With respect to your memo to Karla Davidson dated August 22, 1977, it is my understanding that MGM's ASCAP/BMI performance license allows us to use the vast majority of these individual songs without securing written permission from individual music publishers. I am, of course, not a musical copyright expert. Nonetheless, in my opinion, we are in no way performing any of this material in a "dramatic rights11 fashion. Moreover, if you study the timings of each musical selection, you will find them (by the standards of most television or live stage productions) to be quite brief. The only production that would seem even remotely questionable is our Circus Finale, which, as you know, tributes MGM films and musicals; and even in this case you will notice that no parade float utilizes more than two songs, with the exception of SHOWBOAT, e.g., COTTON BLOSSOM WHY DO I LOVE YOU 0Lf MAN RIVER Also, we are using three songs from JUMBO: THE CIRCUS ON PARADE (early in the CIRCUS production) only these two in (raE M0ST BEAUTIFUt GIRL IN consecutive < ?Σ≤E W0RLD order (SAWDUST, SPANGLES AND DREAMS 07 sec, 14 17 1:00 :26 :46 I have also written a few special lyrics, as noted on the attached cue sheets. Although the lyric changes are minimal, I suppose permission for these few lyric changes should be secured. (note I have deleted FLYING DOWN TO RIO and replaced it with an original song, HEY, RENO ?╟÷ since the copyright owner was asking for payment.)
