    CSUNSENATE MEETING 35-17 MONDAY, April 25th, 2005 MSU 201, 6:00PM I. CALL TO ORDER II. ROLL CALL SENATOR WASHINGTON arrived at 6:09 III. PLEDGE OF ALLEGIANCE IV. APPROVAL OF MINUTES The following minutes are submitted for approval: 35-16 SENATOR DONNELLY moves to approve SENATOR HA WORTH seconds 2 0 - 0 - 0 SENATOR JOHNS SENATOR JIMENEZ abstain V. PUBLIC COMMENT VICE PRESIDENT GOATZ: We give out faculty excellence awards and Professor Hardagree received it this year DR. HARDAGREE: I am incredibly honored to get this award. I wanted to thank you very much. ELIZA GARER: I was looking into running for a seat in here. I'm from Wyoming and an Education major. DIRECTOR WISTISEN: As you have seen, Rebel Radio is no longer going to be a directorship. We have recorded two shows right now. We are going to record 12 shows before the summer. We will get two hours a night. If CSUN is not a part of rebel radio it is going to suck. We are on the air and then we get pulled. 1 DIRECTOR ARNESON: We had a good event this week end. We got way more people then we expected. Thanks to SENATOR ESPINOZA SENATOR DONNELLY SENATOR HUERTA. DAVE HILL helped out a lot for it. KORI BRUST: I wanted to come in and introduce myself. I will be applying for the new directorship. I will be up there to answer any questions. Feel free to come and talk to me. VI. REPORTS A. Senate Committee Reports SENATOR MOSES: We have some things we have to pass. Next week I would like to become chairmen next week. If we could make a meeting soon, that would be great. B. Faculty Senate/University Committee Reports C. Business Manager Report See Report BUSINESS MANAGER HILL: They are doing hiring in the controllers office. Two positions are in payroll. D. Liaison Reports i. Student Involvement Activities BRIAN LAGOMARSINO: Next forum is this Thursday in the Tonopah. We are going over all the events. It is going to be the first week in November. ii. Residence Hall Association RHA PRESIDENT ASHELY FARREL: We have a recall election as well. They are today and tomorrow. It is way down compared to last time. People are out campaigning right now. May 7th is UNLV finale. It will be like a carnival. iii. Student Athletics iv. Student Health Advisory Committee v. ROTC ASSOCIATE CHIEF JUSTICE CHAPEL: We had a good training event last Friday and sat. We flew to Reno and we visited a battle site. We did some night land navigation at 8 pm until midnight. We did patrol base after that until 3:30. We woke up 2 hours later and went to the rifle range. This week we have our awards ceremony. vi. Leadership Advisory Board SENATOR TEMPLETON: UNLVino was last Saturday. We sent some books to the soldiers over seas. Orientation leaders is hiring right now. Greek week was last week. Rebel achievement awards this Friday at four. Rebel Recruiters is also hiring. This is all online on the Yahoo groups. E. Rebel Yell Report VII. EXECUTIVE BOARD ANNOUNCEMENTS PRESIDENT SCHUCK: This is the last time I will be here. It has been fun and I think we got a lot accomplished. I am really confident in the new executive board coming in. Thanks for dealing with me. I had a really good time working with all the directors this year. You all stepped up to the bat. The two items for the stress free zone, since we dipped into campus events for MEChA I took money from hosting. For the Ham Hall board we will be paying $14, 500 of the $21,000. One of the agenda items is to have the directors submit there items through the executive board. This will be really weird for the chain of command. You will lose no power. It gives executive board a point. It doesn't make a difference to me anymore but it will help in the future. We will still have the awards thing this Saturday at 6:30. We are giving away a lot of awards. I kind of don't want to leave. I wish you guys a lot of luck next year. I hope the lecture series continues. I will still be around my office until finals are over and I'm going to go