\ Section 4. Water Main Extensions, (a) Exten- \sio n s for DOMESTIC AND INDUSTRIAL SERVICES: Where an extension of a distribution main within the boundaries of the District is required in order to provide for one or more bona fide services other than fire services, the extension will be made by the District after the applicant has entered into a contract with the District therefor and has paid in advance the cost of the installation under the terms and conditions and at unit prices as follows: bize up to 18 Inches Inclusive: 500 feet Over ,1 . Extra construction costs due to rock excavation, railroad or state highway crossings, in rights of way or in other unusual locations, will be charged for at estimated cost, which cost shall be specified in the contract Mains over 8 inches in diameter will be charged for at estimated actual cost. The size of all mains will be determined by the District. If the District does not have all of the pipe and other materials available for the installation, the applicant may, if he desires, pay to the District ten per cent (10%) of the cost of the installation upon execution of the agreement and the balance when the pipe and other materials are available to the District. If the applicant fails to pay the balance of the cost within thirty (30) days after receipt of notice that the District is ready to proceed with the installation, the District may at its option retain all or any part of the advance payment of ten per cent (10%) to compensate it for any damage it may have sustained by reason of the failure of the applicant to make payment in full, and it shall be relieved of all responsibility to proceed with the installation. 6 The unit prices of pipe installations listed above will be increased or decreased 2 cents per linear foot for each $1.00 per ton increase or decrease in the cost of 6-inch cement lined cast iron water pipe delivered at the District’s Corporation Yard in Oakland, California, subsequent to June 1, 1946. The cost of such pipe so delivered will be determined by the District on the first day of each month. At the option of the applicant, in determining the amount of the payment required, credit of $100 will be deducted for each new bona fide domestic or industrial l service, two inches in size and smaller, that will be connected to the main included in the contract at the time of the installation of the main. One only such credit will be allowed for each individual property owner whose premises are to be served by the new main. For | each such service larger than 2 inches, the credit to be deducted will be in an amount determined as follows: Size of Service Credit Size of Service Credit 3" $200 8" $800 4" 300 10" 1200 6" 500 12* 1600 The contract will provide that the District will refund to the applicant on the amount paid by him, seventy per cent (70%) of all revenue received by the District from water sales and stand-by charges resulting from services directly connected to the said main or mains, excepting therefrom, however, fire hydrants, private fire services and services for which credits were originally allowed. Such refunds will be made as soon as practicable after January 1st of each year, and will be computed upon the revenue from such services for the preceding calendar year, until the entire cost advanced by the applicant has been refunded; provided, however, that no refunds will be made to the applicant for any revenues received by the District for water consumed through said services after ten (10) years from the date of the contract between the District and applicant for said extension, up to a maximum of the amount advanced to the District by the applicant. The term “bona fide service" as used in these Regulations is defined as meaning a water service to a residence or other building completed or substantially under construction, which service is to be put to immediate and permanent use. 7
