II. Motion passes 19:0:0. (SENATOR SOLOMON and CAMPBELL ^stained.) SENATORS SONG and KNUTSON arrived at 6:32 p.m.. IV. ANNOUNCEMENTS: SENATE PRESIDENT PRO-TEMPORE PEREZ reminded everyone about meeting for the Retreat this Saturday at 8:00 a.m. in the horseshoe; she asked for volunteer drivers for a car pool. She also expressed her disappointment that people canceled because it cost $10.50 per person and asked that everyone tell her if they are going or not in their final comments. V. BOARD AND COMMITTEE REPORTS: A. Director Reports: 1. Organizations Board DIRECTOR BONGHI announced a meeting for next week on April 29; he stated that he didn't have anything to report and that there is no O-Board meeting this week. In response to a question, he stated that the request for $500.00 must be in to the O-Board by this Friday. 2. NSA DIRECTOR VALERA announced an Open Forum for Dr. Harter, who will be -leaking on the bond issue, etc., on Wednesday at 11:30 a.m.. SENATOR FLEISCHMAN jommended having Dr. Ackerman at the forum to answer questions regarding the parking issue. He added that he's working on a Town Hall meeting for a congressman but there is a conflict with the scheduling. Also, he should be going up to Carson City for a discussion of the university budget. 3. OSI DIRECTOR HAMILTON stated that the stickers for the election went over very well and didn't have any problems. B. Senate Committee Reports: 1. SENATOR AGUERO announced a Bylaws meeting for next Monday. He stated that they are having problems making quorum, so they may have to change the time and date. SENATE PRESIDENT LAXAGUE asked the members on Bylaws to please resign if they consistently cannot make the meetings. 2. SENATOR PRICE announced a Ways and Means meeting this Wednesday at 6:35 p.m. and they have a busy agenda. 3. SENATOR FLEISCHMAN announced that Campus Safety has a meeting on Thursday April 17 at 3:00 p.m.. She asked anyone to contact her if this is a problem. 4. SENATOR SOLOMON announced that he is going to be resigning from the Bylaws d Adhoc Constitutional Revision Committees. 2 SENATE MINUTES 27-14/ APRIL 7, 1997 C. Faculty Senate Committee Reports: 1. SENATOR HAYES resigned from the Ad Hoc Epilogue Committee. 2. SENATOR GONZALES announced that the last Faculty Senate Scholarship Committee meeting was held last Thursday. 3. SENATOR MOORE resigned from the Faculty Senate Scholarship Committee. 4. SENATOR POOLE resigned from the Faculty Senate Admission Committee. SENATE PRESIDENT LAXAGUE announced that there will be an election for the Ad Hoc Epilogue Committee and another election for the Faculty Senate Scholarship and Admission Committees at the next meeting. D. Residence Hall Liaison Report: LEAH GRIFFITH stated that they are really excited about the elections and the upcoming Spring Fling. E. Business Manager Report: BUSINESS MANAGER JIM MOORE announced only one expenditure of $39.95 for a switch for his office computer. He announced that 8 people still need to sign their E-docs. He also explained the types of contracts that come through CSUN; he asked that the Senate review contracts, which create potential liability, from outside vendors closely and doesn't want the Senate to have to review standard university contracts (ISP's), which don't create liabilities. VI. PUBLIC COMMENT [in accordance with N.R.S. 241.020 (2)(c)(3)] Former SENATOR FISK expressed his disappointment over the cancellation of last week's candidate forum and hopes that next year a forum is held regardless of the weather. SENATE PRESIDENT LAXAGUE explained why and how the forum was canceled. CHIEF JUSTICE MOSS stated that the Judicial Council met last week and they decided that for the Fair Shake Act that Pi Sigma Alpha was not entitled to any additional funding. In response to questions, he stated that he doesn't believe a check was cut yet and the case was specific that they decided on. SENATE PRESIDENT LAXAGUE stated that he'd get copies of the Statutes of the Constitution for everyone within the next couple weeks. In response to a question, SENATE PRESIDENT - ELECT MOORE stated that the Fall meetings will be held at 7:00 p.m. on Mondays and will look into making up a Summer meeting schedule. 