CSUN SENATE MEETING 34-31 MONDAY, SEPTEMBER 20, 2004 MSU 201, 6:00PM I. CALL TO ORDER SENATE PRESIDENT AMESQUITA called the meeting to order at 6:00pm II. ROLL CALL The following senators were present: SENATE PRESIDENT PRO-TEMPORE CIANCI, SENATOR MULLINAX, SENATOR SOLDANO, SENATOR CORPUZ, SENATOR KRISTA DONNELLY, SENATOR MAYER, SENATOR SANTIAGO, SENATOR SUMNER, SENATOR FRIEDLIEB, SENATOR CONWAY, SENATOR JIMENEZ, SENATOR ESPINOZA, SENATOR HUERTA, SENATOR BOWERS, SENATOR MACK, SENATOR TEMPLETON, SENATOR DEARMAS, SENATOR MAPES, SENATOR KARA DONNELLY, SENATOR SORVONGSAVANH The following senators were late: SENATOR CORPUZ (6:01pm), SENATOR ZANDERS (6:06pm) The following senators were absent: SENATOR CRAWFORD SENATOR CORPUZ arrives at 6:01pm III. APPROVAL OF MINUTES The following minutes are submitted for approval: 34-28, 34-29, 34-30 SENATOR ESPINOZA: Move to approve minutes from 34-28 and 29, postpone 34-30 until 34-32 SENATOR KRISTA DONNELLY 2nds SENATOR FRIEDLIEB: it should be upon us to get the minutes, but maybe we could get e-mailed the minutes so we could actually read them before we approve them. SENATOR KRISTA DONNELLY: during your office hours that's a good time to go over them. SENATOR HUERTA: I actually read them at the senate chambers. SENATOR FRIEDLIEB opposes 1 SENATOR CONWAY abstains 19-1-1 34-28 and 34-29 minutes are APPROVED, 34-30 minutes are POSTPONED V. REPORTS A. Senate Committee Reports SENATOR CORPUZ: constitutional revisions this Saturday at 2 SENATOR SOLDANO: if bylaws could meet after the meeting, if not I'll call or e-mail SENATOR KRISTA DONNELLY: looking to have campus safety and awareness on Wednesday evening. SENATOR MULLINAX: I'm glad to see we have a full attendance. Clear your calendars for Senate elections. SENATOR CORPUZ: I wasn't able to get all youir schedules. I think fridays might be a good day because nobody does class. We'll be going over the allocation of budgets. I B. Elections: Sabrina Sumner VICE PRESIDENT GOATZ: DIRECTOR SUMNER hasn't given us a formal resignation but has given us a verbal resignation. We'll be filtering everything through me. SENATOR MAYER: why'd she resign? VICE PRESIDENT GOATZ: personal reasons. A lot of it was that it wasn't priority for her. She wasn't into it anymore. She doesn't like how the gov't's set up. She's used to being in a social sorority. SENATOR MAYER: is that going to .. .the money we approved for elections software and stuff? VICE PRESIDENT GOATZ: no. ASSISTANT DIRECTOR BROWN, PRESIDENT SCHUCK and I are working on setting that up. Look on your next agenda for a new director. SENATOR JIMENEZ: are you going to call the people who applied before? VICE PRESIDENT GOATZ: we've ben putting out feelers for it. There were only two people who applied for it in the past. SENATOR CONWAY: is there an elections board? VICE PRESIDENT GOATZ: SENATOR CRAWFORD and SENATOR CORPUZ both applied to be on it and there was only one person on it SENATOR ESPINOZA: at this point are you trying to get a new diretcor before elections or is it wiser for you guys to handle it. VICE PRESIDENT GOATZ: if we can't find a good person to fill it then we're not going to fill it. Everything's in place and since it's on-line, nothing will happen like last year. SENATOR ESPINOZA: I wouldn't feel comfortable with having someone come in the middle of this whirlwind. I'd be more comfortable with you guys running it. PRESIDENT SCHUCK: the only thing is not having a director is a control issue. 3 SENATE PRESIDENT AMES QUIT A, VICE PRESIDENT GOATZ, me and VICE PRESIDENT PRO-TEMPORE ANDERSON all have access and I'd rather have one person have it. SENATOR ESPINOZA: could you designate someone among yourselves? SENATOR MAPES: is it possible to bring someone in as ...? so he/she would be there as like an intern. VICE PRESIDENT GOATZ: it's a great idea. It might be our best choice. What I was afraid of is that the ry gets a hold of them. SENATOR DEARMAS: what happened to the assistant? VICE PRESIDENT GOATZ: his problem is his work schedule. He's only available in the evenings. SENATOR DEARMAS: he's not working elections? VICE PRESIDENT GOATZ: he'll take off for the two days of elections. SENATOR MAYER: have you made effort to contact other people who have applied? Chris Ho was on the board for 3 years. VICE PRESIDENT GOATZ: I've tried and he hasn't contacted us. If you know anyone who would be interested let me know. SENATOR SORVONGSAVANH: I just want to clarify. You plan to appoint someone next monday? VICE PRESIDENT GOATZ: candidates will be notified by email and phone. We're not for sure appointing someone next week but it will be on the agenda. SENATOR FRIEDLIEB: VICE PRESIDENT GOATZ, how long did you guys know.. .has she expressed her.. .for the position? VICE PRESIDENT GOATZ: friday was the first time. PRESIDENT SCHUCK: it's a crappy situation but you don't have a lot to worry about as far as the operations of the elections. SENATOR MULLINAX: according to bylaws it says the assistant director takes on the duties of the director... 