to water polo. DIRECTOR MADRIGAL: It is weird being in here because I don't know half the faces in here. Ea gives a farewell speech. CSUN Service went above and beyond this year. We have connected and built our relations with SIA. We are a student governing body and we need to continue to make the students have a better experience here. I want to thank everyone on my board. Kori Braust will make a good director next year. I wish everyone the very best. DIRECTOR BLOOD: I still have work to do because I still have Pataki. The lectures are a good thing that we have been doing. It will be at 7 on Thursday. I would like to thank some of the senators. Thanks to SENATOR BOWERS SENATOR ESPINOZA SENATOR DONNELLY, SENATOR HA WORTH SENATOR CRAWFORD SENATOR MACK and the Senate Secretary. I couldn't have done this year with out the E-Board. I wouldn't be where I am with out PRESIDENT SCHUCK. VICE PRESIDENT GOATZ is amazing. He has learned a lot. He is always the one to help out the most. Try to help the directors more next year. A lot of what CSUN does happens through the directors. If the senators help more we can do a lot better. DIRECTOR BOURDET: I want to say thanks to the E-Board. Hoping my assistant will be the next director. He has been the best assistant. Most of you have seen him around and he works long hours. He is the most dependable person I know. I have seen that UNLVCSUN doesn't get too much use. We spent $5,000 on it and we should use it. I am hoping that next year you contribute more to your directors. 3 DIRECTOR ANERSON: It has been a really good four years. CSUN has been one of the best experiences at college for me. I don't have a lot prepared. Fantastic job this year peter. It has been a great learning experiences. The E Board did a really great job this year. The guy that is behind the scenes all the times and he doesn't get much recognition, DAVE HILL is a great person. Shawn Holmquest has also helped me a lot with this. He knows everything that will be going on. I am confident that he knows exactly what he is doing. DIRECTOR DONNELLY: It has been fun. VICE PRESIDENT GOATZ: Wow. This was the best year in CSUN I have ever had working with Mike and PRESIDENT SCHUCK. I didn't know how this was going to work with PRESIDENT SCHUCK.. The shuttles are something that the faculty loves now. PRESIDENT SCHUCK did what was best for the students. Mike brought me into CSUN and I haven't seen you leave since. I don't know what to say. Please show up to the awards banquet. Also, please support Pataki next week. Thanks for everyone that went to Rebelpalooza. Thank you all. SENATE PRESIDENT AMESQUITA: I will try to make this quick. To my senate secretaries thank you for all your work. We are up there really late and need to get stuff done. To the senators, I go back to senate session 32.1 feel like I grew up with a few of you and fathered a lot of yall. Capture every moment. I thank you all for the journey. It has been incredible this year. This is the best CSUN we have had in decades. The people who did this in the 70's are really awed with what we have done. I wrote the directors a really gussy email. The directors have done a lot. We need to put a lot of our energy to our directors. To E-Board; two are missing. Jamielle does a lot of our work. DAVE HILL is like the fourth member of E-Board. We will yell at each other through the halls because we are lazy. DAVE HILL has really gotten involved in higher education. PRESIDENT SCHUCK, I would always forget to tell him what was going on because he didn't know what was going on. He did an amazing job for Peter Goatz; Thank you. Thank you for being secretary, and showing me all the details and helping me out a lot. SENATE PRESIDENT PRO TEMPORE MULLINAX: I'm not going anywhere. This is my last year in CSUN. Now I'm going to be the oldest person here. Mike has this system that he has been doing the last few years and I haven't had to do much. I will help you