3 SENATE MINUTES 27-14/ APRIL 7, 1997 SENATOR FLEISCHMAN addressed the issues (banners being torn up and "Greeks bearing fits") about Greeks vs. Independents that came up during the elections and running a fair election. VII. UNFINISHED BUSINESS A. Action Item: Discussion/Approval of expending an amount not to exceed $2,580.00 for renovations and improvements for the new Annex location in the CBC building; to be encumbered out of the FY 96-97 CSUN 2702 (Gen) Account. Motion to Remove from the Table made by SENATOR MOORE, seconded by SENATOR PEREZ. Move into a vote. Motion to Remove from the Table passes 22:0:0. Motion to Approve made by SENATOR ANDERSON, seconded by SENATOR MOORE. A discussion ensued about cost, advertising, staffing problems, measuring the type and amount of traffic by hiring a staff member to pass out scantrons, blue books, and pencils and asking what the students want over there (i.e., phones, drinks, food, email access), doing a survey and whether it would be effective or not, the exact location of the annex, having the option to vote the item down, furnishing the annex, using the annex for storage space, the size of the annex, and going ahead with the annex now to secure a good investment for future needs. In response to questions, T'"ICE PRESIDENT MILLS explained the cost breakdown for adding two phones and the number of aff (shifts) that would be needed. SENATOR PERSCH arrives at 6:59 p.m.. Move into a vote. Motion passes 14:5:4. (SENATORS ANDERSON, LIDEROS, SONG, SOLOMON, and CAMPBELL opposed, SENATORS FLEISCHMAN, PERSCH, KNUTSON, and LOPEZ abstained.) B. Action Item: Nomination/Election of Jordan M. Wiessen to the CSUN Entertainment & Programming Board. Motion to Remove from the Table made by SENATOR MOORE, seconded by SENATOR ANDERSON. JORDAN WIESSEN expressed his interest and experience in Entertaining and Programming and answered questions of the Senate. Move into a vote. Motion passes 23:0:0. 4 SENATE MINUTES 27-14/ APRIL 7, 1997 "III. NEW BUSINESS A. Action Item: Discussion/Approval for KUNV's Sports Director, Rob Buska, to make a trip to Reno to broadcast the baseball game between UNLV and UNR which takes place on Tuesday, April 15, 1997. Motion to Approve made by SENATOR PEREZ, seconded by SENATOR LUTAR. Motion to strike "Nevada" and replace it with "UNR" made by SENATOR AGUERO, seconded by SENATOR PRICE. Move into a vote. Motion to Amend passes 23:0:0. A brief discussion ensued about the item not going through the E-Board, Mr. Buska and Don Fuller not being present, whether students are aware that KUNV is going to be broadcasting them, and approving the cost breakdown. Move into a vote. Motion passes 21:1:1. (SENATOR SOLOMON opposed, SENATOR LUTAR abstained.) B. Action Item: Discussion/Approval for Don Fuller, General Manager, KUNV for trip to Reno on March 24, 1997, to attend meeting held at KUNR concerning radio station business affecting KUNV. Motion to Approve made by SENATOR MOORE, seconded by SENATOR SONG. A brief discussion followed about reasons for funding or not funding the trip, "rubber stamping" everything for KUNV, the consequences of disapproving the item, late submission of the item, and tabling the item. Motion to Table made by SENATOR TRUJILLO, seconded by SENATOR MOORE. Move into a vote. Motion to Table passes 12:11:0. (SENATORS ANDERSON, HAYES, STARK, LIDEROS, STARK, LOPEZ, LEHMAN, AMEND, SOLOMON, SHAPIRO, FLEISCHMAN, and PEREZ opposed) C. Action Item: Discussion/Approval of Joe Laxague, Veronica Perez, and Mike Castillo for the CSUN Leadership Scholarship Committee. Motion to Approve made by SENATOR PRICE, seconded by SENATOR FLEISCHMAN. SENATE PRESIDENT LAXAGUE explained why and how the CSUN officials were chosen; in summation, the 3 students will be graduating and will not be recipients of the scholarships. 5 SENATE MINUTES 27-14/ APRIL 7, 1997 Move into a vote. Motion passes 22:0:1. (SENATOR PEREZ abstained.) D. Action Item: Discussion/Approval of Independent Service Contracts for Johnny Flamehead and Inside Scarlet. (They will perform on April 9, 1997, at a cost of $250.00 each.) Motion to Approve made by SENATOR LUTAR, seconded by SENATOR PRICE. In response to a question, SENATE PRESIDENT LAXAGUE stated that these contracts are contracts, but they are standard constracts that every single person that works as an independent provider for anyone at the university has to sign. He stated that the Senate agreed that there is no need to attach a copy every single time (if it is a standard contract), we'll just put a phrase in the item, but in instances where contracts that are different from the standard arise, a copy will be attached. He explained that the amounts for these bands are $500.00 each. Move into a vote. Motion passes 23:0:0. IX. EXECUTIVE BOARD ANNOUNCEMENTS AND SUMMATIONS SENATE PRESIDENT LAXAGUE stated that the last meeting was like a circus about moving the poll booth. He stated that Senators kept asking DIRECTOR REED the same questions