NEVADA 890IS Plume (702) 565-0792 ' ' ' Fax (702) 558-6459 August 26, 1997 PROFOSAL NO. 240-E Collegiate Election Services (CES) is a Nevada-based, small business that has been contracted previously with the Consolidated Students- University of Nevada (CSUN). CES's specialty is college and university elections and we are proud of the fact that we have never had an election conducted by us invalidated. We are a company that is environmentally friendly and utilizes recycled materials whenever possible. Also in adherence to Federal regulations, the equipment CES uses exceeds the recommendations of the Americans with Disabilities Act in regards to compliance and specifics. In regards to the TECHNICAL SPECIFICATIONS, Collegiate Election Services is an independent elections services company and the proposer, Allen Chastain has not been associated with CSUN for at least two (2) years. Allen, however has been involved in elections and the processes for over fifteen years and this company has been in business since 1991. CES was contracted to perform the last two Executive, Senate, and Homecoming elections at UNLV. CES has also orchestrated the Student Government election at the Community College of Southern Nevada, which dealt with the unique situation of having polls at three different locations in Clark County (Cheyenne, Charleston, and Henderson campuses). These student ^ elections have been handled smoothly and efficiently because of the on-site supervision and close monitoring during the election. Therefore, CES not only has the knowledge, but has the " experience of conducting student elections. In addition, the employees that work for CES haye been specifically trained to run the student elections at UNLV. CO In accordance to all applicable Federal and State laws as well as CSUN rules, CES has developed a viable procedures package for the student government elections. All locations will be supplied with votomatic booths, punchable ballots and additional election supplies needed to operate a successful election. The materials that CES utilizes for students with impairments is considered standard equipment and does not increase the cost of the service. The Election Processing Procedure is quite simple if it is done correctly. The polls open promptly at 9 00 A.M. on the first day of the election. The student walks up to the booth. The student asks to vote or the employee inquires if the student wants to vote. The employee asks the following questions to determine eligibility. Are you an undergraduate at UNLV9 Are you currently enrolled at UNLV, taking at least one (1) credit? Do you have a photo ID with your social security number and may 1 see it9 COLLEGIATE ELECTION SERVICES Allen Chastain Proposal 240-H If the student answers yes to all those questions, they can continue. If they answer no to at least one of those questions, the student can not Vote. If the student is allowed to proceed, the student is asked to print their name, sign their hame, write the last four (4) digits of their social security number down in the space provided on a sign-in sheet. m-a Example co Ballot N'o. Prim Name Last 4 dign^ SSN' As the student is filling out the sign-in sheet, the employee takes the student's ID and looks up the student's name in the roster supplied by CSUN. The employee checks the SSN to verify that it is the right student. Behind the name, the employee writes down the ballot number and highlights the student's information on the roster with a marker. When all that is completed, the student is given a ballot. When the employee is looking for the student's name in the roster and it is not to be found, we at CES have devised a solution to handle that problem. In years past, when faced with this situation, it was the student's burden to go get the necessary paperwork from the Registrar's office to prove that they were indeed entitled to vote. Sometimes the students thought it was to much of a bother or the registrar's office was close, but whatever the case, the student did not vote. CES fixed that problem by designing a challenge ballot. What we would do is get the student's approval to have the appropriate officials check their eligibility. But instead of having the students go to the registrar's office, they would be allowed to vote and then their status would be checked. If they were not eligible, the ballot would be purged from the totals. Last year in the CSUN General election that CES performed, we had over thirty people issued challenge ballots and of the thirty, only two persons were not eligible to vote. After the student is issued a ballot, they are asked if they know how to vote using the votomatic If the student is unaware or says no, the employee explains the process. The student is then allowed to vote in privacy. After the voting is complete, the student returns to the employee and gives the employee the ballot. The employee removes the top part of the ballot, gives the student the voting stub and the bottom portion goes into the ballot box. The student is then given back their ID card and the voting is complete. The process continues for each voter until the polls close for the night. OiZ'J r-J o The votomatic is a multi-page "booklet" that has the names of the candidates printed among the pages The student places the ballot through the slot in the top of the votomatic and align the two Allen Chastain