4 iii. Entertainment and Programming: Aaron Arneson see attachment iv. Nevada Student Affairs: Sherrelle Blood see attachment v. Office of Student Information: Michelle Bourdet DIRECTOR BOURDET: still working with Manuel to set up powerpoint for plasmas. Listserve, contacted to Jesse Taylor and he hasn't got back to me. Vagus Nerve websit got a webaccount. OSI page is being redesigned. We're meeting every Wednesday. Board members I'll be setting up interviews this week. Went to Fry's for new camera but there's a hold on our account. Filled up vagus nerve racks. All departments should know about the magazine. SENATOR ESPINOZA: the flatscreens we're getting will go under your job? DIRECTOR BOURDET: Manuel and I. SENATOR JIMENEZ: you did all that in one wek? SENATOR MAPES: what kind of format is the plasma being set up? DIRECTOR BOURDET: wide, any size. vi. Publications: Michele Muscato VICE PRESIDENT GOATZ: stuffed al mailboxes for fine and liberal arts. Letter asking if board could get submissions. No deadline for it so we'll make labels for it. Projection timeline is October 29th for submissions. Best production time schedule we've had for Vagus Nerve. vii. Rebel Radio: Tyler Wistisen everything's good. Waiting for Jason to get back to us. Contacted Mark Wellington for interviews with players. Working on media passes for press box during football games. Going to music hall to talk to ... viii. Marketing: Manuel Cabral see attachment. E. Liaison Reports i. Greek Advisory THOMAS STUDDERT: thank you for assisiting for sorority recruitment. Deadline .. .no paper forms for recruitment. All on-line. Thursday. Fine for those who sign up late for recruitment. Those of you interested in extreme leadership opportunity sign up this Friday. It's only five bucks. Krista said she'd report 011 family weekend. It's coming up and we encourage people to sign up for that. We're trying to make it a stronger tradition and we need 5 students to invite their families. Rebel Variety show will be held in ( Ham Hall for the first time this year. SENATOR SUMNER: if guys don't sign up by the deadline do they get charged an extra 5? THOMAS STUDDERT: yes. SENATOR DEARMAS: Rebel Variety Show is being moved to Ham Hall? THOMAS STUDDERT: people can still sign up. We definitely need to increase number of attendants. Mandatory Homecoming meeting tomorrow at 4. Have to have at least 2 representatives. ii. Multicultural Student Affairs iii. Residence Hall Association see attachment SENATOR MACK: are there more positions open in the residence halls? MS. FERRELL: I think they've all been filled but you can ask Dennis Hicks. iv. Student Athletics ( SENATOR MAPES: first football game this last week. Obvious problems with students getting in the game. Thank you for the terrific article in Rebel Yell. Part of the problem was Sam Boyd was understaffed and their scanners went down. There wil be improvements for this Saturday's games. John Robinson bobbleheads for first 2000 people. You'll get a voucher ticket to redeem on your way out. Tailgate went rather well. This week sould be good. Rally coming up for Reno game. 895-0310 for any questions. v. Student Health Advisory Committee ROCKY CLARK: 10-2 will offer students variety of services. Thursdays 1-430 free hiv testing. Free flu shots in October for all students. Free dermatology clinic.. .tues and thrusday... PRESIDENT SCHUCK: what's the dermatology clinic? MR. CLARK: they have a practitioner who can prescribe some... 6- 8pm SENATOR DEARMAS: could you explain more about hiv testing? is it blood, or ?? MR. CLARK: all anonymous. 