SHE ALSO MENTIONED THAT TEUSDAY AT 1 PM THERE WILL BE AN IN-FORMAL MEETING TO WRITE THE BYLAW TO CREATE THE RULES&ETHICS COMMITTEE. IV. BOARD AND COMMITTEE REPORTS BARBARA MCFARLAND BARBARA MCFARLAND INTRODUCED HERSELF AS THE BUSINESS MANAGER AND MENTIONED THAT HER OFFICE IS LOCATED IN HUMANITIES BUILDING ROOM #332. REPORTED THAT SHE FOUND HER DESK UNDER ALL OF THE PAPERWORK THAT HAD ACCUMULATED. THE YELLIN' REBEL PUBLISHES THE FINANCIAL AID NEWSPAPER EACH YEAR. THIS YEAR WOULD BE BEST TO USE A CONTRACT TO ALLEVIATE PROBLEMS. THIS IS A MONEY MAKER. WILL BE ON AGENDA NEXT WEEK (PASSED OUT THE CONTRACT). SHELLY BERKLY READ THE CONTRACT BEFORE SHE LEFT AND FOUND NO PROBLEMS. ALSO MENTIONED THAT MARRIOT IS LOOKING FOR IDEAS FOR WHAT KIND OF CON-CESSIONS STUDENTS WANT. THEY ARE CONSIDERING FAST FOOD CHAINS. SHOULD LET FEELING KNOWN. ALSO UNDER DISCUSSION IS A POST OFFICE AND KINICO'S TYPE SERVICE. RAY FRANKULIN PASSED OUT ACCOUNT BALANCES. MENTIONED THAT THESE WOULD HELP SENATORS TO MAKE DECISIONS WHEN APPROVING MONEY. MIKE KENNEDY REPORTED THAT ASS'T NSA DIRECTOR MIKE BARCLAY HAS RESIGNED. CURRENTLY LOOKING FOR NEW MEMBERS. REPORTED THAT HE ATTENDED AN ALCOHOL AWARENESS MEETING WITH BUD BENNEMAN CONCERNING GROW-ING CONCERNS ABOUT ALCOHOL ABUSE ON CAMPUS. ENCOURAGES SENATORS TO GIVE THEIR OPINION TO THE UNLV FACULTY. KAREN SPLAWN MENTIONED THAT SHE WILL BE LEAVING FOR NEW ORLEANS FOR THE CONFERENCE. LORI GALLAGHER WILL BE SUPERVISING THE ISSUE TO COME OUT DURING THAT TIME. MENTIONED THAT NEXT SEMESTER STUDENTS CAN RECEIVE 3 CREDITS FOR WORKING AT THE YELLIN' REBEL. IN REGARDS TO RECOMMENDATIONS MADE BY THE PUBLICATIONS BOARD: YELL WILL BEGIN USING A LOGGIN SYSTEM FOR ARTICLES SUBMITTED. PRESENTLY THERE ARE ONLY 6-10 REPORTERS WORKING ON ANY ISSUE. THE YELL ADVISOR ANN EHRENBURG WILL BE CONTACTING THE SUN AND RJ TO SET UP A TIME TO VISIT THESE PUBLICATIONS. THE NIFTY NICKEL CONTRACT IS AVAILABLE IN BARBARA MCFARLAND'S OFFICE. ALSO REPORTED THAT THE YELL WILL BE PLACING AN AD IN THE RAN-CHO YEARBOOK, WHICH IS ONE OF THE HIGHLY REGARDED HIGH SCHOOL PUBLICATIONS TO GET THE WORD OUT. CHARGES FOR PERSONALS HAVE BEEN REDUCED TO NOTHING TO ENCOURAGE MORE STUDENTS TO PLACE PERSONALS; PERSONALS HAVE DROPPED OFF IN THE LAST MONTH. GENE TROMOGLINO IS INTERESTED IN DOING THE HOROSCOPE FOR THE YELL. HAVE ALSO CONTACTED THE PSYCHIC EYE AND THE PSYCHIC INSTITUTE. THIS PROBABLY WON'T GET STARTED UNTIL NEXT SEMESTER. SENATOR BENNEMAN ASKED IF THE YELL WAS CONNECTING WITH OTHER CAMPUSES. KAREN ANSWERED YES, BUT MOSTLY GET IDEAS FROM OTHER PAPERS THAT ARE SENT TO THE YELL. HOWEVER SOMETIMES PER-SONAL CONTACT IS MADE WITH OTHER EDITORS. VICE PRESIDENT PRO-TEMPORE FOUNTAIN SUGGESTED ALSO PUTTING AND AD IN THE CLARK HIGHSCHOOL YEARBOOK SINCE IT HAS WON MANY AWARDS OVER THE LAST FEW YEARS. KAREN SAID SHE WILL CALL. TAMMY ADVISED CALLING JUDY HALE. SENTOR GEIHS MENTIONED THAT HE HAS FRIENDS THAT WOULD LIKE TO EARN CREDIT AND WANTS TO KNOW HOW THEY COULD SIGN UP FOR THE CLASS. KAREN MENTIONED THAT ANN EHRENBURG WILL BE TEACHING THE CLASS OR THEY CAN GET INFO FROM THE SPRING SCHEDULE. ALSO MEN-TIONED THAT STUDENTS WILL PROBABLY BE GRADED ON THE STORIES THEY SUBMIT TO THE YELL. ROB ROSENTHAL (KUNV) KUNV COLLECTED $2100 SINCE THE 19TH AND $900 IN IN-KIND SERVICES WITH WAREHOUSE RECORDS. KUNV IS PARTICIPATING IN A RECYCLING DRIVE WITH THE RESIDENCE HALLS. 