The official filing dates are February 2n d thru February 13th. B. Each candidate must complete a filing form which may be obtained from the CSUN Student Government Offices located on the 3r d floor of the Moyer Student Union from 8:00a.m. to 8:00p.m. Monday through Friday. Completed Packets must be returned and time stamped between 8:00a.m. and 5:00p.m. Monday through Friday. Packets received after 5:00p.m. on February 13th, will not be accepted. C. Filing Deposit: a. Each candidate shall pay a filing fee to CSUN at the time of filing. b. The filing deposit amount shall be $50.00 (Checks made payable to Board of Regents). c. If a candidate is cited and deemed in violation of election rules, the Elections Board may retain a portion of the filing fee for each infraction. d. The filing fee, or portion not retained, shall be refunded to the candidate as soon as possible following the election. Candidates must file for their refund within 15 days following the election. D. A candidate meeting will be held on the last day of filing for the purpose of explaining election rules and regulations. Attendance by the candidate and/or a proxy is mandatory. II. QUALIFICATIONS FOR CANDIDACY A. Qualifications for Executive Board candidacy are set forth in the CSUN constitution in Article IV, Section C (See page 4). B. Each candidate will be required to sign a waiver giving the CSUN Business Manager access to his/her academic records to determine eligibility (See page 7 of Filing Packet). III. ADVERTISING/CAMPAIGNING A. Official Advertising begins on the final day of filing (February 13th), following the required candidates meeting. B. All advertising materials must include the CSUN website (www.unlvcsun.com). C. Advertising includes, but is not limited to, the following: a. Speaking to individual students, classes and organizations as an official candidate. b. Hanging up posters, flyers (Candidates will receive a copy of all building posting policies on February 13th at the required candidates meeting). D. Official Campaigning begins at 8a.m. on the first day of elections (March 3r d Primary Elections, April 14th General Elections), and ends at 7p.m. on the last day (March 4t h Primary Elections, April 15th General Elections). E. Campaigning includes, but is not limited to, the following: a. Distributing campaign materials. i. Campaign material is defined as a handbill with the candidate's name on it and/or implies a certain candidate. F. Candidates are not allowed to post advertising/campaign materials on the UNLV campus, with the following exceptions, in the following manner: a. Personal property as pertains to residence hall bulletin boards (no soliciting). Permission must be given. b. Kiosks and bulletin boards on campus. i. Each candidate is limited to one (1) flyer per bulletin board or kiosk. ii. Advertising flyers may be no larger than 8 J4 by 11 inches in size. iii. Campaign handouts may be no larger than 8 V4 by I I inches in size. iv. Flyers may not be posted on walls, there must be a designated space for the hanging of flyers. c. All postings must be done in compliance with the rules set forth by the building. Any Questions, please direct them to the Elections Director and/or Elections Board Member. G. Candidates are not allowed to advertise, campaign, or be sponsored by any private business outside of UNLV; a. Writing on, painting, or posting materials on car windows constitutes off-campus advertising and campaigning. b. No off campus advertising and/or campaigning of any form is permitted. H. All advertising to classes are up to the discretion of the professor. I. Advertising/Campaigning via the internet can only be done through CSUN's OSI Director. Each candidate(s) webpage shall consist of the candidate's biography, picture, and any other information deemed appropriate by the Elections Board. The candidate's biography and picture shall be submitted by the required candidates meeting or it will not be posted. J. Emails may be sent to people, organizations, etc., but they may only be sent from someone that other than a candidate. K. Candidates shall submit samples of all advertising/campaigning materials prior to distribution or posting. Materials will be approved for both purpose and quantity. The material shall be kept on file until all election disputes have been settled. a. Samples will be approved by the Elections Board Director or Elections Board Member and at office hours only (Monday thru Thursday, 8a.m. to 8p.m., Friday 8a.m. to 5p.m.). b. Any candidate who is sponsored by a campus organization (i.e. money or supplies given for campaign) must submit material to be approved and cost accounted for (page 6 of the filing packet). i. All endorsements made by an organization must be in writing with the consent of the candidate and approved by the Elections Board Director or an Elections Board member. L. No campaigning or campaign materials will be permitted within twenty - five (25) feet of a polling booth during election days. Any campaign material within twenty - five (25) feet will be removed by an Elections Board member and candidate will be subject to a fine. M. All yard signs (stakes) will only be allowed after 10:00p.m. the day before the election and may only stay up the two days of the election. The signs must be posted in designated areas and must be in accordance with UNLV posting policies and procedures. Candidates must have approval from UNLV Grounds/Maitenance, prior to the election day, in order