WHEREAS, The virus has affected the lives of our fellow students, faculty, and staff in the university community. WHEREAS, The virus has caused the death of 8 members of our university community, and it has been estimated there are currently 40 cases of the HIV infection on campus. NOW, THEREFORE, Be it resolved that CSUN will administer to its copies of the University Systems Code Book a copy of this University's AIDS policy, so that our student leaders are aware of the procedures for handling cases, and confidentiality of students, faculty, and staff with the HIV virus or AIDS. ADOPTED by a vote of i in favor, opposed, and abstaining on this ninth day of December, 1992. CALL TO ORDER SENATE PRESIDENT BENNEMAN called the meeting to order at 5:05 p.m. II. ANNOUNCEMENTS PRESIDENT KOSTMAN states that Gary Milliken resigned and we are in the process of trying to find someone of the same caliber but it doesn't look good. Senator Cromer arrives. VICE PRESIDENT HELD states that there will be a Holiday party and she has already received 18 RSVP1s. The party is being paid for by the Executive Board to say Thank You to everyone for all the hard work. SENATE PRESIDENT PRO-TEMPORE ROMERO states that the handbooks are not finished but hopefully by Monday. Just to let everyone know I will be taking the Organizations Board Operating Policy off the table tonight so it can be retyped for the handbooks. SENATE PRESIDENT BENNEMAN apologizes for the delay in getting the handbooks done. Willie and I went to the Parking & Traffic Committee meeting and found out where we will be losing and gaining parking. We will be working on several projects over break and we will need volunteers. Thanks for all the gifts that were donated. As for the Judicial Council nominations they are out of order. I have been trying to contact all the SENATE MINUTES NO. 23-05 page thirteen IV. ANNOUNCEMENTS CONT. people who turned in applications but they have not returned any of my calls. About the Rules case there has been a lot of discussion geared toward me. If you have a problem come and talk to me one on one. I did say what was in the paper but it was not the entire quote. I thought we handled the case in the personnel session. They were brought up again and embarrassed. The situation is not as bad as it has been represented. I apologize if I have been hard to approach but I will be in the office more. You are more than welcome to come in an talk to me but wait to talk to me when you are calm not while you are hostile. I feel that rehashing the issue was ridiculous. What about Double Jeopardy? I am asking everyone to be civil and don't resign because of me. V. BOARD & COMMITTEE REPORTS ENTERTAINMENT & PROGRAMMING DIRECTOR ZENTNER announces a film screening tomorrow at 8 p.m. The memo that I gave to everyone was just to let you know what we accomplished at NACA. Senator Pobst asks if she has booked any of these acts? Have you made any final decisions? APPROPRIATIONS DIRECTOR FINMARK states that she is still ironing things out with the Controllers office. If anyone knows anyone from the Native American Student Association or Sigma Phi Epsilon their checks are in the office. OFFICE OF STUDENT INFORMATION DIRECTOR BUNIN passes out a copy of the next OSI page with the exception of the add for the Elections Board Director. Senator H. Fischer states that this is a good page. Senator Jackson states that this is an awesome page but why did it take a whole semester to get it right? Senator Smith states that he could fill in the empty spot with an add for the special library hours. President Kostman asks Director Bunin to tell everyone that he will be revamping the Student Government brochure over the break. We will also be getting involved in the orientation to sell ourselves to the incoming students. Senator Yohe asks who is in charge of advertising for the library? Senator Romero asks what the status of the speech workshop? Senator Wilson asks if they knew that there was a misspelled word? Point of Information from President Kostman that he didn't do it. Senator Pobst asks if they are going to announce the Annex? Point of Information from President Kostman that they were going to wait to announce until school starts next semester. BOARD & COMMITTEE REPORTS CONT. busy the last two weeks. Over break she will be working on the Discount cards, chairs for the annex, Career day packets, and the Book Exchange. We have found an attorney Haynes & McBride. Thanks to Lisa for helping with the fliers for Career day. KUNV no representative. CSUN BUSINESS MANAGER not here. NEVADA STUDENT AFFAIRS DIRECTOR KENNEDY states that he has no library and no lobbyist but we will work something out. Senator S. Fisher asks what is going on with the library? RULES COMMITTEE CHAIR H. FISCHER needs to meet with Shannon after the meeting. We will be replacing about 50% of the Rules. The case of Senators Jackson and Nalder was a hard ruling because Senate Rule D is so vague. We will be making Rules Bylaws Amendments but I don't know when our next meeting will be. I talked to as many Senators as I could about the hearing and they were very productive talks. I listened intently to everything that they had to say. To Bud-I apologize for jumping the gun and didn't go to the source first. I appreciate that Bud sat and talked to me today. Senator Stephenson thanks Senator H. Fischer for taking the time to talk to all the Senators to see what they thought. Senator Yohe states that Rule D is to vague and that makes it unenforceable and Double Jeopardy also came