50% OF THE PROCEEDS WILL GO TO OPPOR-TUNITY VILLAGE AND 50% TO KUNV. PAT EX-PLAINED THAT THE NAME OF THE "REBEL FRESHMAN REVIEW" WAS CHANGED FROM "THE SCARLET AND GRAY". THIS BOOK INCLUDED PICTURES OF ALL FRESHMAN WHO BUY THE BOOK AND 16 PAGES OF CSUN PROMOTIONS. CSUN CO-SPONSORS THIS AND IT DOES NOT COST CSUN ANYTHING. THE COMPANY SOLICITS, COLLECTS THE PICTURES AND DOES THE PUBLICITY. THE "U NEWS" IS PAID IN FULL. IT CONTAINS INFORMATION AND IS BASICALLY IS A FUN PUBLI-CATION. THE STUDENT SERVICES PENCILS ARE USED TO GET THE CSUN NAME OUT. STUDENT SERVICES SENT 20 PENCILS AND 20 BROCHURES TO EACH DEPARTMENT HEAD TO ADVISE THEM OF WHAT CSUN DOES. STUDENT SERV-ICES JUST FINISHED THE JOB VACANCY ANNOUNCEMENTS AND WILL BE AC-CEPTING APPLICATIONS FOR CSUN LEGAL COUNCIL. ALSO MENTIONED THE CSUN TYPING ROOM WHERE STUDENTS ARE CHARGES $.75 PER HOUR; THE CSUN NOTE TAKING SERVICE; AND THE RIDE BOARD. ALSO MENTIONED THAT STUDENT SERVICES IS IN CHARGE OF THE PSEUDO-APARTMENT FINDER SERV-ICE. THE CARTS THAT WERE GIVEN TO PUBLIC SAFETY ARE IN POOR CONDI-TION AND REQUIRE $400-$500 EACH IN REPAIR. SUGGESTS PURCHASING A NEW CART FOR $1000. PRESIDENT BUNIN MENTIONED THAT BOUGHT AN 8 SEATER CART AND THAT THE SECURITY SHUTTLE SERVICE IS IN OPERATION. STUDENT SERVICES DIRECTOR TUOY WOULD LIKE TO STILL PURCHASE ONE CART FOR CSUN USE. MICHELLE BARRETT REPORTED THAT E&P STILL SHIRTS AVAILABLE FROM HOMECOMING AND OKTOBERFEST FOR $5 AND $10 RESPECTIVELY. JAMAL ALLEN INTRODUCED HIMSELF. MENTIONED THAT NEXT SEMESTER OSI WILL BEGIN RUNNING THE "CSUN REPORTS" RADIO SHOW ON KUNV. ANYONE WHO WANTS TO BE INTERVIEWED IS WELCOME. TYRONE SMITH (SENATE SECRETARY) "AS YOU HAVE JUST HEARD FROM CHIEF JUSTICE WALL THERE IS A CASE AND I WOULD LIKE TO READ SOMETHING I PREPARED TO THE SENATE. Before I begin, let me make it clear that I am speaking as Senate Secretary and that this will be entered into the minutes verbatum. I would like to begin by saying that I am disappointed with the attitude of some CSUN of-ficials that the JC is the only approach to solving problems in CSUN. That is not to say that the JC is always inappropriate rather I argue that the JC should be a means of last resort after all other resources have been exhausted. Unfortunately some of us lack the patience and the respect for this organization to use the criteria set up in the CSUN Con-stitution. This criteria sets up lines of communication and paves way for cooperation. Most problems could be settled if we were to take the time to discuss them amongst our-selves, with those who are are targeted. We should express our concerns and work together on a solution. The JC is set up to "decide appeals initiated by CSUN members on decisions of CSUN entities." and in my case there has been no decision made by any CSUN entity. SENATE MINUTES 20-02 PAGE 10 11/9/89 Last week Senator Gonzalez filed a complaint to the JC concerning alleged violations of Bylaw 29 which defines the responsibilities of the Senate Secretary. This complaint was filed without any discussion with Senate President, who my immediate supervisor and herslef was only made aware of the problem when the complaint was filed; nor was there any discussion with myself. Additionally, the same Bylaw 29 also states that the Senate may remove the Senate Secretary by 2/3 vote. Therein exists two steps in handling problems with the Senate Secretary, neither of which was taken advantage of. If after action or non-action by the Senate President and/or Senate left someone dis-satisfied,! belive only then would it be appropriate to file a complaint to the JC. Even then, and I was talking with Chief Justic Wall, the JC could only interpret Bylaw 29 unless the plantiff could prove malfeasence by the Senate Secretary and nonfeasence by the Senate President. Of course those two accusations imply that both purposely ignored problems at hand and/or continued to make the same violations. Of course the complaints at hand were not made clear and neither of us were given a chance to correct them if ap-propriate. The complaints made against me were that I violated Bylaw 29 by not having the minutes in the Senate boxes within 72 hours and the other was that I failed to post a meeting cor-rectly. I would like to point out first of all that these two instances are isolated. I would humbly accept this complaint if I showed a history of the same infractions. However, I