about why wasn't the poll booth placed somewhere in the first place, being unduly influenced in cutting the poll booth somewhere, not putting the poll booth, a 200 vote poll, somewhere to help or t help any particular candidate. He stated that he didn't really catch on until the end when a former student president got up and once again tried to influence business in CSUN even though he hasn't been a student for 3 years. He added that, basically, he thinks "the corruption itself was uncovered and corrected; the poll was not put at CBC because the elections board wanted to disadvantage a certain candidate who might be more popular at that poll than at other polls even though it was one of the biggest polls last time and everybody was so glad that we had a poll at CBC. The whole reason it wasn't there in the first place was to help or to not help a particular candidate." He stated that he respected those that were in favor of having a poll in the Health Sciences like SENATOR PERSCH because we did dramatically increase the voter turnout over there without argument. He stated that those who came up with tons of adhoc, after-the-fact arguments, that "oh, well, somebody who's in the primary might call a case about the general" is ridiculous stuff. He stated that "those were arguments that were manufactured probably by the owner of the election company before any of you even got the issue. You, people, shouldn't have gotten the issue in the first place, but once you did, I'm proud of the way the majority of you handled it. I think through your insight of intelligent questioning, you exposed and then corrected a corruption that had taken place in the primary election set up and then you took action to make the polls more accessible to students... we took a little heat from the (Rebel) Yell, but that's fine. Sometimes you have to take heat if you want to do the right thing. So in that respect, I'm proud of the majority of you regardless of how you voted. I think there is a lesson to be learned. Even though the majority of you dealt with it well, it was a mistake on my part and on the rest of the Executive Board's part that each of you even had to deal with it and for that I'm sorry. Advice from the Executive Board, 'Don't hire Collegitial Elections Services again! Don't an Elections Board Director that has personal contacts with Allen Chastain or Joel Costman!' 6 SENATE MINUTES 27-14/ APRIL 7, 1997 Every single year those particular people start a sphere of influence within CSUN. Some years it goes nvhere. Some years it has, like this year, direct bearing on our business. You don't need those r.jople to tell you what to do. Those of you who are in their sphere of influence, wake up! Those of you who aren't, be on guard! What you need to know to be a representative - you need to know the hearts and minds of your constituents and you need what's in here (he pounds on his heart). That's what you need. You don't need anything else. So, new executives and continuing senators, that's a piece of advice." He also commented on SENATOR FLEISCHMAN's speech during public comment. He disagreed with the part about "never trust the Greeks... that's just a logical fallacy reasoning from the particular to the general... that's like judging all Germans on the actions of Adolf Hitler, all Russians on the actions of Ivan the Terrible." He used himself and VICE PRESIDENT MILLS as examples of being elected whether you are a Greek or Non-Greek and stated that everything we do has campus-wide interests at heart. He stated that he was sorry about those individuals, whoever they are, that tore down the banners. He stated that he won't be attending the Retreat because former SENATOR CAMPBELL was not welcome at the Retreat even though the Judicial Council, all the "lame duck" members of the Executive Board and Director Boards are attending and it was supposed to be "Senator-bonding" experience only so she wasn't welcome. He stated because of this and the circus at the last meeting, he doesn't feel welcome at the Retreat and asked everyone not to let this reflect upon his relationship with the Senate. He also congratulated the new executive members. VICE PRESIDENT MILLS thanked everyone for voting during the elections and asked that everyone going to the banquet to RSVP. He also looks forward to seeing everyone at the Retreat this caturday. XI. GOOD OF THE SENATE SENATE PRESIDENT PRO-TEMPORE addressed the former SENATOR CAMPBELL issue. She stated that "it was not my decision. Other Senators feel uncomfortable. This is not a 'Senate-bonding' Retreat. This is a