H, Knickerbockers Advising you further re lative to the above, w ill say that Leo*s investigation confirms my le tte r of May 29, The records disclose that an ordinance was passed by the City Council o f Las Vegas over two years ago establishing street grades, and from the Information we have the grades then estab­lished by ordinance would not interfere with the water mains. When the recent move to pave the streets was brought about some months a&o, the city appointed an engineer who established new grades which in some instances required the streets to be cut to a greater depth than that established by the ordinance. The ordinance provided that the grades thereby established could be changed in case the City Engineer or the engineer appointed by the City fioramla si oners prepared a plat changing the grades, and had said plat approved by the Board of City Commissioners, The plat establishing the new grades, which is causing the d i f f i ­culty, was approved over a month ago, but no o ffic ia l notice was given to the Land and Water Company of any change of grades* At a meeting held Wednesday, May 15, 1929, the Board, of Commis­sioners did order the Land & Water Company to lower the mains, and from the time o f that order the company has acted with due diligence in the lowering of the mains where required, Leo concurs in my opinion that the Land & Water Company is not lia b le fo r any delay caused the contractor fo r pipe lines not being lowered* F.