6 SENATOR JIMENEZ: is there any other possibility for other testing? MR. CLARK: a few were mentioned. vi. ROTC JUSTIN: last week we had a couple cadets volunteer for... vii. Leadership Advisory Board SENATE PRESIDENT PRO-TEMPORE CIANCI: no report. F. Rebel Yell Report BUSINESS MANAGER HILL: no student fees. Meeting this friday at 8:00 at the fireside lounge. VI. EXECUTIVE BOARD ANNOUNCEMENTS VICE PRESIDENT GOATZ: my evaluations for the past two weeks will be delayed due to dir sumner's resignations, apologize for that. PRESIDENT SCHUCK: tyler's listeners increasing since beginning of month. I want to bring to your attention the receptionists. We were paying 66k for receptionists. We decided to cut that budget by going work study only. We started posting in May and extended deadline until last three weeks of school year. I met with Dr. Fain about the shuttle for final approval. We're asking for 10k through gpsa, staff, and faculty. Total of 30k. Dr. Fain said her office would cover all 30k if the others wouldn't. SENATOR FRIEDLIEB: PRESIDENT SCHUCK, please don't tell us when to leave or not to leave. SENATOR ESPINOZA: you say there's 40k? Where'd it go? PRESIDENT SCHUCK: allocated back to budget. SENATOR MAPES: you have to be commissioned to be thirty hours actually working to get a staff parking permit. If you have written permission from your supervisor there's a possibility. THOMAS STUDDERT: there is a staff parking shortage, grad assistants don't get spots anymore. Best thing to do is to extend hours to 30. SENATE PRESIDENT PRO-TEMPORE CIANCI: passed out new constitiution and statutes. SENATE PRESIDENT AMESQUITA: SENATOR MAPES, get a hold of Jamille. You won't get paid until you fill something out. VII. PUBLIC COMMENT SHAY POSSER: came to tell you about Samuri game. I have information packets about it. It will run Sunday 10am-6pm. It normally costs 5-7 hundred. For students $5.00. We welcome all of you to come. Capped off at 60. I'll leave the fliers here. 7 c VIII. UNFINISHED BUSINESS A. Action Item: Approval of a six (6) credit fee waiver to be paid to Assistant E&P Director Holmquist. Costs to be encumbered from the CSUN 2702 FY05 Entertainment and Programming budget. B. Action Item: Approval of SENATOR DEARMAS, SENATOR TEMPLETON, SENATOR BOWERS, and SENATOR SORVONGSAVANH to serve on the Campus Safety and Awareness committee for the remainder of the 34t h session. As submitted by Senator Espinoza on behalf of the Executive Board. IX. NEW BUSINESS 8 A. Action Item: Approval of establishing the CSUN Investment Earnings Account with a transfer of $500,000 from the CSUN Reserves account. Funds to be encumbered from the CSUN Reserves account. As submitted by Senate President Pro-tempore Cianci on behalf of the Executive Board. SENATE PRESIDENT PRO-TEMPORE CIANCI: move to approve SENATOR JIMENEZ 2nds SENATOR FRIEDLIEB: Dave, can you elaborate on what happens with this. I was hopeing there'd be... BUSINESS MANAGER HILL: we set up a new account in addition to general fund account there will be an investment account. It will earn a 3.75 interest rate. They do a transfer monthly. SENATE PRESIDENT PRO-TEMPORE CIANCI: can we still call this the reserves account? BUSINESS MANAGER HILL: it's still reserves. SENATOR MULLINAX: it's just another big account. SENATOR ESPINOZA: it's in no way... we'll be able to use it whenever we want to without being penalized right? SENATOR MAYER: is it a money market? Who is it with? BUSINESS MANAGER HILL: I would guess wells fargo. It's just an interest bearing account. 21-0-0 passes unanimously B. During the summer months and Spring Break no posting will be done in the Classroom Building Complex because the building is locked; the SORCE room located in MSU room 130 will serve as the alternative posting site of the Classroom Building Complex. 2 SPONSORSHIP AGREEMENT THIS SPONSORSHIP AGREEMENT ("this Agreement") is made this 13t h day of September, 2004, by and between Redbull, and the BOARD OF REGENTS OF THE UNIVERSITY AND COMMUNITY COLLEGE SYSTEM OF NEVADA ACTING ON BEHALF OF THE UNIVERSITY OF NEVADA, LAS VEGAS ("CSUN"). This Agreement in no way obligates or binds any division of the University other than CSUN-Student Government ("CSUN"). WHEREAS, CSUN has the right to sell sponsorships for CSUN fall events WHEREAS, Redbull desires to display its Sponsorship which is referred to as Redbull from hereof and Copy/Product as CSUN fall events listed in the scope of services, and WHEREAS, the parties desire to enter into this Agreement defining their respective rights, duties, and liabilities relating to the purchase and sale of certain sponsorship rights with CSUN fall events listed in scope of services, NOW, THEN, the parties agree as follows: 1) Rights Granted: A) CSUN grants to Redbull, subject to the terms and conditions hereof, the right to have its Sponsorship Copy displayed at CSUN fall events in space described on the attached Exhibit "A". CLIENT Sponsorship Agreement Page 2 of 9 B) For the purposes of this Agreement, "Sponsorship Copy" shall mean any words, slogans, logos, designs or comparable creative effort with respect to the sponsorship of CSUN fall events. 