bonding Retreat for Student Government as a whole. I apologize that former student government members aren't welcome. It's for us. We're... our constituents are paying for it, our constituents shouldn't pay for people that have graduated. That is the sentiments of Senators and mine as well and I'll stick by it." As far as the Retreat, she stated that they worked out the car matter; she asked for volunteer drivers to drive rental cars from the motor pool. She went down the line and asked Senators to tell her whether they were going to the Retreat or not. Then she expressed her disappointment about people canceling out (they had 2 months notice) because it cost the constituents money that was not refundable. SENATOR FLEISCHMAN stated that she may have to work, but will let SENATOR PEREZ know after Wednesday if she can go to the Retreat. She congratulated the new executive members. She stated that "we really need to work on (rules and elections). One of the most important, I think, is students versus family in campaigning. I had to bring my parents out to campaign for me in order to compete, quite frankly, and they had to take time off work. I'm very much against having to do that and I'd much prefer that the only people who can campaign for you are students who attend UNLV." She apologized if SENATE PRESIDENT LAXAGUE felt slighted and stated that there are options to the Greek rule and she is aware of that. She stated, "no more rubber stamping" with her 7 SENATE MINUTES 27-14/ APRIL 7, 1997 vote. She advised the newcomers about being influenced about precampaigning for Senate President ( ~ -o-Tempore. She stated that for the first time they'll need a Vice President Pro-Tempore because „Ae new Vice President graduates in the middle of what would be his term. She added that she has moved and her new phone number is 877-4194. She stated that she is happy about SENATORS TRUJILLO and AGUERO's questions for PROVOST FERRARO. In regards to the booth, she stated that she "assumed that when we had the primary as to where the booths would go... we never thought that the Dining Commons booth would be moved... and we made the assumption and yes, that is our fault, but we corrected that, and up until that point we'd always been notified as to where the booths were going to be. When I thought back on it this is the first time that the Elections Board Director or somebody who was on the Elections Board hadn't come forward and said, 'OK, this is where the polling place wasn't going to be.'... I didn't know and neither did anybody else in this room. If you all break down the word "assume", we can figure out where that put us... As a Senator, I knew that that booth had to be moved, I knew it had to go where the most votes were. As a candidate, I knew that booth had the potential to hurt me, but sitting in this chair I was not a candidate, but I was a Senator. I'm proud of what I did. I corrected something that should have been done the first time and I stand by it regardless of what the Rebel Yell or public opinion might be." SENATOR PRICE stated that the elections are over and congratulated the new executive members. He stated that Anatomy of a Violation was successful. He brought up the idea about a university year book. He stated that he thinks it is a good idea that Dr. Harter is speaking and thinks we need to continue the trend of administrators coming out of their shells and speaking to the students about issues. SENATOR GONZALES congratulate the new executive members. She stated that when she spoke to DIRECTOR REED, he said that the locations were already chosen before the candidates started filing for the election. She suggested having the Senators who canceled out on the Retreat reimburse the constituents. SENATOR SHAPIRO had no comment. SENATOR LUTAR had no comment. SENATOR SOLOMON commented on the Open Forum they had for Education; they had 5 students come on the first day and 5 students come on the next day. He stated that they had the last meeting for the Dean Search today and there should be an announcement in a week or so. Regarding KUNV, he added that the Senate is here to approve money for things, but shouldn't be forced to approve the money for items just because they've already taken place. He agreed with SENATE PRESIDENT LAXAGUE about the booth and elections. He stated that "it was amazing how when he asked DIRECTOR REED about elections and why there was no booth in front of the Dining Commons how he said, 'We, the Board, (the Elections Board), decided not to put the booth in the Dining Commons because it would give an advantage