CALL TO ORDER: SENATE PRESIDENT LAXAGUE called Senate Meeting 27-11 to order at 6:30 p.m.. II. APPROVAL OF MINUTES: Motion to approve Minutes for Senate Meeting 27-10 made by SENATOR ANDERSON, seconded by SENATOR PERSCH. ( ' CONSOLIDATED STUDENTS • UNIVERSITY OF NEVADA, 4 5 0 5 SOUTH MARYLAND PARKWAY • LAS VEGAS, NEVADA 8 9 1 5 4 - 2 0 0 9 • (702) 8 9 5 - 3 4 7 7 • FAX (702) 8 9 5 - 4 6 0 6 SENATE MINUTES 27-11 / MARCH 10, 1997 SENATE PRESIDENT LAXAGUE requested an update of the vote on the item regarding Mr. Saunders; it had not been recorded. The motion passed as 18:4:0. (SENATORS ' ^EISCHMAN, ANDERSON, LEHMAN, and AMEND opposed.). Then, SENATOR PEREZ moved to reconsider the item for Mr. Saunders, seconded by SENATOR FLEISCHMAN, and it passed with the same vote 18:4:0. Then, a motion to amend the date to "March 4" was made by SENATOR FLEISCHMAN, seconded by SENATOR PEREZ; the Motion to amend passed unanimously as 22:0:0. Then, the Main Motion to approve passed unanimously as 22:0:0. SENATOR PERSCH corrected her comments in the Good of the Senate to state that she was referring to the Wine Club's table for Unity Jam on Thursday. SENATOR LEHMAN changed the spelling of "ballet" to "ballot" on item New Business Item A. SENATOR SONG corrected his comments in the Good of the Senate to state that he would be attending the Retreat. SENATOR SOLOMON corrected "Elections Board meetings" to "Senate meetings" for his comments in the Good of the Senate. SENATOR ANDERSON stated that in the Good of the Senate that she was referring that SENATOR POOLE should go for it to be an RA. Move into a vote. Motion to approve passes 23:0:0. IV. ANNOUNCEMENTS: SENATE PRESIDENT PRO-TEMPORE PEREZ announced that they will soon be updating the board with the new pictures and everything; she will organize the board, alphabetizing the colleges, and will use seniority within each college. She asked that the new Senators meet with her after the meeting because their pictures were taken with the wrong background. SENATOR SOLOMON announced a Forum for the College of Education on Wednesday, March 19, 11:30-12:30, and Thursday, March 20, 3:00 - 4:00 p.m. in CED-240; everyone is welcome to attend. V. BOARD AND COMMITTEE REPORTS: A. Director Reports: 1. NSA DIRECTOR VALERA stated that he spent the day talking with state legislature; it looks like the law school and law library issue will come up in 3-5 weeks from now. He stated that PRESIDENT ROSENTHAL will be meeting with some of the Senators regarding the new law library and law school. DIRECTOR VALERO received a phone call from the Diversity Initiatives Director, in Mueller, she would like to meet before the Senate and make her presence known. In response to 2 SENATE MINUTES 27-11 / MARCH 10, 1997 a question, he stated that "her goal isn't necessarily of an actual where it discriminates against ''unintelligible// hers is more or less on diversity whether it meets quotas or not". 2. SENATOR PEREZ spoke on behalf of ELECTIONS BOARD DIRECTOR REED. She stated that they have the official totals; JOE MILLS and WILL PRICE made it for PRESIDENT, LUIS YALERA and RANDY MILMEISTER made it for VICE PRESIDENT, and TERRY MOORE and LEIA FLEISCHMAN made it for SENATE PRESIDENT. She stated that the ballot questions failed (yes-576, no-1196). SENATE PRESIDENT LAXAGUE stated that they are going to take the poll from the Annex and move it to the Dining Commons and no fines were assessed. 3. SENATOR PRICE spoke on behalf of ORGANIZATIONS BOARD DIRECTOR BONGHI. He announced a game this Wednesday at 9:00 p.m. against Memphis; its an NIT tournament; tickets cost $5.00 per student and can be picked up at the Thomas and Mack at the ticket office with a student ID; they are limited as four tickets per person. 4. E&P DIRECTOR CASTILLO stated that Black Man Rising was phenomenal and he will highly support it if it comes back up; he's working right now on Spring Fling and named the supporting band and others he's trying to get. He announced Comedy Night called the "Gig" that will take place in the MSU ballroom next Thursday at 8:00 p.m.; there will be free food and sodas. SENATOR FLEISCHMAN apologized for not attending Black Man Rising, but she has heard good feedback about it; so she's looking forward to bringing it back again. In response to a question, he stated that it is impossible to get a certain group across two state lines in time. SENATE ( NDERSON added that she attended Black Man Rising and it was phenomenal; she suggested )ening it up to the community because of the cost and to make sure that there is nothing else going on on that side of the campus at the same time. In response to another question, he stated that he needs approximately 6 more helpers for the CBS College Tour coming up this Sunday at 9:00 a.m, Monday 10:00 a.m. - 5:00 p.m. and Tuesday 11:00 a.m. - 4:00 p.m.. SENATOR HAYES also stated that Black Man Rising was a phenomenal event; she suggested more advertising next time. SENATOR FLEISCHMAN stated that they should somehow make sure students get precedent if they open it up next time to the community; she thinks that we lost a little bit on the advertising because they were also busy advertising other things. In response to other questions, he added that Spring Fling goes from 2:00 - 10:00 p.m., 2:00 - 11:00 p.m. and it's all free to the students and the exact date of Spring Fling is April 18. 