. Student Athletics SENATOR MAPES: football's coming up on Sunday, kick off s at five. It's on ESPN2. NFL time slot, but not NFL network. Should be a big game. Volleyball this weekend. Tournament on Friday. Washington and San Jose state are here. Soccer game tonight and Friday night. Swipe card system at Ask Me will be same at football. All you need is your rebelcard. Another thing is opportunity to use Rebelcash at concession stands. v. Student Health Advisory Committee vi. ROTC JUSTICE CHAPEL: this is what I'm here for today. Over summer bunch of us went to different training camps. English army, airborne school. I went to leaders'training course. It's like a mini bootcamp. Bunch of other cadets went to camp in Fort Worth Washington. At 0600 today we started training. Later in fall some field train officer courses. 4 SENATOR CONWAY: you had to go to bootcamp? JUSTICE CHAPEL: I had to for scholarship. vii. Leadership Advisory Board SENATE PRESIDENT PRO-TEMPORE CIANCI: we had a speaker come in from 1 -4 on Saturday, Laura Oistein. Lab meetings will be Thursdays 6 or 7 pm. I will be meeting Matt Starkey one on one because I unfortunately have work. The events that are necessary I will be more than willing to take off work. Any questions about what we did? SENATOR CAZARES: what'd you do? SENATE PRESIDENT PRO-TEMPORE CIANCI: we made little things about what we're supposed to be doing. Like Leadershape but on a smaller level. Meet, play games, talk about different ideas. Most people wrote down goals. My thing was controlling my emotion and tone of voice. F. Rebel Yell Report BUSINESS MANAGER HILL: today was first issue of the year. Like 36 pages. PATTY WALSH: it's a very fulfilling 36 pages. It's going to be on shelves tomorrow. The crosswalk and shuttle stories are there, too. And welcome week. VIII. EXECUTIVE BOARD ANNOUNCEMENTS VICE PRESIDENT PRO-TEMPORE ANDERSON: none VICE PRESIDENT GOATZ: I'll start with bad news. We met to discuss the action of probation from now until Septemer 27 as long as it doesn't merit another evaluation. You all should have gotten the directors' evaluations thus far. BUSINESS MANAGER HILL suggested that I do incorporate this into it. I meet with the directors now and have them agree or disagree, comment and sign. Case was decided. Fall'04, everyday except holidays are instructional days. SENATOR CONWAY: were there any other directors that weren't up to par? VICE PRESIDENT GOATZ: it's noted in the evaluation. Assistant director Tostenrud and Director sumner, but foturnately we were able to work it all out. SENATOR DEARMAS: what are the conditions for probation? 5 VICE PRESIDENT GOATZ: SENATE PRESIDENT PRO-TEMPORE CIANCI brought to my attention that it would be the next appropriate step. They get checklists and if the checklist is not completed... SENATOR DEARMAS: why was the punishment so severe? VICE PRESIDENT GOATZ: we were able to work out everything that was correctable with DIRECTOR SUMNER; with DIRECTOR MADRIGAL, it was much more serious. If you look at bylaw 31... SENATOR DEARMAS: for action item e? VICE PRESIDENT GOATZ: it has to be on the agenda for at least 2 weeks. PRESIDENT SCHUCK: yield SENATE PRESIDENT PRO-TEMPORE CIANCI: for new people, I'll be ordering your stuff. Miniboards are corrected. For new senators that need to sit on committees, you can go upstairs and look at the board. As VICE PRESIDENT GOATZ just said, meetings can be closed. SENATOR CAZARES do we have new statutes? SENATOR CAZARES: yes, they'll be in your boxes. SENATE PRESIDENT AMESQUITA: SENATOR SOLDANO is recovering from an operation she just had. She's in stable condition. She's at UMC hospital. The operation's pretty serious, but she's okay. Books for bingo is tonight. Henry's speech was really good. Everyone's invited. Shelly Berkley's assistant said she's agreed to come and speak on November 1st for 35th inauguration of senate. We'll go and start making special invitations. We'll have 201 and 202. It should be a big to do. One of 435 in congress, she'll be here the day before elections. She's very excited to come