EMERGENCY ORDINANCE NO. 608 AN EMERGENCY ORDINANCE TO PLACE THE RESPONSIBILITY FOR THE WASTAGE OF WATER WITHIN THE CITY OF LAS VEGAS; TO REPEAL SECTION 1 OF ORDINANCE no. 4ll ENTITLED; "AN ORDINANCE TO AMEND ORDINANCE NO. 211 OF THE CITY OF LAS VEGAS ENTITLED: "AN EMERGENCY ORDINANCE TO PROHIBIT THE WASTE OF WATER; DEFINING WASTE OF WATER; REGULATING THE USE THEREOF; LIMITING THE TIME DURING WHICH WATER MAY EE USED FOR SPRINKLING OR IRRIGATION, AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH"; ALSO REFERRED TO AS CHAPTER 37, SECTION 7 OF THE LAS VEGAS CITY CODE, AND TO repeal Ordinance no. 302 entitled; "an emergency ordinance to regulate the use of water in woodland park ADDITION TO THE CITY OF LAS VEGAS BETWEEN THE MONTHS OF MAY 15 AND SEPTEMBER 15 INCLUSIVE; AND DEFINING THE REGULATION OF WATER; REGULATING THE USE THEREOF; AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH", ALSO KNOWN AS CHAPTER 37, SECTIONS 8 AND 9 OF THE LAS VEGAS CITY CODE," PROVIDING OTHER MATTERS PROPERLY RELATED THERETO; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. WHEREAS, In order to conserve water within the City of Las Vegas, a Proclamation has "been issued designating alternate days of watering lawns, yards, and gardens; and WHEREAS, the wastage of water is made an offense against the ordinances of the City of Las Vegas; and WHEREAS, in order to place the responsibility for the wastage of water on the business or home owner it is necessary that such responsibility be set forth in ordinance form; and WHEREAS, due to the watering situation it is necessary that the hours limiting the time for watering be repealed; and WHEREAS, by reason of the fact that alternate watering is now in effect, it is hereby declared that an emergency exists and that this ordinance is necessary for the immediate preservation of the public peace, health, safety and welfare, NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF THE CITY OF LAS VEGAS DO ORDAIN AS FOLLOWS: SECTION 1. Section 1 of Ordinance No. 4ll is hereby repealed. SECTION 2. In any prosecution charging a waste of water as set forth in Chapter 37 Code of Las Vegas, Nevada, 1949, and ordinances amendatory thereof, the waste of water, together with proof that such was originated at any residence or place of business, shall constitute in evidence a prima facie presumption that the owner, or occupant for the time being of such residence or place of business, was responsible for such waste. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. This ordinance shall be in effect on and after its passage, adoption, and publication thereof in the Las Vegas Morning Sun, a daily newspaper published in the City of Las Vegas, for a period of once a week for two consecutive weeks immediately following its first reading.