out as much as possible. PRESIDENT SCHUCK I never disliked you and I used to dislike you Peter. I hope we can continue with what is going on. Lets get this all done. VIII. CONSENT AGENDA A. Action Item: Approval of an amount not to exceed $600.00 for parking services at Rebelpalooza. Costs to be encumbered from the CSUN 2702 FY 05 Entertainment & Programming (Rebelpalooza) account. As submitted by Senator Huerta on behalf of Director Arneson. D. Action Item: Approval of an amount not to exceed $1,000.00 to be paid to Xtreme Radio 107.5 for Rebelpalooza advertisements. Costs to be encumbered from the CSUN 2702 FY 05 Entertainment & Programming (Rebelpalooza) account. As submitted by Senator Huerta on behalf of Director Arneson. Approved E. Action Item: Approval of an amount not to exceed $3,500.00 for additional printing costs of the Vagus Nerve creative magazine. $10,000 of the total cost to print 3,500 copies of the Spring 2005 issue was already approved at 35-04. Costs to be encumbered from the CSUN FY 05 Discretionary account. As submitted by Senator Espinoza on behalf of Director Muscato. SENATOR ESPINOZA moves to approve SENATOR DONNELLY seconds SENATOR JOHNS: What is this for? SENATE PRESIDENT AMESQUITA: It is a lot bigger then it was ever before. VICE PRESIDENT GOATZ: We need more money to print the extra ones. SENATE PRESIDENT PRO TEMPORE MULLINAX moves to amend the item inserting publications. SENATOR JOHNS opposes 2 1 - 1 - 0 SENATOR PIRO: This is dirty to come in here with this but she won't be here in the future. 5 SENATOR BOWERS: Can you change this because it is harder to read? This is why we should approve this here next time. SENATOR TEMPLETON: What is the outlook for alumni to submit to this? VICE PRESIDENT GOATZ: It is an undergraduate magazine. SENATOR TEMPLETON: I would like to see some alumni being able to post for it. SENATOR JIMENEZ: I know it is coming out of her budget but she is still going over. I don't like the cover. DIRECTOR BOURDET: The cover is a lot better then what it was going to be. I don't support the director but I do think it is a good magazine. SENATE PRESIDENT PRO TEMPORE MULLINAX: I think the cover is whack. The idea of the magazine is to get the students art work out. The fact is, if I was in here and I heard this then I would be mad. It will be serving out students. SENATOR ESPINOZA: I agree with SENATE PRESIDENT PRO TEMPORE MULLINAX. I guess we are being scared. If we don't spend this then it will probably got to reserves. SENATOR WASHINGTON: Is the actual amount there? And where will it come from? PRESIDENT SCHUCK: It will come from money from Rebelpalooza. SENATOR MOSES: I think it is a good project but I don't like the cover. SENATOR PIRO: We should save that money to put to other thing. This is quality work inside. But the cover doesn't attract people and no one is going to pick it up. SENATOR BOWERS: We don't want to cover this up with more mistakes. We fund this with the student's money and CSUN is only put in here really small. Vote against this. SENATE PRESIDENT AMESQUITA rules the item out of order IX. UNFINISHED BUSINESS A. Action Item: Approval of $18,500.00 for the purchase of an electronic marquee board to be placed on Maryland Pkwy. and Cottage Grove Drive to publicize the activities taking place in Ham Concert Hall, Judy Bayley Theatre, and Black Box Theatre. Costs to be encumbered from the CSUN FY 05 Interest Bearing account. As submitted by the Executive Board. SENATOR WASHINGTON moves to approve SENATOR GABRIEL seconds PRESIDENT SCHUCK moves to amend the item striking "18,500" and inserting "14,500" striking "interest bearing" and inserting "$4,000 reception and $7,500 rebel radio. ( 22-0-0 amendment passes SENATOR JOHNS & SENATOR ESPINOZA oppose 2 0 - 2 - 0 Item passes B. Action Item: Approval of Resolution 35-03 Commending UNLV Golfer of his great successes this year. As submitted by the Executive Board. SENATOR WASHINGTON moves to