Greenspun . being first duly sworn, deposes and says: That he is Publisher of the LAS VEGAS MORNING SUN, a daily newspaper, of general circulation, printed and published at Las Vegas, in the County of Clark, State of Nevada, and that the attached was continuously published in said newspaper for a period of two weeks from February 11. 1952 to February 18. 1952 inclusive, being the issues of said newspaper for the following dates, to-wit: February 11, 18. That said newspaper was regularly issued and circulated on each of the dates above named. s/ H.M. Greenspun Subscribed and sworn to before me this 19th day of February, 1952. s/ Lillian D. ORDINANCE NO. 481 AN ORDINANCE PROHIBITING ANY PERSON, FIRM, ASSOCIATION OR CORPORATION OWNING, MANAGING, OR BEING IN CON­TROL OF ANY AUDITORIUM,THEATRE, OR MOTION PICTURE THEATRE, FROM ALLOWING SMOKING WITHIN SUCH BUILDING; PRO­HIBITING ANY PERSON FROM SMOKING WITHIN SAID BUILDING; PROVIDING A PENALTY FOR THE VIOLATION THEREOF AND OTHER MATTERS RELATING THERETO. The Board of Commissioners of the City of Las Vegas does ordain as follows: Section 1. It shall, be unlawful for any person, firm, association, or corporation, managing, controlling, or presenting shows of any kind in any theatre building, motion picture theatre, including projection rooms, within the City, to allow, or permit, any person to smoke within the confines of said building; except in rest rooms or in a lounge provided by the theatre, completely enclosed and separated from the main seating room. Section 2. It shall be unlawful for any person to smoke within any auditorium, theatre building, or motion picture theatre, including projection rooms, within the City, except in rest rooms or in a lounge provided, by the theatre, completely enclosed and separated from the main seating room. This section shall not be deemed to make it unlawful for a performer to smoke upon the stage during and as a part of any theatrical production. Section 3. There shall be displayed in a conspicuous place in every theatre or motion picture theatre in which smoking is forbidden or prohibited by the terms of this ordinance, a notice to the effect that smoking is prohibited therein, with reference to this ordinance as carrying such prohibition. Section 4. Any person violating the provisions of this ordinance shall be guilty of a misdemean­or and shall be punished by a fine of not less than Ten Dollars ($10.00) nor more than Five Hundred Dollars ($500.00) and in addition thereto may be imprisoned in the City Jail for a period of not to exceed six (6) months. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. This ordinance shall be in full force and effect upon its final reading and adoption, and final publication as in the next section provided. Section 7. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this ordinance to be published once a week for two successive weeks immediately following its first reading and adoption, in the Las Vegas Morning Sun, a daily newspaper published in the City of Las Vegas. Baker_______________________________ Mayor ATTEST: _______s/ Shirley Ballinger_______________ City Clerk The above and foregoing ordinance was first proposed and read by title to the Board of Commis­sioners on the 6th day of February 1952, and referred to the following committee composed of Commissioners Jarrett and Whipple for recommendation; thereafter the said committee reported favorably on said ordinance on the 5th day of March. 1952, which was the regular meeting of said Board of City Commissioners, that at said regular meeting held on the 5th day of March. 1952, the proposed ordinance was read in full to the Board of City Commissioners as amended and adopted by the following vote: Those voting "Aye": Commissioners Bunker.
