L AMENDATORY ENDORSEMENT IN CON SID ERATION of the premium provided for herein, it is understood and agreed as follows: 1. (a) That the phrase “and caused by accident’’ found in Insuring Agreement Number 1, Coverage A, Bodily Injury Liability, shall be eliminated in its entirety, and in lieu thereof, the phrase "and arising by reason of, or in connection with, the business operations or work described in said declarations” shall be inserted. (b) That the word "accident” wherever it appears in the policy, pertaining to Coverage A, Bodily Injury Liability, is elirfi^^ inated and the word "occurrence” is substituted in lieu thereof. (c) That insuring agreements Coverage A and Coverage B are hereby extended to cover not only legal liability, but also liability imposed upon the insured by written contract. The limit of the Company’s liability against insuring agreements Coverage A and B, shall be as stated herein: B o d il y I n j u r y : P r o p e r t y D a m a g e : $ NOT COVERED O n e P e r s o n ; $ NOT COVERED O n e O c c u r r e n c e ; $ HEREUNDER O n e O c c u r r e n c e $ HERMJHDER_______ A g g r e g a te (d) It is expressly understood and agreed that the extension of insuring agreements Coverage A and Coverage B as set forth in sub-paragraph (c) above, to include liability imposed upon the insured by written contract, applies only while the named insured is performing work as a general contractor for the Union Pacific Railroad Company or its affiliated companies and does not apply while the named insured is performing work for the Union Pacific Railroad Company or its affiliated companies as a subcontractor. (e) That the words " I f the earned premium thus computed exceeds the estimated advance premium paid, the named in­sured shall pay the excess to the company; if less, the company shall return to the named insured the unearned portion paid by such insured” as shown in the second paragraph of C O N D ITIO N 1, PREMIUM, are eliminated and the fol­lowing wording is substituted in lieu thereof: " I f the earned premium thus computed exceeds the estimated advance premium paid, the Union Pacific Railroad Company and/or its affiliated companies shall pay the excess to the Company; if less, the Company shall return to the Union Pacific Railroad Company and/or its affiliated companies the unearned portion of such estimated advance premium.” 2. That all exclusions in the policy are eliminated in their entirety, and the following exclusions apply in lieu thereof: A. Under Coverage A and B to loss or damage resulting from the operation by the insured o f trains, cars, locomotives or other vehicles equipped for operation on tracks. B. Under Coverage A, except with respect to liability imposed by law upon another which liability has been assumed by the named Insured under written contract, to bodily injury to any employee of the insured while engaged in the employ­ment (other than Domestic) of the insured or to any obligation for which the insured or an insuror of the insured may be held liable under any Federal Employer’s Liability Act, Workmen’s Compensation Law, Plan or Agreement. C. Under Coverage A and B to loss or damage resulting from the operation or ownership of any aircraft by the insured. D. Under Coverage A and B to loss or damage as a result of bodily injury or damage to property on completed or aban­doned work if such loss or damage occurs thirty (3 0 ) days or more after acceptance, completion or abandonment of such work. E. Under Coverage B to loss or damage to property owned, rented to, or leased by the insured, or in his care, custody and control, unless such property be the property of Union Pacific Railroad Company or its affiliated companies. F. Under Coverage A and B to liability assumed by the insured, except that contained in contracts with the Union Pacific Railroad Company and its affiliated companies. Such assumed liability being subject to all the terms, conditions and ex­clusions of this policy. . Under Coverage A and B to loss resulting from the operation, maintenance, or use of motor vehicles of any kind, or the loading or unloading thereof, elsewhere than upon the premises described in the policy upon which the insured is performing work for the Union Pacific Railroad Company or its affiliated companies, except public ways used in com­mon with others provided, however, that this exception shall not apply with respect to the coverage described in ParSW graph 1 (c) of this Endorsement, and further provided that self-propelled contractors’ equipment not designed for the” carrying o f persons, material, or equipment shall not be deemed to be "motor vehicles” while at the work place herein described. ’ I , I , H . 3. That Condition 4 of .the policy, "Assault and Battery” is eliminated in its entirety. 4. That the word "five” appearing in the fifth line of Condition 15 (Cancellation) shall be amended to read '’’thirty”. Nothing herein contained shall be held to vary, alter, waive or extend any of the terms, conditions, or limitations of the policy to wjdkh this endorsement is attached other than as above stated. !