to a candidate.' In my opinion, I think that is being biased right there saying, 'Well, this person might have a better chance here, so let's move the booth.' and you know, I think that was a really bad move on his part. Then, came up 'where you would influenced by anyone?'; that was never quite answered...We have an Elections Board Director 8 SENATE MINUTES 27-14/ APRIL 7, 1997 who is supposed to be conducting an unbiased election, yet who is being supervised by one of the >ndidates...I found that kind of interesting. " SENATOR POOLE congratulated the new executive members. She stated that having the booth in the Dining Commons was a great idea. She also added that she received a letter that she was approved to be in the pool regarding the RHA election process, but the issue about being both an RHA and Senator hasn't been resolved. Lastly, she told Leia that she has a scheduling problem for Thursday. SENATOR SONG stated that he feels he let his constituents down by voting erroneously regarding the polling booth issue. He state that he is very proud to be Greek and has been able to due a lot of positive things on campus because of it. He stated that he cannot attend the Retreat. He stated, "God Bless Bayno!" and stated that he was sorry about the banners being destroyed. SENATOR AMEND stated that the exception rule to the Greek rule is a bad apple. He stated that Greeks in general have a higher GPA on average than non-Greeks, Greeks are more active in student organizations than non-Greeks, etc.. He added that he didn't think there was any correlation about being Greek or non-Greek about the banners being torn down and receiving votes in past elections. He stated that it was too bad that we didn't have an open session last time regarding Allen Chastain and the elections because "it was very embarrassing for him and very disrespectful for us and I hope that we never //garbled// through an election." He also stated his reason for not going to the Retreat. He didn't feel that Joel had to facilitate the Retreat and it should be open to everyone in '^e student government. SENATOR LEHMAN thanked everyone in the gallery for remaining throughout the whole meeting. She stated that they moved the booth for the right reasons. She added that she is proud to be Greek and the experience has been a good thing. She wrote a check to reimburse the constituents for the Retreat. She stated that we need to discuss the family campaigning for students. Lastly, she thought the Education Forum was fabulous and congratulated the new executive members. SENATOR PERSCH apologized for being late. She made a correction from last week, "apparently, according to Dr. Ackerman... there are only about 7 students who did not find placement with housing this past semester, not the 950 that we were told by one of our RHA." She congratulated all the candidates who ran in this last election. She also stated that she enjoyed the Education Forum. SENATOR KNUTSON commented on the Retreat //his comments were inaudible//. He, as a business owner, supported Don Fuller's trip to Reno because he is the general manager and is responsible. He also added that he is not using the Senate as a resume builder. SENATOR CAMBPELL congratulated everyone for running for the elections. He stated that it was a kind of a coincidence how a former president popped in towards the last hour of last week's meeting to give his "two cents on this particular topic, but he's never been here before and he's never heen here since; so it's kind of... it seems like there's some kind of cahoots going on." He 9 SENATE MINUTES 27-14/ APRIL 7, 1997 apologized to SENATOR PEREZ about the Retreat for not being able to attend and will reimburse ' e constituents. SENATOR LOPEZ congratulated all of the winners of the elections and stated that he thinks that the next election could be run a lot smoother. SENATOR LIDEROS stated that he thought that the CSUN Executive Board members were life-time members of the CSUN. He stated that the Engineers had a great weekend, but crashed a bearing on one of their bikes and took third place in //intelligible// and the Civil Engineers took third place in the Regional for the American Society of Civil Engineers. He added that they took 9th place in the canoe; and took place 3rd place in the Spring for women, but the men happened to fall out of the canoes. He added that this year's T-shirt outbreak around campus will be a picture of Mr. Rogers. Lastly, he announced a retirement party for Herb Wells on Friday, midday, at the Burger King. SENATOR STARK had no comment. SENATOR