to place yard stakes in the ground. Stakes may be no larger than 11 inches by 14 inches and you are limited to three (3) stakes per area. N. All fines shall be assessed by majority vote of members present at the Elections Board meetings provided that a quorum is present; (Quorum is defined as fifty percent plus one, of the current membership of the board). a. Candidates/Proxies have the right to speak in defense of violations at the meeting the fines are being assessed. b. The Designated Elections Board member will notify candidates/proxies by phone and email to inform them of any fine. c. A written log of time and date the candidate's were contacted will be kept with the Elections Director. IV. ADVERTISING/CAMPAIGN EXPENDITURES/LIMITATIONS A. Campaigns for any office shall be subject to the following rules: 1. The candidate shall be limited in his/her expenditures (including monetary donation) on all leaflets, posters, raw materials, and any other advertising/campaigning to the following: a. CSUN Senators: $200.00 b. CSUN Executive Board: $500.00 2. Receipts will be required for all goods and services purchased or donated: a. For all goods where receipts are unavailable (amateur, self-made, or non commercial items), all candidates are expected to turn in an approximation of the fair market value; it shall be indicated on the candidates' spending and contributions statement, the final fair market value will be determined by the Elections Board. It is the candidate's responsibility to ensure the market value is appropriate according to the Elections Board, to avoid any overspending. b. For any advertised, on campus, organized activity that promotes a candidate or ticket, or any organized activity that hinders another candidate or ticket, provided it does not violate Article IV, Article V, and Article VIII of the CSUN Elections Rules. 2 c. Any candidate's signs that are destroyed prior to the election may be replaced by the candidate without reduction from their budget, provided proper evidence is shown to the Elections Board that the signs were destroyed. 3. Candidates who share expenses must each turn in a matched copy of receipts divided equally. 4. Contributions shall be defined as any gift, money, professional service, or donation that a candidate may receive, or have received, on his behalf for the purpose of campaigning. The value of such contributions must reflect the fair market value and must be indicated on the candidates' spending and contribution statement. 5. Any on campus events (i.e. organization BBQ, charity fundraiser, concert, etc.) that may be for the benefit of a candidate must be in compliance with all university regulations. 6. Applicable Nevada Statutes will govern contributions to candidates and their campaigns. Elections Board may set further limits (Nevada Statutes can be found at www.corporateservicecenter.com/Library/NVstatutes.htm') 7. Each candidate will be required to submit to the Elections Board one complete statement of all advertising/campaigning expenditures and contributions. These statements must be supported by receipts for all amounts; the statement shall include expenditures/contributions incurred by 7:00 p.m. on the second day of the elections. These statements must be submitted on the proper form to the Elections Board Director or a member of the Elections Board, initialed, and must be time stamped at the time it is turned in. a. The candidate will ultimately be held responsible for their documents to be time stamped. b. If it is determined that a candidate submitted a false or misleading statement that person shall be brought before the Elections Board for disciplinary action. c. If at any time during the tenure of the elected officers, it shall be proven that the officer submitted a false or misleading statement; it shall be deemed an impeachable offense. ( V. CONDUCT OF CANDIDATES A. Candidates must attend all required candidate meetings scheduled by the Elections Board Director. 1. The CSUN Student Government Elections Board will operate in compliance with Nevada Open Meeting Law per NRS 241. 2. If a candidate is unable to attend a meeting, a proxy shall be designated by the candidate to attend the meeting. 3. A proxy form authorizing the proxy shall be turned in during Roll Call at the Required Candidates Meeting. 4. The candidate is responsible for all the information at the meeting, even if a proxy attends the meeting in their place. B. All protests, challenges, and complaints must be submitted in written form to the Elections Board Director or to a member of the Elections Board, initialed, and time stamped at the time it is submitted, within three (3) days after the alleged infraction. 1. All candidates will be notified by the Elections Board Director or Elections Board member within one (1) working day, by phone or in person, if there is a complaint against them, and will be asked to attend the next scheduled Election Board meeting in their own defense. 2. All fines will be posted in MSU 311, following review by the Elections Director. 3. All complaints filed against a candidate will be made available within 24 hours at the CSUN reception desk (3r d floor MSU), with copies of written complaint. C. All candidates are expected to conduct themselves in a manner which would best represent CSUN and UNLV during his/her candidacy period. 1. Questionable conduct by a candidate or his/her supporters will be brought before the Elections Board and subject to fines upon investigation. 