approve SENATOR COCHRAN seconds SENATOR WASHINGTON What is happening? PRESIDENT SCHUCK: I am emailing it to SENATOR ESPINOZA. SENATOR ESPINOZA: I think we should pass it. It isn't that big of a deal. 7 SENATOR JOHNS: What is the worst thing that PRESIDENT SCHUCK can come up with? I will agree with anything PRESIDENT SCHUCK says. SENATOR WASHINGTON opposes 2 1 - 1 - 0 Item passes C. Action Item: Approval of an amount not to exceed $6,000.00 to be paid to the Student Health Center for "Stress Free" events. Costs to be encumbered from the CSUN 2702 FY05 Discretionary (Campus Events) budget. As submitted by the Executive Board. SENATE PRESIDENT PRO TEMPORE MULLINAX moves to approve SENATOR LACARRA seconds SENATOR LACARRA moves to amend the item striking "6,000 from campus events" and inserting "5,852 campus events and $1,048 hosting" SENATOR BOWERS opposes 2 1 - 1 - 0 amendment passes 2 2 - 0 - 0 Item passes X. NEW BUSINESS A. Action Item: Approval to override Student Body President Henry Schuck veto, dated April 13, 2005 of Senate meeting 35.15 New Business Action Item B regarding UNLV MEChA. Item was amended and approved for funds allocated to UNLV MEChA in the amount of $4,250. As submitted by Senator Huerta. SENATE PRESIDENT AMESQUITA rules the item out of order B. Action Item: Approval to reconsider Senate meeting 35.15 New Business Action Item B regarding UNLV MEChA dated April 13, 2005. Item was amended and approved for funds allocated to UNLV MEChA in the amount of $4,250. As submitted by Senator Huerta. 8 SENATE PRESIDENT AMESQUITA rules the item out of order C. Action Item: Approval of Senator Haworth to serve as a member of the Campus Safety and Awareness for the remainder of the 35th session. As submitted by Senator Donnelly, on behalf of the Campus Safety and Awareness Committee. SENATOR DONNELLY moves to approve SENATOR JOHNS seconds SENATOR HAWORTH accepts 22-0-0 D. Action item: Approval of committing of Senate Bylaw 75 to be committed to the Bylaws committee. As submitted by Senator Jimenez. See attachment 35.17.01 SENATOR JIMENEZ withdraws the item E. Action Item: Approval of Committee Recommendation of Senate Bill 35-07, which proposes adoption of bylaw 83. As submitted by Student Body President Shuck (see attachment). SENATE PRESIDENT PRO TEMPORE MULLINAX moves to approve SENATOR DONNELLY seconds PRESIDENT SCHUCK: These items would still be on the agendas. The E-Board would have to support the director before they can come here. The idea is to not have the chain of command going astray. SENATOR PIRO: They way this is worded is active censorship. This is our check on them. You need to reword this to say what you want SENATOR MOSES: If two members of E-Board don't like this then the item is done and won't even come to us. SENATOR LACARRA: If the senate can't look at it, then we can't look at it all. The way it is now we still have a say. SENATOR TEMPLETON: I agree with SENATOR LACARRA SENATOR ESPINOZA: You can always waive the bylaw if this is something you are passionate about. The Executive Board spends the most time up in CSUN. 9 SENATOR BOWERS: The reason we have the government is that we are representing them. I want to know what the directors say. SENATOR BOWERS: Everything we do goes through the executive board anyways. We are always making compromises. I don't think that they are trying to take away your power. They are doing this because they are our supervisors. They listen to what we say and help us with making compromises. Not once have they shot down an idea. They always help us to get what we want done. Be better senators and find out what is going on. DIRECTOR ANERSON: I think they should be able to come up with what is best for CSUN. DIRECTOR DONNELLY: I'm not opposed to this. I don't think that they did this to stop the directors from doing anything innovative that they want to do. DIRECTOR ANERSON: If you have a passionate director, the Executive Board is going to