and talk to us. Entertainment and Programming had some things happen today but it was free. I've never lived in residence halls, but they do a lot of good things and if you wear your name badge, everyone wants to join. These students are ready to get involved. Wear your name badges. By end of week I'll have an updated contact list. IX. PUBLIC COMMENT X. UNFINISHED BUSINESS A. Action Item: Approval of one(l) CSUN member to serve as Justice for a term ending two (2) years from date of appointment. As submitted by Senator Cazares. Action Item: Approval of the apportionment of all Senate Seats for the 35th session in accordance to bylaw 33. As submitted by Senate President Pro-tempore Cianci on behalf of Senate President Amesquita. SENATE PRESIDENT PRO-TEMPORE CIANCI: move to approve SENATOR JIMENEZ 2nds SENATE PRESIDENT PRO-TEMPORE CIANCI: I don't know exactly why it needs to be approved, but apportionment has nothing to do with us and we can't approve or disapprove it. it's redundant to even put this on the agenda, it's not necessary at all. PRESIDENT SCHUCK reads numbers Business 5 Education 2 Engineering 2 Fine Arts 2 Health Sciences 1 Hotel Administration 2 Liberal Arts 3 Nursing 1 Science 2 University College 3 Urban Affairs 2 If you want to know where the numbers came in close its Urban Affairs and Engineering by .002 on the percentage. Action Item: Nomination/Selection of one (1) student to serve as Senator for the College of Business for the remainder of the 34th session. As submitted by Senate President Amesquita. SENATE PRESIDENT PRO-TEMPORE CIANCI move to postpone until 34- 30 7 SENATOR BOWERS 2nds SENATOR ESPINOZA: when are the new senators appointed? SENATE PRESIDENT AMESQUITA: take office on November 1st. 20-0-0 Action Item A POSTPONED unanimously B. Action Item: Approval of Korie Brust to serve as the Assistant Director of CSUN Services for the term ending April 30, 2005. As submitted by Senator Sumner on behalf of CSUN Services Director Ea Madrigal. SENATE PRESIDENT PRO-TEMPORE CIANCI: move to postpone until 34-32 SENATOR FRIEDLIEB2nds SENATOR MULLINAX: why? VICE PRESIDENT GOATZ: it's the first time it's been on the agenda. SENATE PRESIDENT PRO-TEMPORE CIANCI: um, the reason it's being postponed is because the probationary period that ea is on it's the consensus of the eboard that until the probationary period has been served, an assistant shouldn't be appointed to her. SENATOR MULLINAX: if there's more than one person screwint up, it may not be there fault. I think it's important that she have an assistant, the eboard presented ea. her ideas must have been good enough for you to appoint her. so ifsomeone else can carry out her ideas, an assistant might be good. SENATOR DEARMAS: senate approved an assistant for elections board like that. I know there have been some issues and misunderstandings, my point is that it's imperative that she have help. SENATOR CONWAY: what took you so long to put this on the agenda. SENATE PRESIDENT AMESQUITA: it wasn't submitted properly. SENATOR CONWAY: I was otld it was given to you months ago. SENATE PRESIDENT AMESQUITA: no, it wasn't correct, she daid I'm sorry and sne sumner came and said here it is and submitted correctly, she didn't suSENATOR MAYERit it properly. SENATOR CONWAY: you mess up all the time. 8 SENATOR MAYER: why don't we amend the term to end with the probationary period? schuck: let me answer a couple of things, she's not being suspended, she's bein ut on probation, she's been given the opportunity to turn it around, these are back to back evaluations that have been negative, we don't feel like it's a good idea.. .1 don't know korie. the onl person I know who has had an interview with her is madrigal, if at the end of three weeks she can do the duties the way we fele the way they should be done, we don't feel confident in her decision making. SENATOR MAYER: you are hindering her ability to do her job by denying her an assistandt. peter obviously oversees all that anyway. sumner: I don't work with her everyday, these guys do. as a senate we have the power to