10. ARTICLE XI - CONTRACTOR DEFAULT A. This entire agreement is made upon this condition, that 1) if Contractor shall fail to construct and install, or there- after to maintain and service the advertising displays herein as required or if said Contractor shall fail to or neglect to or perform or observe any of the covenants contained herein on its part to be kept and performed and such failure or neglect shall continue for a period of not less than thirty (30) days after the Commission has notified Contractor in writing of Contractor's default hereunder and Contractor has failed to correct such defaults within said thirty (30) days, 2) if Contractor shall be declared to be bankrupt or insolvent according to law, or if any assignment of its property shall be made for the benefit of creditors, then in any of said events, the Commission, or, those having an estate in the pre- mises, lawfully may, at its option, immediately or at any time thereafter, with- out demand or notice, enter into, and upon said premises and re-possess the same, and expel said Contractor and those claiming by, through, or under him, and in that event title to the advertising displays and additions thereto shall rest in the Commission. On the re-entry aforesaid, this agreement shall terminate. B. In the event of action or suit or proceeding is brought to take possession of the premises or to enforce compliance with the Agreement by Contractor, Con- tractor shall pay to the Commission such sums as the Court may adjudge reasonable as attorney's fees to be allowed in said action, suit or proceeding. C. Any waiver of any breach of covenants herein contained to be kept and per- formed by Contractor shall not be deemed or considered as a continuing waiver and shall not operate to bar or prevent the Commission from declaring a forfeiture for any succeeding breach either of the same condition or covenant or otherwise. ARTICLE XII - REDELIVERY OF PREMISES Contractor shall make no unlawful or offensive use of the premises, and, at the expiration of the term of the Agreement or upon any sooner termination thereof, without the necessity of demand therefore by the Commission or those having its estate in the premises, Contractor shall surrender possession of the premises peaceably, quietly and in as good order and condition, reasonable use and wear thereof, fire and unavoidable causes excepted, as the same now are or any hereafter be placed by improvement thereto by Contractor or the Commission. ARTICLE XIII - PROPERTY RIGHTS UPON TERMINATION It is mutually agreed that the Contractor upon termination of the Agreement for any cause, shall have no claim, right, title or interest in or to the advertising displays