have been Senate Secretary for over 2 months and taken notes at 9 meetings. I ponder whether this truly warrants a complaint or could it have been simply handled with a request to do my best not to let this happen again? I would like to quote from the complaint: "On the Oct., 19, 1989 meeting the minutes were not in my box until 6 days later on Wednesday. This constitutes an infraction of the Bylaw." I beg to differ. Let me read directly from the Bylaw 29. "Minutes of the Senate Meeting to be typed and submitted to the Senate President witin seventy-two (72) hours." Senator Gonzalez, you are not the Senate President and I am not required to have minutes in your box at any certain time. However, if the Senate wishes, I can do my best to get them in you boxes as soon as possible. But you must realize and keep in mind that before I can do that or time stamp them the Senate President must make corrections and sign them. As for posting the agenda incorrectly please accept my deepest apologies. I did fail to time stamp the agendas, and to post them in the CSUN offices. I guess this just goes to show that I am only human, yet I continue to do the best I canin my position. But lets remember that no great catastrophe came of this mistake, except for the one that may come of the pending complaints. SENATE MINUTES 20-02 PAGE 11 11/9/89 I would like to remind Senator Gonzalez of the mistakes he has made in his life that were unintended and honest in execution. Perhaps you could grant me the right to remain human. The final complaint asks for an interpretaion of the Senate Secretary's duties. I believe that the duties and responsibilities are explicitly outlined in the CSUN Bylaw 29. However, an additional reference is made to the other position I hold as OSI Co-Director. Perhaps Senator Gonzalez, you feel some sort of conflict exists. Perhaps I could have settled your concerns given a chance but you failed to even approach me. In spite of this, I believe that I can narrow this concern down to two meetings. Specifically the meetings in-volving the Yellin' Rebel computers and the one at which I was passing notes to Senator Rosenberg. During the debate concerning the Yell's computers it became apparant that I was in favor of an upgraded version of the system. During the meeting I was allowed to speak and limited myself to asking questions of the computer representative. I felt that since I was more knowledgable than most about the system, that I knew the right questions to ask. They were questions that I felt were important in helping Senators make an informed deci-sion. On the other hand, during the recess which was called by the Senate President, I ex-ercised my first ammendment right to free speech and attempted to lobby several Senators. Keep in mind that at this time I was not in any way acting as Senate Secretary. Once again, during open discussion I did express my opinion but, as I said then, it was my professional opinion based on my professional experience with that computer system. I ask you where is the conflict? Of course, I have learned a lesson and realized that there is a fine line. A line that I had not come near before that and a line I will not approach again as Senate Secretary. In contrast, there was a conflict implied during the meeting at which I was holding a dis-cussion with Senator Rosenberg by passing notes. This did take away from my duties as Senate Secretary. But let me point out the example I set by directly expressing my concerns to her. I had the consideration to keep it between us, yet by her choice others were brought in. Others I might add that attempted to convince Senator Rosenberg to file a complaint instead of working out the problem face to face. Fortunately Senator Rosenberg made the responsible decision. Today we share a very productive and amiable relationship. I might remind the