work on it. if you don't agree with it, then just pretty much don't vote for it. SENATOR ESPINOZA: whether she odes need an ssitant, why don't we just postpone it and we'll have the decision next week. SENATOR CAZARES: she had one good evaluationand she said she needed an ssitant then. SENATE PRESIDENT PRO-TEMPORE CIANCI: to address q's about approval of elections director it was sitting thre for at least two or a month and a half. VICE PRESIDENT PRO-TEMPORE ANDERSON: my whole job is to be a sup to dorectors. I worked with ther step by step throught he process and she can recruit a board, and she can sue candidate burst as a board member, she has plenty ot help, we just don't feel the necessity to put forth a director at this time, we'd rather have them on the board than have them fighting for their jobs in three weeks. SENATOR MAPES: it sounds like they're split on this, I'm sure we can all make an effort to help. SENATOR MACK: like Jaime said, get a little more ffort rather than jump to something so extreme. SENATOR FRIEDLIEB: I would say since the next meeting is in two weeks, why don't we postpone until nexst mtg and you guys can interview her and know what you feel about her. 9 SENATOR CONWAY: I don't feel comfortable not giving her someone to work with, I don't feel comfortable not giving her every opportunity, shcuck: eric? SENATOR CONWAY: it's not working, she's not doing well with them, seems to em that we should give her all the opportunity in the world. SENATOR CRAWFORD: we don't have amtg next week because it's labor day, right? think aobut the itme frame the new assist dir could be working for. I don't see how the ssist dir working for two weeks could make the diffetence between ea keeping or losing her job. at: it's the beginning of the semester and everyone's busy, we should consider giving her more time. SENATOR FRIEDLIEB: I don't understand how everyone thinks, if everyone thinks eboard is the ultimate assistance, then what's the need fror any dir or assist dir? there should be an assist dir. I think we should give her one asap. think abou this guys, two weeks is a big difference, sen crawford. it could mean the difference between a massive failure, it's not a minute insignificant factor, it's major and it could make a difference in anything. SENATOR BOWERS asks questions about staffing and locations SENATOR KRISTA DONNELLY is online viting 24hrs? DIRECTOR SUMNER: yes.... SENATOR CRAWFORD..it is a potential source of revenue ,.. .let other sources on campus use them; SENATOR ESPINOZA are we going to get the PC's and then SIA might se them for a cost? 11 DIRECTOR SUMNER: SIA has expressed interst in helping in the purchase of the laptops.. .but it is in the works... laptop per booth, exact same setup with laptops. SENATOR DEARMAS: as far as increasing voter registration... DIRECTOR SUMNER: it's part of our marketing plan. Motion PASSES unanimously as amended 17-0-0 without SENATOR MACK D. Action Item: Approval of amount not to exceed $12,000.00 to be paid to The Apple Store for the purchase of 11 laptops that will serve as polling areas for the elections. Costs will be encumbered from the CSUN 2702 FY 05 Reserve budget. As submitted by Senators Huerta and Jimenez on behalf of Director Sumner. SENATOR HUERTA moves to approve SENATE PRESIDENT PRO-TEMPORE CIANCI 2nds SENATOR FRIEDLIEB: I don't like taking money out of the reserves. I see a big problem with this. DIRECTOR SUMNER only has 25500 in her budget. SENATOR CAZARES: just to reiterate, this program is webbased? Can we not rent them? DIRECTOR SUMNER: we researched that and it was about the same price. PRESIDENT SCHUCK: it also doesn't give us ability to do surveys anytime we want. SENATOR CRAWFORD: I just wanted to clarify the 300 for shuttles is split up. SENATE PRESIDENT PRO-TEMPORE CIANCI: move to amend by striking to the apple store. SENATOR CAZARES 2nds SENATOR CONWAY: is it a good idea to pay money and not know where it's going? BUSINESS MANAGER HILL: we like to see who offers the best rate - in the past. 12 DIRECTOR SUMNER: we had to get it in. Apple had the cheapest bid. Right now it's between Dell and Gateway. It'll be the same price, probably a little cheaper. We won't know until we get all the bids in. It has to go through purchasing. 