5. OSI DIRECTOR HAMILTON stated that last week they had the election banners; she stated that the KUNV Marathon is going really well and encouraged more people to volunteer to help answer phones. B. Senate Committee Reports: 1. SENATOR AGUERO stated that the Bylaws committee met today and got through one bylaw and sent the other one back for revision. They have another meeting next Monday at 5:30 p.m. in the Senate Chambers. 3 SENATE MINUTES 27-11 / MARCH 10, 1997 2. SENATOR ANDERSON stated that she talked to everybody on the Constitutional Revision committee except SENATOR AMEND, she just wanted let him know that right after this 1 .eeting they're going to go down, write the pros and cons so that they can give it to Alan as soon as possible. 3. SENATOR FLEISCHMAN announced a meeting (for the Campus Safety Awareness committee) the second week of April and asked everyone to get with her and let her know what is a good day and time for them. She stated that she prefers Tuesday after 2:00 p.m. or Thursday after 2:00 p.m.. 4. SENATOR PRICE announced that Ways and Means will not meet this Wednesday, they will meet next Wednesday. SENATE PRESIDENT LAXAGUE asked all of those chairmen, as soon as they know their meeting time and place, to write it on the Dry Erase Board behind the Senate Secretary's desk so that committee members who forget or anyone who wants to attend can. C. Faculty Senate Committee Reports. 1. SENATOR SHAPIRO stated that the Code committee met last Friday and they didn't really take any action; all that they did was decide that they didn't know very much, so they are going to bring in experts and more information on March 21, time to be announced, and copies right now of e Grievance Policy between the administration and faculty. SENATOR FLEISCHMAN thanked iNATOR SHAPIRO. D. Residence Hall Liaison Report: LEAH GRIFFITH stated that there is a lot of programming going on at the Residence Hall(s) and they're trying to search down the RHA Executive Board; she announced that if anyone is interested in going out for next year's Executive Board, the applications are due March 19. She also announced a new position of Telecommunications Coordinator. E. Business Manager Report: BUSINESS MANAGER JIM MOORE read off the list of expenses from the last week: $10.00 for Public Safety for parking permits, $115.90 for the February phone bill, $30.00 to disconnect the ringer of a student's phone, $0.32 for February postage, $29.40 for the Sparklets business this last month. In response to a question, VICE PRESIDENT MILLS stated that the ringer was turned off on the student's phone to avoid taking incoming calls on that phone. SENATE PRESIDENT LAXAGUE added that the parking permits were for election workers, the people who manned the polls and stuff. JIM MOORE clarified that approving Mr. Saunders as an interim employee is not something they can legally do; interim is a technical term used to described when you are going to put someone into a position until the job search is complete; he stated that they will place, in his contract, that he's a probationary employee, so that if we intend to discontinue his "vices we'll be able to give him two weeks notice; this means that the Senate will be able to make 4 SENATE MINUTES 27-11 / MARCH 10, 1997 up their mind by June 16 whether they wish to continue him or discontinue him. He thanked '"veryone for giving him some time to check out the fee waiver credits that SENATOR LIDEROS iked about last week. He talked with his supervisor and, unfortunately, it is not something that they can do. The Board of Regents' position on this is that those stipends and fee waivers are given to a position and while the person that's in that position can accept or decline those fee waivers, he doesn't have the option to bring a transfer; he stated that there are other options available once that money is transferred to him, ofcourse he can do whatever he wants. SENATE PRESIDENT LAXAGUE stated that he could pay for his courses and then get the money from the Registrar as a refund. JIM MOORE replied that that is absolutely right. In response to a question, SENATOR LIDEROS affirmed that he is able to collect the fee waiver. VI. PUBLIC COMMENT[in accordance with N.R.S. 241.020 (2)(c)(3)] There was