Proposal 240-H red studs with the holes in the top of the ballot. The student casts their vote by using the stylus (the punch), to poke a hole next to the arrow, next to the name of the candidate. To vote for the different positions, the student only has to turn the page. The ballots are number 312 reader cards that have pre-slotted areas to register the student's selection. Students with disabilities have been acknowledged by CES and we have made considerations for the student to vote at any booth on campus. CES has trained it? employees to make available the election process for all students. The owner has attended classes on how to facilitate the voting process for persons with disabilities and consequently, all the employees of CES have been trained. x GmO - If a student is visually impaired, CES has made the following accommodations- «_o Printed ballot in a larger font. _ Magnifying sheets at each booth. * To actually read the ballot to the student and aid them in their voting. If the student is in a wheelchair or otherwise physically incapacitated- cd The booths are adjustable to accommodate the height of the wheelchair. The votomatics can be taken out of the booth and hand-held so student can vote in comfort. Our goal/duty is to create an environment that will enable any eligible person the ability to vote. If in doing so, the election company has to make any adjustment to accommodate a disability we frill not hesitate, as long as that accommodation does not in any way jeopardize the integrity of the election. The voting will stop at seven o'clock P.M. unless the two following situations arise. If a student is waiting in line to sign up to vote or if a student has already signed up but is waiting to cast their ballot. In either case, the employee will allow those students who were in line the right to vote. No new student will be allowed to walk up to the polls and get processed after seven o'clock P:M. Once both lines are gone, that is when the employee can close down that poll. If a student is in line at seven o'clock P.M., it does not matter if the line takes two hours to finish, that poll stays open, so the student can vote. After the polls are closed, the workers return the equipment to a centralized location (usually in front ofCSUN) so that it can be secured for the next day or so that the ballots can be tabulated. The next process deals with the Counting of the Ballots. On the second day of the election after the polls are closed, a designated area will be set aside for the counting of the ballots. CES likes to have the counting done in an open area in which the candidates can see the procedure but they can not see the vote totals. The need for openness is crucial and CES believes having the candidates able to see the counting minimizes any thoughts of improprieties. uixc uic uduoi uu.\es scan. arriving at the central location, one election employee is designated to watch the boxes and ailOw no unauthorized person near them. Once all the ballot boxes have arrived, the employee watching the ballots, the employee who counts the ballots, the Election Director, and the appropriate CSUN official (usually the CSUN lawyer), will start the counting. The ballot boxes are opened one at a time. Just before the boxes are opened and after they are unsealed, there is a preliminary inspection to see if the boxes have been tampered. Once the box is opened, the ballots are hand-fed into an electronic ballot counter. During the count, the ballots are periodically sub totaled, so that in the case of a power outage or some other mishap, the counting would not have to start over. The actual counting of the ballots does not take that long and CES usually has the count completed within an hour after tabulation starts. The actual machine that does the counting is a portable unit that has a print-out of the totals similar to a calculator. It can be calibrated so that if a student votes for more choices than they are entitled, the counter "reads" that ballot and disallows that vote. The sensors in the counter also acknowledges spindled or mutilated ballots. If the counter is unable to read a ballot, it emits a beeping sound. When that happens, the person running the machine reteeds that ballot through the counter. If it happens again, that ballot is set aside and is manually counted after that area's ballots are tallied. On the register tape, when a "bad" ballot is scanned, it is called an error byt->it does not affect the actual tabulation of the ballots. After the one location is counted, the ballots . are rubber-band together and placed back in the ballot box and it is locked, place to the side i a a secured area and the next box is opened and the procedure continues. t-o The "lawyer takes the location's printout and writes on the top of the paper the location and ofre number of votes. After all the boxes are opened, the lawyer counts the totals of all the printouts^ <% a* c_o After all the locations are counted by the machine, we have to get the results of the verification. Verification starts after the polls close and at the same time the ballots are being counted. At each location there was a roster which had the names of the students. For the CSUN elections we will have ten locations and thus ten complete roster to verify. To check that nobody voted more than once, the employees verifying the election must go through