Senate that we already live in a society filled with conflict. So let us begin to treat each other as fellow human beings who deserve the respect we expect of others. Let us begin to relate to each other as fellow human beings with a common goal: to better serve the Students of UNLV. Let us begin to remember that we all do the best we can and allow for mistakes. Let us offer solutions and progress. Let us view the mistakes we have made in the past build on our future. To quote someone famous, "United we stand, Divided we Fall". Let us become the example to follow. SENATE MINUTES 20-02 PAGE 12 11/9/89 I can think of many more pressing issues that Senators could be exerting energy to solve. Many of them were mentioned her tonight. If many of you would spend as much energy as Mario and Gorge have spent on their complaints on truly important issues perhaps CSUN could accomplish greater things. As I have said before, Senator Gonzalez, my door is always open. I challege you to cooperate with me so that we may resolve our differences. Perhaps then we could re-direct your great energy and intellect to more productive activities. Perhaps you could even think offer some suggestions for the CSUN survery that OSI is putting together. As of today, not one Senator has made any contributions. In closing I urge everyone in CSUN to think of themselves as a part of a team. A team that appreciates everyone of its members. A team that assists misguided members. A team that solves problems together. And I hope that this team won't put up with these kind of child-ish activities an more." Chief Justice Wall "Obviously Tyrone had the right to say these things. There is a certain question of appropriateness. The complaint was not filed to the Senate. That may be an objection in itself. The complaint is before the Judicial Council and to have somebody come up and argue their case before the Senate is certainly you have the right to do that yes, but don't confuse the Senate with the Judicial Council. Now if you feel that George has made a mis-take by filing a complaint to the Judicial Council instead of the Senate then that that is one thing. If you go to the Judicial Council and argue it and if you will write. It is very possible that there is a definate question of jurisdiction as to whether or not it should have been filed with us. But if you are going to argue the specific points of the complaint you should do so before the Judicial Council. Secondy, you took a statement that I made com-pletely out of context. I did not state that the JC could make no rulings concerning a Bylaw except to interopret it. Obviouslyt he constitution has to be implied and it has to go as a particular case. Now I was discussing this with you as I would anyone that has a case before the JC. Argueing specific points not committing to a specific position playing a little bit of devils advocate showing you what I think might be the strengths and weaknesses of your case, so that it can help you when you go before the JC. When I find that my statements are being taken completely out of context portrayed to the Senate that I hear that someone say the JC can't do anything about a bylaw except to interpret it, that's another matter. Another thing, discussing the JC's jurisdiction... The JC's jurisdiction is not limited to hearing appeals ok. There are 3 sections in our jurisdiction. One of them is interpretation. You also misportrayed the complaint in that respect. Jorge did not com-plain to the JC that we should interpret your position as Senate Secretary, he requested an interpretation, which any senator has the authority to do, remanding a question, in order to interpret the position of Senate Secretary and OSI director. We have jurisdiction to do that and it is completely out of place for you to be arguing it in front of the Senate al-though you have the right to do so.