into play during the meeting. Senator H. Fischer also thanks Senator Stephenson for all the good advice. BYLAWS CHAIR ROMERO there are 5 people to approve tonight so we can have our first meeting to discuss Bylaw 23-01 concerning the Residential Halls. Anyone interested in writing Bylaws let me know. Point of Information from Senate President Benneman that Brian will not be here. He still wants the position. He also wanted to state that the only person that he talked to was Senator Stephenson. NEW BUSINESS A. Approval for the Executive Board to make expenditures not to exceed $10,000.00 during the Winter Break specifically for the CSUN Annex or any problems with KUNV. Motion to approve by Senator Turner, seconded by Senator H. Fischer. Senator Turner yeilds the floor to President Kostman. President Kostman states that you need to keep in mind two things two years ago the transmitter for KUNV blew and needed to be replaced and at the first Executive Board meeting and Senate meeting everyone will be informed exactly what was spent. Senator Rosenthal asks how much the Annex is going to cost? Senator Yohe asks if this motion means that the Executive Board can only spend on these two things? Senator S. Fisher asks if this is considered an approval of the annex? President Kostman states that this is to purchase a phone and furniture for the Annex and things that we need to buy for it. Senator S. Fisher state that this is forcing the Senate to approve the Annex this doesn't give us a choice. President Kostman states that he resents the way Senator S. Fisher said that. Senator Wilson returns. Senator Yohe states that the annex is a good idea. What exactly SENATE MINUTES NO. 23-05 page thirteen VIII. NEW BUSINESS CONT. are you spending the money on? Senator Pobst asks what account the money is coming from? Can you approve E&P events? Senator H. Fischer proposes and amendment to the original motion to read "..KUNV or any other emergencies." Seconded by Senator Stephenson. Senator Yohe states that the motion is entirely to vague. Point of Information from President Kostman that you can't define an emergency before it happens. Have faith in your Executive Board. Senator S. Fisher states that it has to be left vague. Senator Turner asks for a three minute recess. Meeting called back to order. Move into a vote on the amendment. Motion passes 15-1-0. Senator Yohe opposed. Move back into discussion of the entire motion. Senator Yohe states that he is in favor of the Annex and the emergencies. When the annex was proposed did we allocate a specific amount of money? I don't feel that I can cast a responsible vote the way that the motion is written. Senator Romero states that he is in favor of the motion. We will get a break down of all the expenditures. I trust that they will buy exactly what they said they would. Senator Nalder states that she is in favor of the motion and she does trust the Executive Board to handle $10,000 dollars. Senator Turner asks if they will share the expenditures with the rest of us? Vote to let Senator Yohe speak for a third time. Motion passes 11-2-3. Senators Romero and Sabatini opposed. Senators H. Fischer, Turner, and Yohe abstaining. Senator Yohe states that he will speak his own opinion and in no way is it slanderous against the Executive Board. Move into a vote. Motion passes 14-2-1. Fischer, seconded by Senator Romero. Senator H. Fischer asks if there is anything to be revised? Senator Pobst asks if there will be an automatic seat as a college is opened? Move into a vote. Senator Pobst asks when the Convention is and is it the same as the last one? Point of Information from Vice President Held that the Convention is February 12-17 in Nashville. Move into a vote. Motion passes 13-0-3. Senators S. Fisher, Pobst, and Turner abstaining. D. Approval of a $50.00 stipend increase for Appropriations Director Finmark, from $200.00 to $250.00 per month, out of the 2702 (general) account. Motion to approve by Senator Romero, seconded by Senator Stephenson. Point of Information from Senate President Benneman that this should be retroactive November 1, 1992. Senator Turner motions to amend the original motion to read "..retroactive November 1, 1992." Seconded by Senator Smith. Senator Yohe states that he is against the amendment that the increase should be from the authorization date. Senator Romero asks if this was approved by the Executive Board in November then why are we getting it now? Senator S. Fisher asks Director Finmark if she knew about the raise? Why didn't she say something earlier? Move into a vote on the proposed amendment. Motion fails 1-11-4. Senator Smith in favor. Senators Cromer, H. Fischer, Romero, and Turner abstaining. Move back into the original motion. Senator Smith asks when the position is reopened the stipend will be $200.00? Senator Romero states that he is in favor of the motion. Director Finmark is doing a great job. People like her and she is always in the office. Senator Stephenson states that he is in favor of the motion. She has a go get them attitude. She always does a great job. She breaks her back for all the organizations. Senator Yohe states that he is voting against the motion but that does not mean that he is saying anything against Director Finmark. Senator Wilson yeilds the floor to director Finmark and asks SENATE MINUTES NO. 23-05 page t h i r t e e n VIII. NEW BUSINESS CONT. how long she has been a Director? Move into a vote. Motion passes 16-2-0. Senators Pobst and Yohe opposed. Point of Personal Privilege by Senator Nalder. Supplemental