'» ? users that had never been billed prior to August of 1952; that for the Apache Hotel the question was asked "Was any billing ever made under this particular rate, that is, 1931, until 1952 for a refrig­erating machine?" and the answer was "Not to my knowledge." and further it appears that there was a refrigerating machine in the hotel since 1936. Hie question was also asked "Do you know how long the El Portal Theatre has had a cooling system?" and the answer was "I think since 1934•” It is equipped with a cooling tower and has about fifty-ton capacity. The make-up water necessary in the system is about forty gallons ("as measured in a garbage can"). This will last from four o'clock in the afternoon until eight o'clock at night when another can full of water is dumped into the system and lasts until eleven o"clock. Hie theatre plant operates about ten hours a day and only during the period from May to October. The old billing had been on the basis of flat rate per machine, while the new billing amounted to $646 for the period July 1 to August 31 of 1952. This billing wasnot in accordance with other bills submitted as it was for the period from July to August rather than from January to August, both inclusive. The Ranch© Grande Creamery, the record indicates, was charged approximately $3.50 per month under the old schedule. This amount was billed on a two-ton machine prior to September 1, 1951. On September 1, 1951 the charge was five dollars* On September 1, 1952, a corrected statement was rendered by the Company in which the dairy was billed "for an additional refrigeration charge for the period January 1 to and Including August 31* 1952 in the amount of $1072, less amount previously paid $40, or a net additional charge - 4 -