18-0-0 Amendment PASSES unanimously PRESIDENT SCHUCK: any concerns about reserves, there's 850000 but if the Board of Regents ever gets in a bind, they can swipe that money. Don't think that's money we have control over. You're at a big risk if it's sitting around. When they find out about it, they'll either swipe it or question it. BUSINESS MANAGER HILL: new controller on campus, the first question he asked was why is it so big? Why don't we cut it back each year was the next question. SENATOR MULLINAX: you have to spend to make, we should give ourselves raises. SENATOR FRIEDLIEB opposes. SENATOR CONWAY abstains. 15-1-1 Item PASSES as amended. E. Action Item: Approval of one (1) CSUN member to serve as Director of CSUN Services for a term ending April 30, 2005. As submitted by Senator Crawford on behalf of the Executive Board, out of order XII. EXECUTIVE BOARD SUMMATIONS VICE PRESIDENT PRO-TEMPORE ANDERSON: I spoke to them both personally and said here's my number and asked what I could do to help. SENATOR TEMPLETON, you didn't come to the scholarship committee. We do go out and help directors. We want them to succeed. We don't want DIRECTOR MADRIGAL to fail. If she fails, all of UNLV suffers. SENATOR SUMNER leaves at 8:24pm VICE PRESIDENT GOATZ: When I do evaluations I try to highlight the good as much as possible. When someone gets good or needs improvement.. .I'm up there all the time. If you're not up there, you don't know what's going on. I didn't see anyone but SENATE PRESIDENT PRO-TEMPORE CIANCI at welcome meeting. It'd be nice to see more active involvement. I've asked her time and time again and the only 13 comment I got was that she needed a body. Directors always ask for help. It's our job to supervise, it's their job to be administrators for their department. PRESIDENT SCHUCK: asks directors. It's not like I abandon the directors. Every time any of our directors asks for help they run stuff past me, I revise things, I try to be a helping hand. I'm pretty hands on. If you think we as an e board aren't assisting them, you guys are dead wrong. I'd rather be happy and have everything work out good. I don't want to sit for 2 and a half hours... We brought you one bad evaluation that we brought it to you with a unanimous eboard vote. DIRECTOR SUMNER had a bad report and I couldn't be more happy with how much she's turned that around. We're not going to bring you stuff that I know is going to be a battle if I don't have to. Have a good first week of school. Go Rebels, Go CSUN. SENATE PRESIDENT AMES QUIT A: I'll take this tomorrow morning over to Lisa. Items are due by 5:00pm, Friday, Sept 10. That's for the 30th meeting. SENATOR CAZARES, I need to talk to you about that committee for bylaws. Please go see her. XIII. GOOD OF THE SENATE SENATOR ESPINOZA: good luck in new school year. SENATOR BOWERS: for my fraterninty we're purtting on a fundraiser. Alpha Kappa Psi. At Sunset Station poker tournatment $50 buy in. Open bar. Also, Justice McSharry and I would like to invite you guys to our housewarming party at 8. She would like gifts. I don't care. SENATOR MACK: concerning welcome week, throughout the beginning I saw a lot of people helping in a lot of other ways. Not once did I ever hear the eboard ask for help. I don't even know who she is. I hear a lot of personalized things. If you ask a little more, you'll et a lot more help. SENATOR ZANDER: have a good week. SENATOR JIMENEZ left because it was his mother's birthday. He loves his mom. SENATOR KRISTA DONNELLY: as for SENATOR TEMPLETON about scholarship committee I felt I was made very much aware about the meeting. The communication was fine. I got emails and was asked in person. As for the reserves I don't think the spending is frivolous. Henry did a really good job at orientation., sorry I left early last meeting, it was my birthday. SENATOR KARA DONNELLY: thank you for