listen to them. We know what we are doing most of the time. We are going to get done what we need to get done. SENATE PRESIDENT PRO TEMPORE MULLINAX there is a reason why we have this how it is. This would be showing a complete lack of confidence in the Executive Board and directors. We need to trust our senators that they are doing a good job on their committees. There are checks and balances. There has to be some kind of compromise. I think it needs to be rewritten. SENATOR WASHINGTON: I feel that from what the directors that this is happening as it is already. This is a risk for future Executive Boards . PRESIDENT SCHUCK: The vice president is in charge of the directors. We could amend this to say that the senate can override the decision with a 2/3 vote. SENATOR PIRO: We are talking about hope. We need to have every person have a say. SENATOR PIRO moves to recommit SENATOR DONNELLY seconds 21-1-0 SENATOR JOHNS opposes F. Action Item: Approval of Committee Recommendation of Senate Bill 34-08, which proposes changes to bylaw 71. As submitted by Student Body President Shuck (see attachment). SENATOR DONNELLY moves to approve and combine Action Item F and G 10 SENATOR ESPINOZA seconds SENATOR JIMENEZ: these are bills and we shouldn't combine and approve. SENATOR JOHNS: I don't know what is going to be changed on 71 SENATE PRESIDENT AMESQUITA: Everything in brackets will be deleted SENATE PRESIDENT AMESQUITA: We previously had student body presidents who wanted to create there own board. The current student body president body doesn't need all that. He has the directors. He didn't need to have his friends to have stipend positions. SENATE PRESIDENT PRO TEMPORE MULLINAX: I have talked to PRESIDENT SCHUCK a number of times about this. In the three and a half years I have been here, this does not work. The presidents put there friends in a position because they could. The letter was almost pointless. It was a waste of time and money. SENATOR WASHINGTON: Are we still talking about combining and approving? SENATOR VILLA, SENATOR TEMPLETON SENATOR GABRIEL SENATOR JOHNS SENATOR GONZALEZ, SENATOR WASHINGTON, SENATOR PIRO , SENATOR JIMENEZ , SENATOR BOWERS SENATOR MOSES SENATOR LACARRA SENATOR VAN HOUTEN oppose 10-12-0 motion fails SENATE PRESIDENT PRO TEMPORE MULLINAX moves to approve Jeff Ponchvinin: This was the stupidest thing that CSUN has ever done. SENATOR TEMPLETON: I think this is sad. This is clearly and outrage to the students. If we can revamp this. I am sorry that this failed. This will go out to all the students. SENATOR JOHNS: This failed because the president appointed his friend. SENATOR BOWERS: If any of the senators want to take this on, then don't vote for this. SENATE PRESIDENT PRO TEMPORE MULLINAX: if your concern is to not outreach to the students you shouldn't have voted down the Vagus Nerve . The Rebel Yell is a hundred times better then this. VICE PRESIDENT GOATZ: The web site should be enough. It is more cost effective. We should be directing people to the web site 11 SENATOR PIRO: I think the fear in the room is that this could be restructured and could be effective. SENATOR ESPINOZA: The people who were here and saw what this was are opposed to this. The lack of effort that was put into this was enormous. There is a reason why the people who have seen this are voting against this. We should get rid of this and then rebuild. SENATOR SORVONGSAVANH: I think that the committee and PRESIDENT SCHUCK think we should do this then I think we should SENATOR JOHNS opposes 21-1-0 item passes G. Action Item: Approval of Committee Recommendation of Senate Bill 34-09, which proposes adoption of bylaw 84. As submitted by Senator Espinoza (see attachment). SENATOR HA WORTH moves to approve SENATOR DONNELLY seconds SENATOR ESPINOZA: The point of this is students supporting the school. This is about making a difference. SENATOR TEMPLETON: Is this for one sport? SENATOR ESPINOZA: No SENATOR PIRO: I