no public comment. VII UNFINISHED BUSINESS A. Action Item: Discussion/Approval of SENATOR LIDEROS using his twelve (12) credit fee waiver as a scholarship for two (2) students of the College of Engineering. Motion to Remove the Table made by SENATOR PRICE, seconded by SENATOR PERSCH. Move into a vote. Motion to Remove from the Table passes 23:0:0. In response to a question, SENATE PRESIDENT LAXAGUE suggested that for SENATOR LIDEROS to give a full 12 credit scholarship, they might have to make it so that he gets all 12 credits in the fall and gets none in the spring; that way he could use his refund for those 12 to set up the scholarship on his own maybe. SENATOR FLEISCHMAN suggested retabling the item to be able to rewrite it because of what they found out from BUSINESS MANAGER JIM MOORE. Motion to Table made by SENATOR PRICE, seconded by SENATOR SONG. Move into a vote. Motion to Table passes 23:0:0. VIII. NEW BUSINESS A. Action Item: Nomination/Approval of John Gunning to the CSUN Entertainment and Programming Board. Motion to Approve made by SENATOR MOORE, seconded by SENATOR AGUERO. SENATE MINUTES 27-11 / MARCH 10, 1997 SENATOR FLEISCHMAN asked if anyone knew how many open slots DIRECTOR '"ASTILLO had, but no one present knew. DIRECTOR CASTILLO had left the meeting and John > tinning was not present. Motion to Table made by SENATOR PRICE, seconded by SENATOR SOLOMON. Move into a vote. Motion to Table passes 23:0:0. B. Action Item: Discussion/Approval of Alpha Gamma Delta Funding Request of $500.00 to be encumbered out of the CSUN 2702 (Gen) Account. Motion to Approve made by SENATOR ANDERSON, seconded by SENATOR MOORE. MELANIE NEWT spoke on behalf of Alpha Gamma Delta and answered a few questions. In response to two questions, she stated that there was considerable water damage done to the //unintelligible// chair from last year and the event is held the same time every year because it is more convenient, the weather is nice, etc.. //SENATOR STARK responded to SENATOR FLEISCHMAN's question about the chair, but what he said is unintelligible.// Move into a vote. Motion passes 19:0:4. (SENATORS FLEISCHMAN, HAYES, SOLOMON, and ANDERSON abstained.) / SENATE PRESIDENT LAXAGUE suggested to organizations to make sure that when they bmit a funding request form that it adds up to the total expenses. C. Action Item: Discussion/Approval of Delta Sigma Phi Funding Request of $500.00 to be encumbered out of the CSUN 2702 (Gen) Account. (See Attachment 3.) Motion to Approve made by SENATOR TRUJILLO, seconded by SENATOR AGUERO. SENATOR FLEISCHMAN stated that she has a problem with us bypassing the rule about paying for somebody's philanthropy. She definitely wants this (good cause) to happen, but not this way. SENATE PRESIDENT LAXAGUE emphasized that they are not actually giving the money to the little league organization, they're buying equipment with it. RICK WALLAS spoke on behalf of Delta Sigma Phi and stated that he and two other members are coaching this team and don't just want to give the money to them. Motion to amend the funding request to read "$450.00" made by SENATOR ANDERSON, seconded by SENATOR HAYES. A brief discussion ensued about how the funding request was broken down. RICK WALLAS commented on the coupon books and how that money goes back to the league. He also stated that they get advertisement on a plaque, on jerseys, a four page add in the little leagues' program, etc..A further discussion about the funding request followed. 6 SENATE MINUTES 27-11 / MARCH 10, 1997 SENATOR AGUERO made a friendly amendment to amend the funding request down to ^400.00, seconded by SENATOR SONG. The first and second concurred. Move into a vote. Motion to amend the item to read '$400.00" instead of "$500.00" passes 23:0:0. In response to a question, RICK WALLAS stated that this event would benefit the university by (students) going and watching the games; it is open to anyone who would like to go; they would post flyers, game schedules, and use word of mouth to advertise the games. A brief discussion ensued about a disagreement between paying for a philanthropy and paying for an activity that upholds the community and our reputation as a school. SENATOR HAYES stated that what they are doing is basically a good idea, but if everyone of our organizations on campus wanted to sponsor a team, she could really see this getting out of control. SENATOR FLEISCHMAN added that her problem is not with the idea or not how it is going to benefit the kids, but her problem is with where the CSUN money is going and how it (the budget) is being spent; it is not fair to other organizations;" if we do this, ladies and gentlemen, you get to open a whole big can of worms that gets to say any organization that has a philanthropy that they need to donate money to come to us because we'll give