each page to look for duplications. The highlighting of the names makes it easier to spot who voted per page and the process goes quite fast. If, during the process, the employees come across a student who voted more than once, they write on a master sheet the ballot number of all the ballots that student used. Due to the fact that the student voted more than once, all votes made by that student will be purged. That is why it is important that we write down the ballot number next to their name on the roster. By verifying the election this way, this is the best way to acknowledge an illegal ballot while maintaining the integrity of the election. .After the verification is completed, the master list is given to the Election Director. That person calls out the number of the ballot and the employee who oversees the boxes opens the appropriate '"Hot box and retrieves the ballot in question. Override of Senator Matt Stark's 3rd Unexcused Absence. SENATOR STARK apologized for being absent at the last meeting and explained why he was unable to attend the meeting. In response to a question, he stated that he had no excuse for the other unexcused absences. SENATE PRESIDENT MOORE stated that those were over the summer and SENATOR STARK just forgot to call him. STUDENT BODY PRESIDENT MILLS announced that SENATOR STARK had called and left a message on his voice mail that said that he tried to reach Tricia Nix, the Senate Secretary, and Terry Moore to let them know that he couldn't make it to the meeting. SENATE PRESIDENT MOORE added that granted that he had a test the next day he would have given SENATOR STARK an excused absence. Move into a vote. Motion passes 14-1-2. (SENATOR FISK opposed, SENATOR FLEISCHMAN and SENATOR HAYES abstained.) SENATE PRESIDENT MOORE announced that SENATOR STARK can now vote. The Senate now sits at 18 Senators present. B. Guest Speaker; Regent Dorothy Gallagher SENATE PRESIDENT MOORE introduced REGENT GALLAGHER. He stated that kEGENT GALLAGHER was the Vice Chair of the Board of Regents from 1982-84 and again from 1987-89; then moved up to be Chair of the Board of Regents from 1989-91; has also served as Chairman and member of virtually every committee that the Board of Regents has ever created; has done an outstanding job and really loves Student Government. //Applause.// REGENT GALLAGHER stated that she started off in Student Government and this is where you start. She stated that the problem we have within the country is not having enough participation by the people and enough voters. She announced that she celebrated her 72nd birthday yesterday. //Applause.// She stated that she is glad to CSUN taking their responsibility seriously and are just starting to get ready do this because they are not going to do it just here, they are going to be responsible for the rest of their lives as wives, husbands, parents, etc. She referred to the Senate as a "great big workshop for the rest of your lives because you're learning a lot here." She added that they had a discussion about autonomy and went on to state, "nobody really has it. I often tell people when they say on the Board (of Regents), 'well, the legislature can't do that. We are constitutionally mandated.' I said that's very true. The Regents are constitutionally mandated, but when they did that mandate they neglected to give us the printing press to print the money to take care of the mandate. So, for that reason, we, even though we are constitutionally mandated, are not autonomous. We're very responsible to a lot of people, and just as you are. You people are responsible to the students that elected you. I'm responsible to the people that elected me. You're responsible to this institution that you serve. I also am responsible to you people and the institution within the system." She "scussed her history within the system and stated, "If you're going to spend the kind of money we ^pend, someone had better act like it's a business. Someone had better feel responsible when it's 2 SENATE MINUTES 27-26/ September 15, 1997 somebody else's money...you don't have to agree and be crazy about everybody, but you must be able 1 work together and you must be able to respect each other." SENATOR HAYES commended the Board of Regents for the changes made in the College of Education. In response to a question, she stated that she really doesn't know why some Regents aren't in support of funding the debate program. In response to questions, she stated that regarding community service and volunteerism "responsible people will usually respond to something when they think they feel they're doing some good;" and she stated that she thinks a leader should hear both sides of an issue and have all the facts before making a decision. SENATE PRESIDENT MOORE asked DIRECTOR FINKELSTEIN to approach the Chair and gave him all the tickets minus the CSUN tickets (2877 - the 60 CSUN tickets). He stated that he went with SENATOR CECI to pick them up from the Thomas and Mack at approximately 3:00 p.m. this afternoon. He announced that "Ticketgate is over." Motion to move back into the order of the day made SENATOR TRUJILLO, seconded by SENATOR POOLE. Move into a vote. Motion to move back into the order of the day passes 19-0-0. III. APPROVAL OF MINUTES: SENATE PRESIDENT MOORE announced that the reason we have minutes from the 25th / ission up for approval is because we have the