John H. Far ley ATTORNEY AT LAW 620 ROANOKE BUILDING MINNEAPOLIS 2,MINNESOTA December 12, 1958 Mr. A1 Freeman c/o Sands Hotel Las Vegas, Nevada Dear Al: I am in receipt of advice this morning from attorneys whom we employed in connection with registration of the trademark "Angelita" to the effect that the Examiner?╟╓s searches failed to show that the mark when applied to applicant?╟╓s goods, is confusingly similar to any registered mark. The Examiner did, however, make the following com- ments ?╟ÑIf the word ANGELITA has a particular meaning in a foreign language, it is requested that its English equivalent be set forth in the papers. "A search of the Office records fails to show that the mark, when applied to applicant?╟╓s goods, is confusingly similar to any registered mark.?╟Ñ Response has been made by our attorneys as follows: "In response to the Examiner?╟╓s inquiry, to the best of applicant?╟╓s knowledge, the word "ANGELITA?╟Ñ is not a foreign word and has no particular meaning in any foreign language. "It is noted that a search of Office records fails to indicate that the mark of this application when used in connection with the goods is confusingly similar to any registered mark. "Applicant looks forward to an early notice of publication." In the attorneys' letter, they advise that in normal course we should now receive notice within a few weeks that our isrk is to be pub- lished for opposition. It is apparent that there will be considerable delay yet before final issuance of the mark. Appa/guily the original hurdles have been gotten over.