agenda item E. E. Introduction/approval of Senate Resolution 23-01 regarding the CSUN AIDS Policy. Motion to approve by Senator Rosenthal, seconded by Senator Siciliano. Move into a three minute recess. Meeting called back to order. Senator Rosenthal states that we should approve because it means easier access for students. Senator Yohe states that this policy is screwed from the start. People have the right to know if a person has AIDS. There is no reason there should be confidentiality for one specific disease. There is no reason to have a specific exemption for this disease which is primarily caught by homosexuals. This is ridiculous. Senator Turner says thank you to Senator Yohe. Senator S. Fisher states that he disagrees with the statement about homosexuals. We don't need an AIDS policy and if we did it should read don't get it because if you do you are going to die. Because of the gravity of the disease I would want to know if someone I was associating with was HIV positive or has the AIDS virus. That then puts my life at risk. There are two things that I disagree with about this policy and they are if we approve this policy then it goes in our handbooks I don't think it belongs in our handbooks, we don't need a policy and I don't agree with the way it is written. Point of Information from Senator Turner that the policy is already in place and will be enforced. President Kostman states he is not going to say yes or no about the resolution but will state that there are a lot of misconceptions and ignorance where AIDS is concerned. Senator H. Fischer states that things in the code book are statutes will this be in the same format as those? Senate President Benneman states that the book has National, State, and University statutes. Point of Information from Senator Turner that this is already a university policy and will be followed anyway. Senator Yohe states that by putting this in the book we are saying its ok and I'm saying that it isn't ok. There is no difference between AIDS and any other disease except that these people want to politicize sensitivity and that is my only problem with this. This is the most unsound policy and I don't want it in any book that I own. SENATE MINUTES NO. 23-05 page thirteen VIII. NEW BUSINESS CONT. Senator Rosenthal states that this is already University policy whether you agree or not. By approving this it is just making an easier reference. Senator Pobst states that she agrees with Senator Yohe in the aspect that there is no need for a special policy and Senator S. Fisher with the fact that we need a greater sensitivity where HIV and AIDS are concerned. Senator H. Fischer states that AIDS is not just any other disease there is a stigmatism attached which is different than cancer. If you don't like this then too bad. Senator Stephenson states that he seconds that. Vote to let Senator Yohe speak for a third time. Motion fails 5-11-0. Senator Wilson states that anyone diagnosed can give written permission to release the fact that the have AIDS to the public. If this person is a friend of yours then you would think that they would tell you that they have the disease. Senator Nalder returns. Senator Turner states that this policy was researched for two years before it was adopted by the University. I personally feel that as a student body we need to stand together. As the Senate we have the power to hire and fire at our discretion and this policy protects people with HIV and AIDS. This disease does have a stigmatism attached and someday it could effect you. You have to think about the possibility that this could be you someday. Senator Pobst asks if she can yeild the floor to Senator Yohe? President Kostman yeilds the floor to NSA Director Kennedy. Director Kennedy states that he wants his name stricken as the drafter of the resolution. Motion by Senator Pobst, seconded by Senator Nalder. Motion passes 16-0-2. Senators Nalder and Turner abstaining. Move into a vote on the original motion with the amendments. Motion passes 14-2-1. Senator Romero moves to take the Organizations Board Operating Policy off the table, seconded by Senator Nalder. Motion to take the item off the table passes 15-2-0. Senators S. Fisher and Jackson opposed. Senator Romero states that the Organizations Board agreed with our changes concerning the Vice Chair appointment. Move into a vote. Motion passes 16-0-1. Senator Pobst abstaining. IX. OPEN DISCUSSION SENATOR TURNER says thank you to President Kostman, Senator SENATE MINUTES NO. 23-05 page thirteen IX. OPEN DISCUSSION CONT. Pobst, and Senator H. Fischer for their comments. SENATOR SMITH states about the ad-hoc committee that he needs two members from Bylaws so if you are interested then let him know. Thanks to Joel for bringing in Senator Bryan. For Senator Yohe that I read an article about a ten year old girl who has AIDS and they don't know why. SENATOR STEPHENSON states that this is the last meeting and I want to wish everyone a Merry Christmas. He won't touch the AIDS thing. He is glad that we got a few things out of the way tonight. SENATOR SABATINI states that Senator Bryan was out of order. There were alot of three minute recesses tonight. I want everyone to think about why. Everyone needs to learn to differentiate between pertinate business and topics for open discussion and watch the language. SENATOR H. FISCHER states that he called alot of people last night and I want to say thank you especially to Senator Stephenson. Merry Christmas and any other holiday too. Good luck on finals. SENATOR YOHE