that to you and you can just don't worry about it." SENATOR AGUERO stated that "the worst case scenario that we see coming out of this is a bunch of organizations come, volunteer their time to the community, and help out their little league organization. I mean I realize that a lot people go out and will just donate money, but these guys aren't just donating money. They're sponsoring a team, 3 guys or more, it sounds like, are going to go out and be involved with the team. Practice is four days | week. They're getting involved. They're not just giving the money to someone and they're rtainly not giving (the money outright) to these kids. They're sponsoring a team so that they can effectively be active in the community." SENATOR MOORE added that they "have at times given money to certain organizations like the band for hats. The whole point is we have given money to organizations that haven't followed CSUN rules. I think that's not even related to the point. The point is that we're trying to debate, as SENATOR AGUERO pointed out, this is a worthy, notable endeavor on the CSUN's part and I think it's an excellent investment of our money for an organization that's going to be giving back to the community." SENATOR FLEISCHMAN stated that it is all right as long as it's outside of the $500.00; "we are talking about the $500.00 that is allotted to each and every organization. They have to follow rules. If you allow for an exception, it is not fair to the other organizations." Move into a vote. Motion passes 15:4:4. (SENATORS PEREZ, FLEISCHMAN, HAYES, and SOLOMON opposed. SENATORS KNUTSON, ANDERSON, POOLE, and AMEND abstained.) D. Action Item: Discussion/Approval of the UNLV Anthropological Society Funding Request of $500. 00 to be encumbered out of the CSUN 2702 (Gen) Account. Motion to Approve made by SENATOR MOORE, seconded by SENATOR LUTAR. SENATE PRESIDENT LAXAGUE asked if someone from the Anthropological Society >uld like to comment briefly on the event, but no one responded. 7 SENATE MINUTES 27-11 / MARCH 10, 1997 Move into a vote. Motion passes 19:0:4. (SENATORS SOLOMON, ANDERSON, ! .MEND, and HAYES abstained.) E. Action Item: Discussion/Approval of the Black Student Association Funding Request for $500.00 to be encumbered out of the CSUN 2702 (Gen) Account. Motion to Approve made by SENATOR MOORE, seconded by SENATOR TRUJILLO. SENATOR SOLOMON asked if anyone was here from this organization and SENATOR PRICE responded. SENATOR PRICE stated that he called them to be here. Move into a vote. Motion passes 19:0:4. (SENATORS ANDERSON, AMEND, SOLOMON, and HAYES abstained.) F. Action Item: Discussion/Approval of the Independent Service Provider Contract with David White. Motion to Approve made by SENATOR MOORE, seconded by SENATOR PRICE. Move into a vote. Motion passes 23:0:0. ( SENATOR AGUERO takes a ( personal privilege at 7:23 p.m. and returns at 7:25 p.m.. G. Action Item: Discussion/Approval of the Independent Service Provider Contract with Rob Benhorn. Motion to Approve made by SENATOR FLEISCHMAN, seconded by SENATOR ANDERSON. Move into a vote. Motion passes 23:0:0. IX. EXECUTIVE BOARD ANNOUNCEMENTS AND SUMMATIONS VICE PRESIDENT MILLS hoped that everyone had a good weekend, congratulated everyone on the elections, and stated that he will be leaving invitations in everybody's boxes for an upcoming banquet for end of the year. PRESIDENT ROSENTHAL stated that regarding the Preschool that nobody was opposed to the plan, they were opposed to the time; so his response to the Provost was that the program is fine and we'd support it if it waited until the Fall of 1998 and (they) continued the Preschool next year as is. He also announced that the registration policy now states that if you register for a class and drop it within the first week of classes you'll get a full refund, if you drop it the second week it's a 50% refund and then no refund anytime thereafter; what they're doing is changing a little so the second ;ek you get no refund if you drop anything, but they're extending it to six weeks so that you get a 8 SENATE MINUTES 27-11 / MARCH 10, 1997 50% refund if you drop everything; he explained the losses and gains of the change. He also stated +hat regarding the law school he'd like to contact the legislators about it today and all week we're 1 _,oing to talk to some of them; he wrote letters in support of the law school. He stated that regarding the elections, it will be a big transition and wants to see it begin the very next week after the elections are over and a two week period is not enough time; he wants to do a small inauguration to let the students know who the representatives are. Since the KUNV issue failed miserably, he stated that he is looking at alternative ways to find alternative money because it is going to need more money eventually. He