2. Conduct unbecoming includes, but is not limited to: a. threatening the Elections Board Director, Elections Board Members, other candidates, students, UNLV staff and representatives, etc. b. any profanity or abuse toward any of above mentioned | 3. No disturbing behavior towards the Elections Board Director or Elections Board Members will be tolerated. 3 D. Candidates will be held accountable for their own actions and those of their recognized supporters. 1. A recognized supporter is defined as anyone who is advertising or campaigning on the behalf of the candidate. 2. All candidates are responsible for informing recognized supporters of the Election Rules. 3. Candidates are responsible for any violations of the Elections Rules committed by recognized supporters. E. Candidates are not allowed to advertise or campaign for or with another candidate, unless they receive written permission from the candidate. a. Written permission must be turned into the Elections Board Director or a member of the Elections Board by the last day of elections. b. Candidates are not allowed to deface any other flyer. i. Defacing is defined as covering another flyer's material (examples will be given at the required candidate's meeting. VI. VOTING PROCEDURES A. Paper Ballot: 1. An undergraduate elector desiring to vote shall present his/her UNLV Rebel Card or another picture identification at the polling area. The election worker shall verify the card with a master list and hand the student a ballot. The elector will then proceed to mark the ballot. After voting, the elector shall place his/her ballot in the ballot box. Any elector voting more than once will lose his/her privilege to vote in this election and his/her ballot shall be rendered null and void. 2. If the elector is not on the master list, he/she must obtain verification of current UNLV credit hours and his/her college major from the Registrar's Office. 3. No absentee or proxy ballots will be permitted. 4. No write-in candidates will be permitted in the official ballot count. 5. In the Executive Board Elections, electors shall have a choice of voting for a candidate or for "none of the above." 6. If the "none of these candidates" ballot entry receives the wining total of votes then the candidate with the next highest number of votes shall be declared the winner in accordance with these rules (as stated in the CSUN Constitution Article IV, Section lc & Section 4). B. Electronic Voting: 1. In the event that paper ballot is not used, electronic voting machines provided by the Clark County Elections Department, will be the only form of voting. 2. All other rules (A. 2-6), will apply. VII. COUNTING OF BALLOTS A. At the close of Wednesday's voting, all the ballots will be safely and securely stored until counting commences on Thursday. B. Ballot boxes are to be opened in the presence of a minimum of two (2) Election Board members 1. If voting is electronic, poll tapes shall be processed in the presence of two (2) election board members. C. Each candidate is permitted to designate one (1) person (may not be the candidate) to function as an observer during the counting of the ballots in his/her election. 1. The designated person must check in with the Elections Board Director at least ten (10) minutes before the counting begins, and must observe in the area designated by the Elections Board Director. 2. A written form for the designated person will be given at the candidate's meeting that will need to be turned in to the Elections Board Director or Elections Board Member. D. Any individual creating a disturbance, as determined by the Elections Board Director, during the counting of the ballots shall be required to leave. I. CERTIFICATION A. The Elections Board and the hired elections firm shall certify that the elections for each race have been conducted in accordance with the Elections Rules, the operating policy of the Elections Board, and any other rules or policies governing elections including the CSUN Constitution and Nevada State laws and statutes. B. Certification of Elections by the Elections Director shall take place no later than March 11th, 2004 for Prmary Elections and no later than April 22n d , 2004 for General Elections, and verified by the Clark County Elections Department. IX. FINES A. Fines will be levied in accordance with CSUN Senate Bylaw 33, Article III, Section C (8) as follows: 1. Notification Process: The Director or Board members will notify each candidate of their fines, one time by telephone (this includes leaving a message) and by email. Fines will also be posted in the CSUN office, MSU 311. It is the candidates' responsibility to be aware of his/her fines and to appear at elections board meetings. a. If a candidate is notified of a violation of an advertisement material, the candidate will have 24 hours, from the time they were contacted to remove the problem, or they will be fined; (the 24 hours will start upon leaving a message as well). b. A log will be kept on the Elections Director's desk of times and dates contacts were made. 2. Candidates that accumulate fines in the excess of their total filing fee will be disqualified. 3. Candidates that do not turn in an expenditure form will be disqualified, even if the candidate spent $0.00, or ran unopposed. 