I agree.TERMS AND CONDITIONS 1. This order, if accepted, will be subject to delivery when available and at Seller's prices in effect at the date of shipment, provided that if the price at which the order is accepted or if, as the case may be, Seller's price in effect at the proposed date of shipment, should be nullified or reduced by reason of any law, governmental decree, order or regulation, Seller shall have the right to cancel this order upon written notice to the Buyer. 2. In the event of war, fire, flood, strike, labor trouble, accident, riot, act of government authority, act of God, or other contingencies beyond the control of the parties, interfering with the production, supply, transportation, or consumption of the goods covered by this contract, or with the supply of any raw material used in connection therewith, quantities so affected may be eliminated from the contract without liability, but the contract shall otherwise remain unaffected. Seller may during any period of shortage due to any of said causes, prorate its supply of such goods among itself, for its own manufacturing uses, and its accepted orders and contract customers, in such manner as may be deemed equitable. 3. Seller shall not be liable for any loss or damage resulting from the handling or use of the goods shipped hereunder whether in manufacturing processes or otherwise. 4. Acknowledgment of this order is based upon our ability to produce, and shall not be construed as a commitment as to either production or price on future orders. 5. The above terms and conditions govern the sale of goods covered by this order unless Seller and Buyer have heretofore entered into a written contract covering the sale of such goods.