MOORE stated that, as a future Executive Board member, he promises that issues like moving the polling booth will not be repeated. He thinks that a lot of time was wasted on it and it was kind of out of control. He congratulated VICE PRESIDENT JOE MILLS and thanked everyone for voting. He stated that he is looking forward to SENATE PRESIDENT LAXAGUE's advice in the upcoming weeks. He stated that he had a meeting with the new executive members with the intention of setting goals for next year and they will have another meeting on Friday. He stated he doesn't agree with not letting family and friends help with campaigning. Also, he touched ^on the Greeks versus Independents; he stated as a Greek, he believes in the principles it represents and as a president, he believes in higher standards, etc.. He stated that we're trying to reach a point, even though we know it is not obtainable, but at least we are trying. Lastly, he commented on the bad press Greeks receive. SENATOR HUNT had no comment. SENATOR HAYES rescinded her decision to attend the Retreat and will reimburse the money. She stated that she will no longer approve things regarding KUNV and Jazz, until it becomes a student station. She also stated that the Greeks aren't the only people that are noble, "you don't need to be a part of a Greek Organization." She also commented about Greek members who snap being out of turn and that it is not necessary. SENATOR ANDERSON stated that everyone who cannot go to the Retreat is going to pay the money back. She stated that she understood that the Retreat was an opportunity for everyone in student government to get to know eachother a little better, to work together a little bit better and she thinks Joel would be adequate in working toward those goals. She stated that she doesn't think that Leia meant that all Greeks were bad, she was just saying "be weary of people saying that they'll do things for you." She stated that she'd maybe be interested in doing Admission's during the summer. Also, regarding the election rules, she stated that she thinks the Elections Director should start getting "aid right off the bat so that they can get started working on the rules. Lastly, she enjoyed and was id to be a part of Anatomy of a Violation. 10 SENATE MINUTES 27-14/ APRIL 7, 1997 SENATOR TRUJILLO asked the Senate to keep in mind when asking a member of a Judical council their opinion as the opinion of the entire council is unfair for both the individual and CSUN; we should ask the organization as a group. He stated that the mock trial was fun. He stated that he was unaware about the facilitator for the Retreat. He also commented on last week's meeting about the open discussion with PROVOST FERRARO and the Concensual Relationship Policy; he felt that he did the Senate an inservice because he got flustered about it. He thanked Dr. Ackerman for giving his word about not voting on this until students have been totally heard. He and Joe will have a meeting with Dr. Ackerman about how they are going to approach this; they're not going to just let it die. He gave Leia credit for speaking her mind, but he thought it was a step too far. He stated that as one of the members who started a fraternity on campus, you don't realize what kind of walls and barriers that are there when you embrace a group of ideals and you try to follow through with them. He stated that there are those exceptions when Greeks are judged as a whole. Lastly, he stated that he was disappointed about what happened regarding the elections this year. He also asked what organization held a car wash last weekend at Chevron, but no one knew. SENATOR AGUERO congratulated the winners and everyone that ran in the elections. He disagreed with the "shame on you" lecture from SENATOR FLEISCHMAN and felt it was wrong; he believes that we "argue ideas, not people" as Senators. He agreed with SENATE PRESIDENT LAXAGUE about the Retreat. Lastly, he agreed with SENATOR HAYES "that sometimes the Greek recognition symbols that are placed on the Senate floor are beyond the realm of what should be here." He also stated that he thinks that what Greeks do by wearing badges on their chests as honor is both ~>norable and right; "these are some of the most upstanding students that we have on this campus..." SENATE PRESIDENT LAXAGUE added that the snapping of fingers by some Greeks is applause because it is quieter than clapping. Former SENATOR BRIGGS commented on the Greeks versus non-Greeks issue. She stated it's not about being a Greek, it's about how you feel about yourself and not a Greek issue. XI.