states that the AIDS policy is ridiculous. If you politicize sensitivity then sensitivity becomes charity. This is censorship and a violation of free speech. People who follow this policy are responsible for all other people, some of whom know that they have the virus. To politicize this motion is a horrible injustice against the souls and humanity of all people. To create policy is lobbying and this insensitivity cheapens the beauty of sensitivity. I also wish that Senator Bryan had been able to answer some questions. I would also like to see the story of the young girl with AIDS, I am always interested in learning more about it. I am also about to do something that I am personally seeking but ethically unavoidable. The recent incidents involving Senator Jackson and Senator Nalder at the UNLV/UNR football game has to be addressed before an open Senate meeting now that the confidentiality of the closed door session is no longer keeping me from expressing my opinion. My justifications to the existence of student government and my justifications for serving as a student senator would be voided if I do not speak out. I no longer consider the student government a farce for one very important reason, students see the effect of student government to represent the student side of issues before the University Administration, the Regents and the Legislature. I am confident that the actions of Senator Jackson and Senator Nalder in their continued presence on the Senate has harmed our ability to accomplish these goals. Not only have their actions harmed our credibility to the administration and regents and they have taken away the support of students for student government. These two factors have, in my views, severely wounded our capability to fight for students. I talked to approximately 60-70 students in my classes and asked if the actions of Senator Nalder and Senator Jackson SENATE MINUTES NO. 23-05 page thirteen IX. OPEN DISCUSSION CONT. should be condoned on the Senate. I could not find one student who could justify their actions or their continued presence on the Senate. I do not believe that any further action should be taken by the Senate or the Rules Committee for two reasons: First, any further action would constitute a violation of the Constitutional right against Double Jeopardy; Second , the vagueness of Rule D of the Senate Rules makes it unjust and unenforceable. Therefore, I feel that it is Senator Jackson and Senator Nalder's duty to do everything in their power to correct the harm that they have done to the students of this University with their actions. SENATOR S. FISHER states that he did not say that he was against the Annex, he is in favor of the Annex. I just wanted to clarify in case anyone thought that I was against the Annex. The issue of trusting the Executive Board came up and I do trust them. I have said in the past that I trust them. Just because I trust them doesn't mean that I always agree with them. The big problem that I had with it was that we make most of our Directors give a breakdown if they want to spend a large enough sum of money. If you trust the Executive Board explicitly then you might as well give spending power over the entire $650,000 and we can all go home. About the AIDS policy, just because UNLV adopts the policy doesn't mean that I have to agree with it. What happened to Lynn Wilson? This is the last meeting so everyone have a Happy Hanukkah and Merry Christmas. The last thing is that I picked up my graduation application today and it is really a good feeling so stay in school it is worth it. I hope everyone has a great vacation. I just got a copy of the letter that Senator Yohe read about five minutes ago and I won't be resigning. I talked to people whose opinions I respect and I also talked to all the people in my classes and several football players and several people in the administration who felt that the whole incident was blown way out of proportion. I'm sure that the people that you talked to had the opinions that you stated. The people that I talked to didn't feel that a resignation was necessary and I won't give it. SENATOR JACKSON states that regarding his comments toward Director Bunin that he personally knows that he has missed three OSI pages and when I looked at the copy of the page for tomorrow I was stunned. That is why I said what I had to say I didn't mean to say something against him but for a paper to come out of this quality now then why didn't we see it earlier. In the article in the Rebel Yell I was misquoted I am not from Michigan. Everything that I said was misquoted or taken out of context. Believe me when I say that if I could take back my actions on Homecoming night I would. I am truly sorry for it but I don't feel that I have harmed Student Government. I think that the true harm that has come out of this whole situation is the backstabbing and the side stepping and the people who are trying to break apart our team. To Senator Jackson, you are entitled to your criticism of the Directors but one thing that you have to remember is that this is a learning lab. I think you could have taken a more positive approach. I agree with you that this has been his best page and he is doing a good job and he is trying and I don't see many people giving him positive input or ideas. We need to think about this if we want to have a strong sense of teamwork. Teamwork is more than coming to these meetings and voicing your concerns and then leaving and not coming back until the next meeting. Teamwork is doing something everyday.
