5* You agree that you will fully comply with all rules and regulations of any unions and guilds over any of the materials, services, facilities and personnel in con- nection with the presentation having jurisdiction in the premises. You agree to furnish, at your sole expense, such musicians, including musical contractor, as may be required by any national or local union for and in connection with this engagement and rehearsal. Our obligation hereunder is subject to detention or prevention by sickness, inability to perform, accidents, means of transportation, acts of God, riots, strike, labor difficulties, epidemics, any act or order of any public authority or any other cause beyond our control. You agree to compensate us in accordance with the terms contained in this Agreement regardless of inclement weather, strike, lockout, or any act of God which would pre- vent the presentation of the performance to be presented hereunder. 6. You agree that Mr. Skelton shall receive sole star billing in all advertising and publicity issued by or under your control in connection with the presentation here- under, and he shall receive sole star billing on any marquee in connection with any performance, and no other person shall receive billing in size of type or prominence equal to or larger than that accorded to Mr. Skelton. 7. You agree that you will not permit any still or motion pictures or radio or television broadcasting of the performance without our express prior written approval. You further agree that no working or selling of concessions will be permitted on the premises during Mr. Skelton*s performance. 8. This Agreement shall be governed by and construed in accordance with the laws of the State of Californiaapplicable to contracts executed and fully to be performed therein. This writing constitutes the entire agreement of the parties. There is no representation, warranty, obligation or condition except as herein expressly contained. Any waiver, modification or termination of this Agreement must be in writing signed by thcw party to be charged. Nothing herein shall constitute any agency, joint venture, partnership or employment relationship between the parties. You shall not have the right to assign this Agreement or any part thereof.
