    N that it would be impracticable or extremely difficult to deter­mine the amount of the diminution in the market value of the said lands of the Union Pacific which would result from the con­tinued maintenance of said pipe lines and power lines in their existing location upon the said properties of Union Pacific which are not to be acquired by the District. It is desirable to both parties to have certain of said pipe lines and power lines removed from or relocated upon the property of Union Pacific and to provide for the granting of ease­ments to the District for its pipe lines which will permanently occupy the property of Union Pacific not acquired by the District. The parties also desire to agree upon the amount of liquidated damages which Union Pacific will be entitled to re­ceive if certain of said pipe lines and power lines are not re­located upon or removed from the property of the Union Pacific not to be acquired by the District, as required by the terms of this agreement. Agreement NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, it is agreed as follows: Section 1. The District agrees that it will, at its sole cost and expense and within one year from the sale"date, remove from the premises of the Union Pacific the following pipe lines and pole lines: (a) That certain pipe line shown in broken black and white line between points KK and LL on said Exhibit "A-l". (b) That certain pipe line shown in broken black and white line between points II and JJ on said Exhibit "A-l”. - 2 -