tape, but the written minutes were never done. So, he commended the Senate Secretary on her initiative for taking it upon herself this summer to start doing those. He announced that he looked through them and signed them on behalf of former SENATE PRESIDENT SMITH. He stated that he contact former SENATE PRESIDENT SMITH who then stated that he didn't have a problem with that. Move into a vote. Motion to Approve Minutes 27-25 and Minutes 25-27 passes 19-0-0. V. BOARD AND COMMITTEE REPORTS: A. Senate Committee Reports: 1. SENATOR FLEISCHMAN announced a Campus Safety and Awareness meeting Tuesday at 2:30 p.m.. SENATE PRESIDENT MOORE asked Campus Safety and Awareness to investigate a theft in the office on Wednesday between 9:45 p.m. and Thursday morning at 11:15 a.m.. 2. SENATOR GRIFFITH announced that Bylaws is still trying to meet because they didn't make quorum. She asked that everyone get her their updated schedules. SENATE PRESIDENT MOORE asked the Senators on the committee who cannot make the meeting times to please resign so that they can make quorum. ( 3 SENATE MINUTES 27-26/ September 15, 1997 3. SENATOR MILMEISTER announced that the Impeachment Committee held ! eir first meeting last Friday where they discussed the assignment of charges and the charges under investigation. He stated that they will come back this Friday at 5:30 p.m. in room 204 to discuss the charges that are under investigation and let PRESIDENT MILLS respond to the charges. SENATOR MILMEISTER stated, "PRESIDENT MILLS, I just wanted to let you know that I have the wrong room on the agenda. It's going to be in room 204 at 5:30 p.m. up here in MSU. I'll write that down for you later." SENATE PRESIDENT MOORE asked, "That's also referred to as the Fireside Lounge, correct?" SENATOR MILMEISTER replied, "I believe so, Mr. Chairman." 4. SENATOR STARK announced that Ways and Means will meet Thursday at 2:30 p.m. in the Senate Chambers. He stated that the big thing on the agenda are the CSUN Organization Funding Request packets and he passed them around. SENATOR LIDEROS addressed Campus Safety and Awareness and asked them to look into fire evacuation. He stated that there are no fire evacuations posted in the classrooms nor are teachers aware of the fire evacuation plan. B. Faculty Senate/University Committee Reports: There weren't any reports. C. Director Reports: - 1. NSA DIRECTOR CONTINE stated they brought House Minority Leader, Dick Gephardt to UNLV along with Regent Shelley Berkley. He stated that they had a good turnout and education issues were discussed. He went on to state that they are still continuing to organization the Third Party Debate which is their next event coming up. SENATE PRESIDENT MOORE commended DIRECTOR CONTINE on a well-planned event. DIRECTOR CONTINE stated that he will request a copy of the transcript from the event. SENATOR .HAYES also commended DIRECTOR HAYES on doing a good public relations job. 2. Elections Board DIRECTOR FLEISCHMAN announced that they had Senate candidates meeting today. She then announced that the Elections Board will be using the cart all day 17-18 September and 1-2 October. She also announced that Josephine Benetti withdrew as an Elections Board member. She stated that there is nothing she can do to change the election dates on 1-2 October because that it the way it is written in the Constitution and suggested going through the process to get it changed. She stated that they want to print an apology in the OSI page to say that the Elections Board acknowledges the conflict of the Jewish holiday being on those days. She asked that for those candidates or voters who cannot make it due to the holiday to please vote Wednesday from 9:00 a.m. until sundown. She stated that they finally got the Polaroid camera and it works great. She also stated that fines have been posted in the office and still some fines pending Election Board approval. She announced that the next meeting will be Friday at 6:00 p.m. in room 202 which is a mandatory Homecoming candidates meeting. She asked that the Senate on the agenda if somebody ^uld put item G before item B. In response to a question, she recommended revising the constitution to state "if there is a conflict that impedes candidates' ability to effectively campaign for 4 SENATE MINUTES 27-26/ September 15, 1997 office..." SENATE PRESIDENT MOORE added that Jewish people follow a 13 month calendar and ;e Jewish New Year moves, so it was a fluke that it just happened to fall on these two days. SENATOR TRUJILLO strongly recommended looking into this for next year and to please be very careful in the wording. In response to a question, DIRECTOR FLEISCHMAN stated that the general rule of thumb is that you vote in the first college and recommended doing a challenge ballot through the elections services and a letter from the registrar saying that you are a major for the college that you are voting and that you are only voting in that college. In response to another question, DIRECTOR FLEISCHMAN suggested placing the rules on the table to try and avoid problems and when an elections company is chosen they will sit down and discuss any rules that apply. 3. O-Board DIRECTOR FINKELSTEIN expressed relief that the ticket situation has been solved. He then announced that they will be distributing the tickets at 9:00 a.m. downstairs right by the ID booth tomorrow until about 5:00 p.m..