announced that SENATE PRESIDENT LAXAGUE had a lot of good ideas at the Elections Board meeting so he gave him (LAXAGUE) a big folder and notebook to do the research on it. Lastly, he stated that the NIT Tournament is having a reception before the game on Wednesday 6:30 - 8:00 p.m. in the Si Redd room; there will be tickets. If you are interested in going, please let him know. SENATE PRESIDENT LAXAGUE stated that Aaron (PRESIDENT ROSENTHAL) gave him a list of 5 or 6 college radio stations in the West that are operated by students, so he'll be calling them and asking them on information how they're structured and how they operate, etc.. He stated that it is good to see that the elections didn't have any fines or complaints. He said that the key is to advertise for directors early, especially so that you can get the most applicants possible; the executive (board) will help out with advertising. He added that as student ambassador he gave a tour along with CARL COOK to a state legislator from Reno who was against the law school and had never been to UNLV; he thinks that the legislator is more open now to a law school. He stated that the law school is probably favored by the majority up in Carson City, but it is not an unanimously popular thing i ere. Lastly, he commented on SENATOR POOLE's situation in the residence halls. He stated that 1 /en though PRESIDENT ROSENTHAL and DR. PIPER agreed to work out a compromise and they talked, she (SENATOR POOLE) continues to be stone-walled at the bottom level by her immediate supervisor. GOOD OF THE SENATE SENATOR AGUERO congratulated everyone who made it through the primary (election); he realized that it is controversial to set precedence, especially concerning giving money to the organizations, but he thinks that when people come in here with ideas and innovations and using that money to benefit both the good of the school, the good of their organization(s), the good of the community, that is favorable in all ways, the Senate (should) precedent it in that manner. SENATOR TRUJILLO congratulated everyone who made it out of the primaries for the election; regarding the election fines, he stated that he didn't know if it was such (that) we had good candidates or lack of us actually finding fines that needed to be assessed; as senators you notice flyers being torn in half or people boasting over other people when they step down; this is something we should look in our elections board and think about that for the new executive offices coming in. He added that regarding the monies for the organizations, as senators, there is a feeling that we have to define our policy for how the organizations get money in terms of the travel and what we're going to allow and what we're not going to allow. He thinks it is time for us maybe to get a little more lidified in our procedures; there is an operations policy which no one can find at present. He stated that the Consensual Relationships policy is going to die the way he .anted it to; the Provost emphasized in an article that it will apply to everyone, even the students. SENATOR ANDERSON stated that we have to look where the Consensual Relationship policy is coming from; it came from the status of women, perhaps that is not where it should have originated. She stated that she popped into the Senate Chambers when SENATORS LUTAR, POOLE, and SHAPIRO were talking about the O-Board; she thinks they came up with an interesting idea that if we maybe pay for a trip/registration/educational, they have to come and give us a presentation (on what they actually learned, resume-building) before we give them the money. SENATOR SHAPIRO stated that regarding the funding of the baseball team, he thinks it is a good thing that a can of worms might be open because he thinks a lot of the funding policies to organizations really suck. He stated that maybe we should reconsider those policies. He stated that SENATORS POOLE, LUTAR and himself volunteered on Friday night from 12:00 a.m. - 3:30/4:00 a.m. (for KUNV) and would recommended anybody doing that; it was certainly interesting; they enjoyed the music being played, it was chosen by the students. He added that he is still trying regarding the speed bumps; they've gone over there and decided which ones were bad and removed those and they say that the rest are good, but we'll see what comes of that. SENATOR GONZALES asked about referring a ballot question about the Consensual ?lationships policy to the students. SENATE PRESIDENT LAXAGUE suggested that she submit it , an item for the agenda. SENATOR LUTAR stated that KUNV was a great experience and they had a lot of fun. She suggested changing the 15 days before an event that is required for an organization to submit a funding request to 15 days after the event so that they have time to prepare the receipts.