think that we should jump on the train right now. SENATOR ESPINOZA: He would keep certain record of what we did like fliers and what we made. This will show what events failed. DIRECTOR BOURDET: I am currently the historian 22-0-0 passes H. Action Item: Refer to Committee, Senate Bill 34-10, which proposes changes to bylaw 72. As submitted by Senator Crawford (see attachment). SENATE PRESIDENT PRO TEMPORE MULLINAX moves to commit. SENATOR CRAWFORD seconds 12 SENATOR JIMENEZ: I want to bring to attention section 3 a 2. It seems like it is too far apart. I also think that a week is too short. SENATOR TEMPLETON: I don't think that anyone likes the word roughly. 2 1 - 0 - 1 SENATOR VAN HOUTEN abstains I. Action Item: Approval of $ 1500 to co-sponser UNLV Spring Flicks Film Festival. Cost to be encumbered from the CSUN 2705 FY02 Senate Discretionary budgets of $800 Marazita, $200 Mullinax, $118 Wong, $48 Huerta. As submitted by Senator Marazita. SENATOR MARAZITA moves to amend the item striking "1,500" and inserting "3,075" striking "02" and inserting "05" and inserting "$1,909 from rebel radio discretionary" account SENATE PRESIDENT PRO TEMPORE MULLINAX seconds SENATOR MOSES: Where is the money going to be going to? SENATOR MARAZITA: I passed it out. SENATOR JIMENEZ: The numbers add up? BUSINESS MANAGER HILL: Yes. 22-0-0 amendment passes SENATOR JOHNS: Who is David Smelner? SENATOR MARAZITA: He is a professor in the film department SENATOR JOHNS: Does he get to keep all this? SENATOR MARAZITA: No. VICE PRESIDENT GOATZ: Who are we paying this to? SENATOR MARAZITA: Through the film department. SENATOR MARAZITA moves to amend the item inserting to be paid to the UNLV short film archives, under the film department 13 22-0-0 amendment passes SENATOR BOWERS: After the event where does this go? SENATOR MARAZITA: This goes to all the students 22-0-0 item passes XI. EXECUTIVE BOARD SUMMATIONS VICE PRESIDENT GOATZ: Show up to the interviews. SENATE PRESIDENT AMESQUITA: This is the spirit director. The newsletter, if we want to inform our students we have the means. I will be taking down the yahoo groups. Thank you for not doing the newsletter. SENATOR MACK resigned. Lacrosse season is over. Our record is 2-5. Thank you for those who went to Ryan Boamgauders vigil. I will defend the shuttles. Because PRESIDENT SCHUCK did this, the university has already put in $300,000. By sending rebel radio to urban affairs, it is institutionalizing it. Greek week happened and was changed again. It was group teams this year. The GPA requirement is going to be 2.5. Thank you all very much. It has been a journey. XII. GOOD OF THE SENATE SENATOR VAN HOUTEN: I am looking forward to SENATE PRESIDENT ESPINOZA SENATOR LACARRA: These dd cards are great. They provide a service so that students can get home safe and they take your car as well. I am trying to get a proctor program. Any student in CSUN can become one and they help out with test taking. Hopefully all you guys should be in favor of that and not cheating. SENATOR WONG: I was surprised that our directors are all graduating. I like the events that were put on and I hope we have just as good directors SENATOR HA WORTH: The first meeting of GSA will be at on Thursday. We will also be talking about walking in pride SENATOR DONNELLY: I am sad to see the executive board leaving and excited about the new one. SENATOR ESPINOZA: I would like to thank everyone for approving the bylaw. Maybe this will help with. After finals it will be ever other week for meetings. Bear with me when I make mistakes. I will learn from my mistakes. Who is graduating? 14 SENATOR MOSES: I want to say that I am glad we didn't do the Vagus Nerve thing. I want to hold my meeting before finals. SENATOR BOWERS: I agree. I was sad that SENATOR MACK resigned. I did receive a personal invitation to MEChA. SENATOR JIMENEZ: We had a pretty good meeting. I would like to see more then one person come up for directors.
