    3 c) Bidder must submit with his bid proposal a schematic diagram in color showing his intent with respect to advertising in the terminal building. d) Each bidder shall submit with his proposal a certified or cashier's check or a surety bond in the amount of $5,000.00 as provided in the Notice of Call for Bid Proposals and with force and effect as therein specified. The Bid Bond, if used, shall be in form as set out in the attached form and shall be duly executed with a surety company thereon qualified to do business in the State of Nevada and acceptable and satisfactory to the Commission. e) Failure to submit all of the foregoing with bidder's bid proposal shall be cause for disqualification of the bidder. 5. Explanations, Written and Oral Should a bidder find a discrepancy in, or omission from the specifications, or should there be any doubt as to the meaning of any thereof, he shall at once notify in writing the Clark County Purchasing Agent, who will then send written instructions to all bidders. The Commission will not be responsible for any oral instructions. 6. Withdrawal of Bid At any time prior to the date and hour set for the opening of bids a bidder may withdraw his bid. This will not preclude the submission of another bid by such bidder prior to the date and hour set for the opening of bids. No bid proposal shall be withdrawn except with the consent of the Commission for a period of 30 days following the opening of bid proposals. 7. Opening of Bids At the time and place set for the opening of bid proposals each and every bid proposal received prior to the scheduled closing time for the receipt of bids will be publicly opened and read aloud. Any bids received after the scheduled closing time for receipt of bids will be returned to the bidder unopened. Bidders qualifications forms shall not be read publicly, and the information con- tained therein shall be held confidential. 8. Unacceptable Bids No bid proposal will be considered or contract awarded to any person, firm or corporation that is in arrears or in default to the Commission upon any debt or under any contract, whether as surety or otherwise, or where such bidder has failed to perform faithfully under previous contract with the Commission. 9. Award The Commission will no later than 30 days following the opening of bid proposals accept the bid proposal and award on the sum of the proposed rentals to be paid to the Commission for each of the years of the term of the contract, provided, however, that the Commission reserves the right to reject any and all bids and to readvertise for bids.
