I agree.Excerpt from Deed, Helen J. Stewart and heirs to William A. Clark. (Photostatic copy in Pioneer Title, Book "U«, Page 333 of Deeds.) Dated December 8th, 1903. Description of land to be conveyed and consideration, (|55,000). Then follows: "Together with all water arising from said land or flowing therefrom, and all water rights belonging thereto and used in connection therewith, except four miner’s inches of water (California measurement) or so mach thereof as may be required by the parties of first part to irrigate said burial plot, from the Vegas Creek, and the water shall not then be diverted from said Vegas Creek in such manner as to interfere with the rights herein reserved, unless provision shall otherwise be made by said party of the second part, his heirs or assigns, to convey.to the tract of land so reserved the water aforesaid, for use as aforesaid." June 16, 1939.
