That view was based on a research of the law which we wade out here some tins ago far Mr* Spencer in connection with cox# threatened litigation in Wyoming, and I am enclosing for your information copy of tha latter X wrote Mr* Spencer on December 28, 1939, together with the list of oases referred to therein* since it is quite voluminous and it is very possible that you can find my letter to Mr* Spencer in your files with the resume attached, as your office would undoubtedly be familiar with the situation whleh existed* as X recall* at Cheyenne* viewed in that memorandum th-nt tha Public Service Con-ad salon would at least have the authority to investigate that contract and dstermine vhethsr tha basis for the charges made by the Railroad against the later Company were reasonable, ainee it is upon those charges that our water rates are fixed* X have never had any occasion to believe that Mr* Sexton of the Public Service Commission is familiar with this line of salts* but there is no doubt that If he turned it over to the Attorney General, the latter could find the eases* My principal worry In this matter was that ir- X am not attaching a resume of those eases It would seem under the cases which wars re- X* B* Bennett £XBsbrh end* *** Copy of enclosures and copy of Mr. Bookes* letter herewith.