appointing me at the last meeting. Sorry I left early; it was my sister's birthday and I love my sister. SENATOR FRIEDLIEB: I don't remember whether it's mandatory anymore but I think it would be a good thing to do if it isn't it would be good if everyone posted 14 office hours. I definitely think we shoud start posting our office hours. Don't keep saying the same thing someone else said. Speak when it's your turn, not when someone else has the floor. SENATOR MULLINAX: rules and ethics we need someone on rules and etics. SENATOR MACK's wrong. I do make personal attacks at Schuck (laughs). You have two weeks to talk to two classes. I believe that everyone should have the opportunity to do a good job and should be given all the opportunity to do it. Just because she won't admit she needs help, dones't mean she doesn't need it. It wasn't Henry who got everyone hyped, it was the band. I hope UNLV does well. I hope they don't lose by 26 points. Watch the marching band, they're doing some weird weird stuff this year. You reiterate yourself over and over and over again. I work at the freakin' frog at 10 so stop in and say hi. SENATOR CONWAY: e-baord, you guys are doing a good job. cross walk, great accomplishment. It's not what you're doing it's the way you are going about doing it. If you guys tell us you're messing up this and this and this and this, then.. .there were times you weren't paying attention to directors and stuff, laughing.. .it's good to see everybody. Like the hoodies. SENATOR TEMPLETON: before I became a senator I was constituent and when I became a representative for my constituents..., I appreciate you guys trying to save money for our constituents. I can see why VICE PRESIDENT PRO-TEMPORE ANDERSON and SENATOR KRISTA DONNELLY correspond, I've seen them correspond on the third floor... OPEN DISCUSSION Personal Notes: CSUN Executive Board Meeting for Monday, August 30, 2004 ( CSUN ELECTIONS OPERA TING POLICY Revised June 2004 Purpose The purpose of the Elections Board shall be to properly, fairly, and objectively conduct CSUN Elections. I. Structure The Elections Board shall consist of the following: A. The Director, who shall be nominated by the Executive Board and approved by the Senate; B. The Assistant Director, who shall be selected as prescribed by Article IX, Section E, Item 1 of the CSUN Constitution; C. At least three (3), but no more than ten (10), CSUN members, at least one of whom must be a senator; D. The Board will require eighty percent (80%) attendance for quorum. II. Duties, Powers, and Responsibilities of the Elections Board A. The Elections Director: 1. The duties of the Director shall be as those as described in Article IX, Section D, of the CSUN Constitution; 2. The Director shall chair the Elections Board; 3. The Director shall vote only to break a tie; 4. The Director shall be required to comply by the duties required of the Board as long as it does not interfere with his/her duties as a Director; 5. The Director shall make regular reports to the Executive Board and CSUN regarding elections; 6. The Director shall make recommendations to the Board regarding any financial infractions by the candidate and/or person(s) associated with the candidate; 7. The Director shall verify the validity of infractions committed by the candidate and/or person(s) associated with the candidate. The Director shall approve action items to be brought to the Board based on that verification. B. Elections Assistant Director 1. The duties of the Assistant Elections Director shall be those as described in Article IX, Section E, of the CSUN Constitution. C. Elections Board 1. The Board shall maintain public neutrality with regards to any candidate or issues in any election within his/her jurisdiction; 2. The Board shall review and approve the budget prepared by the Director; The Board shall validate all signatures on the candidates' filing forms, and report the findings to the candidates the Monday following the due date. If not valid, the candidates have one (1) week to re-submit the corrected form; 4. The Board shall f