4. Failure for candidate or proxy to attend a required candidate meeting will result in a twenty dollar ($20.00) fine. 5. Advertising/Campaigning prior to a date set by the Elections Board will result in disqualification. a. Advertising begins following the required candidates meeting at a time designated by the Elections Board Director. b. Campaigning begins the day of the Election and ends at 7:00p.m. the second day of the election. 6. Campaign material(s) including handbills placed by a candidate or supporter(s) within twenty-five (25) feet of voting areas will be assessed a fine of ten dollars ($10.00), per offense. 7. Campaigning within twenty-five (25) feet of the voting areas will be assessed a fine often dollars ($10.00), per offense. 8. Failure to submit samples of campaign materials, prior to using them, to the Elections Board Director or Elections Board member will result in a ten dollar ($10.00) fine per offense. a. If samples are not submitted within three (3) days after usage, the candidate will be disqualified. 9. Failure to adhere to the rules set forth by each building will result in a five dollar ($5.00) fine, per each individual building (building's will be defined at the required candidate's meeting). 10. Any candidate or candidate's recognized supporters proven to have removed, defaced, or tampered with another candidate's campaign materials will be fined fifty percent (50%) of their total filing fee. 11. A candidate who submits his/her campaign spending and contribution statement after the deadline will be assessed a ten dollar ($10.00) fine. a. If the campaign spending and contribution statement is not turned in by the time the ballots are finished being counted, the candidate will be disqualified. 12. Any candidate that is fined three (3) times for the same offense will be disqualified. This does not include defacing posting procedures. 13. Executive Board candidate expenditures over five hundred dollars ($500.00) will result in automatic disqualification. 14. Use of CSUN materials and services for the purpose of campaigning shall result in twenty-five dollar ($25.00) fine per offense (this includes Source Room materials as well as materials on the third floor such as): a. Use of copier, paper, computers, office supplies, senate boxes, or the offices is prohibited. 15. Candidates and candidates' recognized supporters are not allowed in any CSUN office while campaigning or while in possession of campaign materials unless those materials are being approved by the Elections Director or an Elections Board member. Violation of this rule will result in a ten dollar ($10.00) fine per offense. 16. Writing on or painting or posting materials on car windows constitutes off-campus campaigning and will result in a ten dollar ($10.00) fine per offense. 17. Conduct that is determined unbecoming of a candidate at the designated Elections Board meeting, shall be fined twenty five dollars ($25.00). 18. Candidates have until seven days after the election to remove advertising materials. Failure to do so will result in forfeiture of five dollars ($5.00) per offense and up to the remainder of the filing fee. 19. Any candidate that uses e-mail to campaign to persons unknown to the candidate will be fined fifty percent (50%) of their initial filing fee, per offense. 5 20. Campaigning with the use of the Internet, a website, or webpage's other than the one created by CSUN's OSI Director will result in disqualification. 21. Any candidate that hangs a banner (a banner is considered anything larger than 11 by 14) will be fined ten dollars ($10.00) per offense. By signing below, I am indicating that I understand and agree to comply with the rules and regulations set forth in the elections packet, understand the matter in which I must conduct my advertising and campaign, and have been further instructed on the points as stated below: 1. The CSUN Elections Director or an Elections Board Member must approve all advertising and campaign materials prior to posting or handing them out. The CSUN Elections Director or an Elections Board Member must also sign a sample of the material, time stamp it, and place it in the designated file located in the CSUN offices. 2. Verbal complaints will not be tolerated. Any and all complaints must be formally submitted in writing. Written complaints will be submitted to CSUN Election Board members only. The CSUN Elections Board member is to annotate the complaint with signature and time stamp, and give it to the Election Board Director. At the time of submittal, copies will be made with a copy to be furnished to the complainant. 3. The CSUN offices are not to be used as candidate campaign headquarters. Candidates are prohibited from using any office equipment and/or office supplies of CSUN Student Government, i.e. desk, chair, copy machine, tape, stapler scissors, paper, pens, pencils, markers, hole punchers, rulers, etc. 4. Candidate's may contact the CSUN Elections Director at her business office or email only if problems or questions arise. 5. Biographies must be submitted to the Elections Board by Friday February 20 tli, 2004 at the required candidates meeting. Please submit your biography on a clean disk in Microsoft Word format. Biographies are not to exceed two hundred and fifty (250) words. Pictures will be taken to accompany the biographies immediately following the required candidate meeting or by appointment with the Elections Director on or before Friday February 20t h , 2004. If the candidate does not turn in their biography or have their picture taken by the designated time, there will not be a biography or picture published or displayed for that candidate. 6.
