Deed has been delivered and recorded and the con­sideration outlined therein collected. Hot thought necessary to revise deed but in order to protect grantees in deed with respect to refunds in connection with future developments, suggest agreement be made between LVL&W Company and grantees providing that LVL&W Company will enter into refund contracts with grantees, or their successors, pursuant to rules and regulations of the company, approved by Public Service Commission, for refund of cost of mains advanced by grantees or their successors. Advised by Gahlan that grantees have already sold approximately 20 acres of land to Biltmore Homes, Inc., who are constructing housing project thereon. The refund contract with Biltmore has been prepared for submission to yop. Understand grantees expect to sell other parcels of this land from time to time and not to personally develop the property. Believe general agreement with grantees here suggested and specific refund contracts with persons who develop the land from time to time will take care of the situation adequately. We are preparing a new refund rule for approval of the Public Service Commission which will relate solely to defense housing projects and which will cover the McNeil transaction, the Biltmore Homes, Inc*, and any similar housing projects.