2) Sponsorship Copy Approval: The design, layout and content of the Sponsorship Copy shall be subject to UNLV's approval, which approval shall not be unreasonably withheld. Redbull shall submit the Sponsorship Copy to UNLV for its review no later than seven (7) days prior to the event at which it is first to be displayed; the Sponsorship Copy shall be deemed approved if Redbull has not received UNLV's reasonable objections thereto within Ten (10) days following its receipt thereof. 3) Maintenance: Maintenance of the Redbull shall be in good and attractive order, repair, and condition shall be the responsibility of Redbull and at its expense. 4) Term and Termination A) This Agreement shall be from the date of appropriate approval and shall expire on December 3r d , 2004. CLIENT Sponsorship Agreement Page 3 of 9 B) In addition to any right of termination granted elsewhere in this Agreement, either party shall have the right at any time to cancel this Agreement, without prejudice to any legal rights to which either party may be entitled, upon the occurrence of a material default by the other party in performance of any of the provisions of this Agreement providing said default is not cured within Fifteen (15) days following written notice of such default to the defaulting party. 5) Sponsorship Fee: A) Redbull shall pay/provide to CSUN the following product for the duration of the contract period: • $1,500.00 Check made payable to : BOARD OF REGENTS. TOTAL $1,500.00 6) Indemnification A) To the extent of the University's/CSUN's liability as provided by law and in the manner authorized by law, the University agrees to indemnify and hold Redbull harmless from any loss, damage, liability, cost or expense to the person or property of another which was caused by the negligence of the University, its officers, employees and agents under this Agreement. B) Redbull represents, warrants, and revenants to UNLV/CSUN that it has the full right and authority to enter into and fully perform this Agreement in accordance with its terms. CLIENT Sponsorship Agreement Page 5 of 9 9) Additional Considerations: UNLV/CSUN shall supply Redbull with any and all additional items set forth on the attached Exhibit "A." 10) Headings: The paragraph headings in this Agreement are for convenience and reference only and shall not be construed or held in any way to explain, modify, or add to the interpretation or meaning of this Agreement. 11) Severability: If any provision of this Agreement is in conflict with any Federal or State Statute of rule of law, then such provision shall be deemed null and void to the extent that it is in conflict therewith, but without invalidating the remaining provisions hereof 12) Entire Agreement: Governing Law: Amendment: This Agreement constitutes the entire understanding and agreement between the parties with respect other subject matter hereof and supersedes any and all prior negotiations, understandings or agreements in regard thereto. The governing law shall be that of the State of Nevada, and all parties accept jurisdiction of the State of Nevada for dispute. This Agreement may be maneden only by written instrument signed by the parties hereto. CLIENT Sponsorship Agreement Page 7 of 9 13) Partnership: Anything in here to the contrary notwithstanding, this Agreement shall not be construed as creating a partnership, joint venture, or other business relationship between the parties or their respective legal representatives, successors, employees, agents, or assigns. 14) Use of Names and Marks: Except as otherwise set forth herein, Redbull and UNLV/CSUN hereby acknowledge and agree that this Agreement does not operate to assign, transfer or convey to each other any license, privilege or right of any kind or nature whatsoever to use for any reason, any trademarks, tradenames, network names, propriety logo types or network marks, owned by Redbull and/or UNLV as the case may be. 15) Assignment Redbull shall not assign, transfer, or delegate any rights, obligations, or duties under the Agreement without the prior written approval of UNLV.
